Chapter: What is mentioned about one who marries a woman but does not consummate the marriage and then commits adultery
باب ما جاء فيمن تزوج امرأة ولم يمسها ثم زنى
Sunan al-Kubra Bayhaqi 16945
Saeed bin Musayyab was asked about a man who got married, but did not consummate the marriage with his wife, and then committed adultery. He said: The Sunnah in this regard is that he should be flogged, and not stoned to death.

(١٦٩٤٥) سعید بن مسیب سے ایسے شخص کے بارے میں پوچھا گیا جس کی شادی ہوئی ، لیکن اپنی بیوی سے وطی نہیں کی، پھر اس سے زنا ہوجائے تو ؟ فرمایا : اس میں سنت یہ ہے کہ اسے کوڑے مارے جائیں رجم نہ کیا جائے۔
(16945) Saeed bin Musayyab se aise shakhs ke baare mein poocha gaya jis ki shadi hui, lekin apni biwi se wati nahi ki, phir us se zina hojae to? Farmaya: Is mein sunnat yeh hai ki use kore maare jaen rajm na kiya jae.
Samak bin Harb narrates that a man from Banu Ajl told me that during the Battle of Siffin, I was with Ali when suddenly a man started shouting: "I have committed fornication, establish the prescribed punishment on me." I took him to Ali. Ali (R.A.) asked: "Are you married?" He said: "Yes." He asked: "Have you consummated the marriage?" He said: "No." So he ordered him to be given a hundred lashes and gave half the dowry to his wife and separated them.

(١٦٩٤٦) سماک بن حرب کہتے ہیں کہ بنو عجل کے ایک شخص نے مجھے بتایا کہ جنگ صفین میں میں حضرت علی کے ساتھ تھا کہ اچانک ایک آدمی چیخنے لگا : میں نے زنا کرلیا ہے، مجھ پر حد قائم کی جائے۔ میں اسے علی کے پاس لے گیا۔ حضرت علی (رض) نے پوچھا : شادی کی ہے ؟ کہا : ہاں، پوچھا : بیوی سے دخول بھی کیا ہے ؟ کہا : نہیں تو اسے سو کوڑے مارے اور بیوی کو نصف حق مہر دلوایا اور ان کے درمیان جدائی کروا دی۔
Simak bin Harb kahte hain ki Banu Ajl ke ek shakhs ne mujhe bataya ki jang Safeen mein main Hazrat Ali ke sath tha ke achanak ek aadmi cheekhne laga: main ne zina kar liya hai, mujh par had qaim ki jaye. Main ise Ali ke pass le gaya. Hazrat Ali (RA) ne pucha: shadi ki hai? Kaha: haan, pucha: biwi se dakhol bhi kiya hai? Kaha: nahi to ise sau kore mare aur biwi ko nisf haq mehr dilwaya aur in ke darmayan judai karwa di.
Hansh bin Mu'tamir reported that one of us married a woman, then before having intercourse with her, she committed fornication with another. So Hadrat 'Ali inflicted the prescribed punishment on her and the woman also did not want to live with him; so he (Hadrat 'Ali) separated them.
The Shaikh (al-Bukhari) said: The separation between them was judicially. We do not say this, and it is also likely that they were separated by their consent.

(١٦٩٤٧) حنش بن معتمر کہتے ہیں کہ ہم میں سے ایک آدمی نے ایک عورت سے شادی کی، پھر دخول سے پہلے اس نے کسی سے زنا کرلیا تو حضرت علی نے اس پر حد لگا دی اور عورت نے بھی اس کے پاس نہ رہنا چاہا تو ان میں بھی جدائی کروا دی۔
شیخ فرماتے ہیں کہ ان کے درمیان جدائی حکماً تھی۔ ہم یہ نہیں کہتے اور اس بات کا بھی احتمال ہے کہ ان کی رضا مندی سے تفریق کرائی گئی ہو۔
Hinsh bin Muata'mar kehte hain ki hum mein se aik aadmi ne aik aurat se shaadi ki, phir dukhool se pehle usne kisi se zina karlia to Hazrat Ali ne us par hadh laga di aur aurat ne bhi uske paas nah rehna chaha to un mein bhi judai karwa di. Sheikh farmate hain ki unke darmiyaan judai hukman thi. Hum yeh nahin kehte aur is baat ka bhi ehtema'l hai ki unki raza mandi se tafreeq karaai gayi ho.
Abu Zinad said: "I heard the jurists of Medina saying: 'If a man is married, but has not had intercourse with his wife, then commits adultery, he is not to be stoned. The same applies to a woman. Also slave women and mothers of children are not to be stoned."

(١٦٩٤٨) ابو زناد کہتے ہیں کہ میں نے فقہاء اہل مدینہ کو یہ فرماتے ہوئے سنا کہ جو آدمی شادی شدہ ہو، لیکن بیوی سے نہملا ہو، پھر اس سے زنا ہوجائے تو اس پر رجم نہیں ہے اور عورت بھی اسی طرح ہے اور لونڈیوں اور اوالاد کی ماؤں پر رجم نہیں ہے۔
(16948) Abu Zinad kahte hain ki maine fuqaha ahle Madina ko ye farmate hue suna ki jo aadmi shadi shuda ho, lekin biwi se na mila ho, phir us se zina hojae to us par rajm nahin hai aur aurat bhi isi tarah hai aur londion aur aulad ki maaon par rajm nahin hai.
