Hazal Aslami reported: Ma'iz came to the Prophet (ﷺ) and said: I have committed fornication, so pronounce judgment on me according to the Book of Allah. He (the Prophet) turned away from him. He (Ma'iz) made confession four times and he (the Prophet) said: Go and stone him. When the stones troubled him, he fled. `Abdullah b. Unais chased him and struck him with the thigh-bone of a camel. He cried aloud and the people too stoned him (to death). This (the fact that Ma'iz fled) was reported to the Prophet (ﷺ) and he said: Why did you not leave him that he might have repented to Allah, and Allah might have accepted his repentance? O Hazal! If you had covered him with your cloth, it would have been better for you than what you did to him.

(١٦٩٥٨) ہزال اسلمی کہتے ہیں کہ ماعز نبی (صلی اللہ علیہ وآلہ وسلم) کے پاس آیا اور کہا کہ میں نے زنا کرلیا ہے۔ مجھ پر کتاب اللہ کے مطابق فیصلہ فرمائیں۔ آپ نے اس سے اعراض کیا یہاں تک کہ اس نے چار مرتبہ اعتراف کیا تو آپ نے فرمایا : جاؤ اسے رجم کر دو ۔ جب اس پر پتھر پڑے تو وہ تکلیف سے بھاگا تو عبداللہ بن انیس نے اسے گدھے کی ہڈی ماری تو وہ چیخا اور لوگوں نے بھی مارے یہاں تک کہ وہ مرگیا۔ جب اس کے بھاگنے کی بات نبی (صلی اللہ علیہ وآلہ وسلم) کو بتائی گئی تو آپ نے فرمایا : ” تم نے اسے چھوڑ کیوں نہ دیا کہ وہ اللہ سے توبہ کرلیتا۔ “ اے ہزال ! اگر تو اسے کپڑے سے ڈھانپ لیتا تو تیرے لیے یہ زیادہ بہتر تھا اس سے جو تو نے کیا۔
(16958) Hazal Islami kahte hain ki Maaz Nabi ((صلى الله عليه وآله وسلم)) ke pass aaya aur kaha ki maine zina kar liya hai. Mujh par kitab Allah ke mutabiq faisla farmaen. Aap ne us se airaz kiya yahan tak ki us ne chaar martaba iqrar kiya to aap ne farmaya: Jao usey rajm kar do. Jab us par pathar pade to wo takleef se bhaga to Abdullah bin Uneys ne usey gadhe ki haddi maari to wo cheekha aur logon ne bhi maare yahan tak ki wo mar gaya. Jab us ke bhaagne ki baat Nabi ((صلى الله عليه وآله وسلم)) ko batai gai to aap ne farmaya: "Tum ne usey chhod kyon nah diya ki wo Allah se tauba kar leta." Aye Hazal! Agar tu usey kapde se dhaanp leta to tere liye ye zyada behtar tha is se jo tune kiya.
Abu Waqid Al-Laythi reported: A man came to 'Umar (RA) in Syria and said that he had seen another man with his wife. 'Umar (RA) sent Abu Waqid to his wife to confirm. He went to his wife while she was surrounded by women. Abu Waqid told her everything and said that she would not be punished if she confessed. A woman beside her told her to deny it. She refused to deny it and confessed. She was then stoned to death on the order of 'Umar.
Imam Shafi'i (RA) said that 'Umar and 'Uthman, when they stoned women to death, did not say that they themselves witnessed the act.

(١٦٩٦٠) ابو واقد لیثی فرماتے ہیں کہ حضرت عمر (رض) کے پاس شام میں ایک شخص آیا۔ اس نے کہا کہ اس نے اپنی بیوی کے ساتھ ایک دوسرے مرد کو دیکھا ہے تو حضرت عمر (رض) نے ابو واقد کو اس کی بیوی کے پاس تصدیق کے لیے بھیجا تو وہ اس کی بیوی کے پاس آئے۔ اس کے ارد گرد عورتیں تھی تو اسے ابو واقد نے ساری بات بتائی اور کہا کہ اس کے کہنے پر آپ کو سزا نہیں دی جائے گی تو اس کی ساتھ والی اسے کہنے لگی کہ تو انکار کر دے تو اس نے منع کردیا کہ میں انکار کروں اور اقرار کرلیا تو حضرت عمر کے حکم پر اسے رجم کردیا گیا۔
امام شافعی (رح) فرماتے ہیں کہ حضرت عمر نے اور حضرت عثمان نے جب ایک عورت کو رجم کیا تھا تو خود حاضر ہونے کا نہیں کہا تھا۔
(16960) Abu Waqid Laithi farmate hain ki Hazrat Umar (RA) ke pass Sham mein ek shakhs aaya. Usne kaha ki usne apni biwi ke saath ek doosre mard ko dekha hai to Hazrat Umar (RA) ne Abu Waqid ko uski biwi ke pass tasdeeq ke liye bheja to woh uski biwi ke pass aaye. Uske ird gird auratain thi to use Abu Waqid ne sari baat batai aur kaha ki uske kahne par aapko saza nahi di jayegi to uski saath wali use kahne lagi ki tu inkar kar de to usne mana kar diya ki mein inkar karoon aur iqrar kar liya to Hazrat Umar ke hukm par use rajm kar diya gaya.
Imam Shafi (RA) farmate hain ki Hazrat Umar ne aur Hazrat Usman ne jab ek aurat ko rajm kiya tha to khud hazir hone ka nahi kaha tha.
Malik said that it reached him that 'Uthman gave orders that a woman be stoned to death and she was stoned to death. This is the shorter version of a longer hadith.

(١٦٩٦١) مالک کہتے ہیں کہ انھیں یہ بات پہنچی کہ حضرت عثمان نے ایک عورت کے رجم کرنے حکم دیا اور اسے رجم کیا گیا۔ یہ لمبی حدیث سے مختصر ہے۔
(16961) Malik kehte hain ki unhen ye baat pahunchi ki Hazrat Usman ne ek aurat ke rajm karne hukm diya aur use rajm kiya gaya. Ye lambi hadees se mukhtasir hai.
