Aisha (may Allah be pleased with her) narrated that the Messenger of Allah (peace and blessings of Allah be upon him) said: "The hand should be cut off for a quarter of a dinar or more (that is stolen)."

(١٧١٥٦) حضرت عائشہ (رض) فرماتی ہیں کہ رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : دینار کے چوتھے حصہ یا اس سے زیادہ (سامان چوری کرنے ) پر ہاتھ کاٹ دیا جائے۔

(١٧١٥٧) حضرت عائشہ (رض) نبی (صلی اللہ علیہ وآلہ وسلم) سے نقل فرماتی ہیں کہ ہاتھ کا کاٹنا دینار کے چوتھے حصہ یا اس سے زیادہ (کی مالیت پر ہے) ۔
Hazrat Ayesha (Razi Allahu Anha) Nabi ((صلى الله عليه وآله وسلم)) se naqal farmati hain ke hath ka kaatna dinar ke chauthe hissa ya is se ziada (ki maliyat par hai).
Aisha (may Allah be pleased with her) reported: The Prophet (peace and blessings be upon him) said: "The hand of the one who steals a quarter of a dinar or more should be cut off."

(١٧١٥٩) حضرت عائشہ (رض) فرماتی ہیں کہ نبی (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : دینار کے چوتھے حصہ یا اس سے زیادہ مال چوری کرنے والے کا ہاتھ کاٹ دیا جائے۔

(١٧١٦٠) حضرت عائشہ (رض) فرماتی ہیں کہ رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : دینار کے چوتھے حصہ یا اس سے زیادہ مال چوری کرنے پر ہاتھ کا کاٹنا ہے۔
Hazrat Ayesha (Razi Allah Anha) farmati hain ke Rasul Allah ((صلى الله عليه وآله وسلم)) ne farmaya: dinar ke chauthe hissa ya us se ziada mal chori karne par hath ka katna hai.
Narrated Aisha (RA): The Prophet (SAW) said: The hand of a thief should be cut off for (stealing) a quarter of a dinar or more. In the narration of Harmalah: Aisha (RA) said that the Prophet (SAW) said: The hand of a thief should not be cut off but for (stealing something) the value of which is a quarter of a dinar or more.

(١٧١٦١) حضرت عائشہ (رض) فرماتی ہیں کہ نبی (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : چور کا ہاتھ دینار کے چوتھے حصہ یا اس سے زیادہ کے مال پر کاٹا جائے گا۔ حضرت حرملہ کی روایت میں ہے کہ حضرت عائشہ (رض) فرماتی ہیں کہ نبی (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : چور کا ہاتھ نہیں کاٹا جائے گا مگر دینار کے چوتھے حصہ یا اس سے زیادہ کی مالیت میں۔
Hazrat Ayesha (Razi Allaho Anha) farmati hain ke Nabi (Sallallaho Alaihe Wasallam) ne farmaya: Chor ka hath dinar ke chauthe hissa ya us se zyada ke maal par kata jaye ga. Hazrat Harmalah ki riwayat mein hai ke Hazrat Ayesha (Razi Allaho Anha) farmati hain ke Nabi (Sallallaho Alaihe Wasallam) ne farmaya: Chor ka hath nahin kata jaye ga magar dinar ke chauthe hissa ya us se zyada ki maliyat mein.
Narrated Aisha (RA): I heard the Messenger of Allah (peace be upon him) say: The hand of a thief should not be cut off but for a quarter of a dinar or more.

(١٧١٦٢) حضرت عائشہ (رض) سے منقول ہے کہ انھوں نے رسول اللہ (صلی اللہ علیہ وآلہ وسلم) سے سنا : چور کا ہاتھ نہیں کاٹا جائے مگر دینار کے چوتھے حصہ یا اس سے زیادہ کی مالیت میں۔
Hazrat Ayesha (Razi Allah Anha) se manqol hai ki unhon ne Rasul Allah ((صلى الله عليه وآله وسلم)) se suna : Chor ka hath nahi kaata jaye magar dinar ke chauthe hissa ya us se ziada ki maliyat mein.
Abu Bakr bin Muhammad bin Amr bin Hazm narrates that a Nabatean man who had committed theft was brought to me. Umrah bint Abi Bakr sent me a message, saying, “O son! If the value of his theft does not reach a quarter of a dinar, then do not cut off his hand because Aisha (ra) narrated to me a hadith that she heard from the Messenger (peace and blessings be upon him) that a hand should not be cut off for a theft less than the value of a quarter of a dinar.” He ( Abu Bakr bin Muhammad) said that the value of his theft was only equal to two dirhams, so I flogged him, imposed a fine on him, and released him.
Muhammad bin Ishaq is mudallis and he has not explicitly mentioned his chain of narrators, however this hadith has also been mentioned previously with a chain of narrators going back to the Prophet (peace and blessings be upon him).

(١٧١٦٣) حضرت ابوبکر بن محمد بن عمرو بن حزم فرماتے ہیں کہ میرے پاس ایک نبطی کو لایا گیا جس نے چوری کی تھی تو میرے پاس حضرت عمرہ بنت ابی بکر نے یہ پیغام بھیجا کہ اے بیٹے ! اگر اس کی چوری دینار کے چوتھے حصہ کی مالیت کو نہ پہنچے تو اس کا ہاتھ مت کاٹنا؛ کیونکہ حضرت عائشہ (رض) نے مجھے حدیث بیان کی ہے کہ میں نے رسول (صلی اللہ علیہ وآلہ وسلم) سے سنا ہے کہ دینار کے چوتھے حصہ سے کم کی مالیت میں ہاتھ مت کاٹا جائے۔ فرماتے ہیں کہ اس کی چوری تو دو درہم کی مالیت کے برابر تھی تو میں نے اس کو مارا اور جرمانہ ڈا الا اور اس کو چھوڑ دیا۔
محمد بن اسحاق مدلس ہے اور اس نے صراحت نہیں کی، لیکن یہ حدیث مرفوعاً بھی گزر چکی ہے۔
(17163) Hazrat Abu Bakr bin Muhammad bin Amro bin Hazm farmate hain ke mere pas ek Nabti ko laya gaya jis ne chori ki thi to mere pas Hazrat Umrah bint Abi Bakr ne ye paigham bheja ke aye bete! Agar iski chori dinar ke chauthe hissa ki maliyat ko na pahunche to iska hath mat katna; kyunki Hazrat Ayesha (Razi Allahu Anha) ne mujhe hadees bayan ki hai ke mainne Rasul ((صلى الله عليه وآله وسلم)) se suna hai ke dinar ke chauthe hissa se kam ki maliyat mein hath mat kata jaye. Farmate hain ke iski chori to do dirham ki maliyat ke barabar thi to mainne isko mara aur jurmana dala aur isko chhor diya.
Muhammad bin Ishaq mudallis hai aur usne sarhahat nahin ki, lekin ye hadees marfooan bhi guzar chuki hai.
Yahya bin Yahya Al-Ghasani narrated that he came to Madinah and met Abu Bakr bin Muhammad bin Amr bin Hazm (may Allah be pleased with him) who was the governor of Madinah at that time. He said: "A thief from your city was brought to me. He had committed a petty theft, so my aunt, Umm Salamah bint Abi Umayya (may Allah be pleased with her) sent me a message saying, 'Do not make any hasty decision regarding the thief until I come to you. I will tell you what I have heard from Aisha (may Allah be pleased with her) regarding theft.'"
He said, "Then she came to me and said: Aisha (may Allah be pleased with her) said that the Messenger of Allah (peace and blessings of Allah be upon him) said: 'Cut off the hand of the thief for a quarter of a dinar or more, and do not cut off the hand for less than that.'"
"And in those days, a quarter of a dinar was equal to three dirhams, and one dinar was equal to ten dirhams. The value of what the thief had stolen was less than a quarter of a dinar, so I did not cut off his hand."

(١٧١٦٤) یحییٰ بن یحییٰ غسانی فرماتے ہیں کہ میں مدینہ طیبہ آیا تو میری ملاقات ابوبکر بن محمد بن عمرو بن حزم (رض) سے ہوئی اور وہ ان دنوں مدینہ کے گورنر تھے تو انھوں نے فرمایا : میرے پاس ایک چور لایا گیا جو تمہارے شہر کا تھا ۔ اس نے ایک معمولی سی چوری کی تھی تو میری خالہ حضرت عمرہ بنت عبدالرحمن (رض) نے یہ پیغام بھیجا کہ جب تک میں آپ کے پاس نہ آؤں، تم نے اس چور کے فیصلے میں کوئی جلد بازی نہیں کرنی۔ میں تمہیں بتاؤں گی کہ میں نے حضرت عائشہ (رض) سے چوری کے بارے میں کیا سنا ہے۔ فرماتے ہیں کہ پھر وہ میرے پاس آئیں اور انھوں نے فرمایا : حضرت عائشہ (رض) فرماتی تھیں کہ رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : دینار کے چوتھے حصہ کے برابرمال میں چور کا ہاتھ کاٹ دو اور اس سے کم میں ہاتھ مت کاٹو۔
اور ان دنوں دینار کا چوتھا حصہ تین دراہم کے برابر ہوتا تھا اور ایک دینار دس درہم کے برابر ہوتا تھا تو اس چور نے جو چوری کی تھی اس کی مالیت دینار کے چوتھے حصہ سے کم کی تھی اس لیے میں نے اس کا ہاتھ نہیں کاٹا۔
Yahya bin Yahya Ghasani farmate hain ke mein Madina Tayyaba aaya to meri mulaqat Abubakar bin Muhammad bin Amr bin Hazm (RA) se hui aur wo un dino Madina ke governor thay to unhon ne farmaya: Mere pass ek chor laya gaya jo tumhare shehar ka tha. Us ne ek aam si chori ki thi to meri khala Hazrat Umrah bint Abdul Rahman (RA) ne yeh pegham bheja ke jab tak mein aap ke pass na aaun, tum ne is chor ke faisle mein koi jaldbazi nahin karni. Mein tumhen bataun gi ke maine Hazrat Ayesha (RA) se chori ke bare mein kya suna hai. Farmate hain ke phir wo mere pass aayin aur unhon ne farmaya: Hazrat Ayesha (RA) farmati thi ke Rasulullah ((صلى الله عليه وآله وسلم)) ne farmaya: Dinar ke chauthe hissa ke barabar maal mein chor ka hath kaat do aur is se kam mein hath mat kato. Aur un dino dinar ka chautha hissa teen dirham ke barabar hota tha aur ek dinar das dirham ke barabar hota tha to is chor ne jo chori ki thi us ki maliyat dinar ke chauthe hissa se kam ki thi is liye maine is ka hath nahin kata.
Hisham ibn Urwah reported from his father that Aishah (may Allah be pleased with her) said: "During the time of the Messenger of Allah (peace and blessings of Allah be upon him), a thief's hand was not cut off for stealing something worth less than a shield, whether it was a Jihfa shield or a Taris shield, and both of these were valuable."

(١٧١٦٥) ہشام بن عروہ اپنے والد سے نقل فرماتے ہیں کہ حضرت عائشہ (رض) نے فرمایا : رسول اللہ (صلی اللہ علیہ وآلہ وسلم) کے زمانے میں چور کا ہاتھ نہیں کاٹا جاتا تھا ڈھال سے کم قیمت میں (چاہے وہ ڈھال) جحفہ ہو یا ترس اور یہ دونوں قیمت والی ہیں۔
Hisham bin Urwah apne walid se naqal farmate hain ki Hazrat Ayesha (Razi Allahu Anha) ne farmaya: Rasool Allah ((صلى الله عليه وآله وسلم)) ke zamane mein chor ka hath nahin kaata jata tha dhaal se kam qeemat mein (chahe woh dhaal) jahfa ho ya taras aur yeh donon qeemat wali hain.
Hisham ibn Urwah reported from his father that the hand of a thief was not cut off at the time of the Messenger of Allah (ﷺ) for anything less in value than a Jifha or a Taris (these are kinds of shields), and each of them was valuable.
And the hand of the thief was not cut off at the time of the Prophet (ﷺ) for stealing any insignificant thing.

(١٧١٦٦) ہشام بن عروہ اپنے والد سے نقل فرماتے ہیں کہ رسول اللہ (صلی اللہ علیہ وآلہ وسلم) کے زمانے میں چور کا ہاتھ نہیں کاٹا جاتا تھا جحفہ اور ترس (یہ ڈھال کے نام ہیں) کی قیمت سے کم میں اور ان میں سے ہر ایک قیمتی ہے۔
اور نبی (صلی اللہ علیہ وآلہ وسلم) کے زمانے میں چور کا ہاتھ کسی تھوڑی سی چیز میں نہیں کاٹا جاتا تھا۔
Hisham bin Urwah apne wald se naql farmate hain ke Rasool Allah ((صلى الله عليه وآله وسلم)) ke zamane mein chor ka hath nahi kaata jata tha jahfa aur tirs (ye dhaal ke naam hain) ki qeemat se kam mein aur in mein se har ek qeemati hai. Aur Nabi ((صلى الله عليه وآله وسلم)) ke zamane mein chor ka hath kisi thori si cheez mein nahi kaata jata tha.
Hishām reported that a man stole a bowl and he was brought to 'Umar b. 'Abd al-'Aziz. Hishām said: My father said: His hand should not be cut off for a paltry thing. He then said: 'A'ishah told me a hadith that the hand of a thief was not cut off during the lifetime of the Prophet (ﷺ) for less than the price of a shield or a helmet.

(١٧١٦٧) ہشام سے منقول ہے کہ ایک شخص نے ایک پیالہ چوری کیا تو اس کو حضرت عمر بن عبدالعزیز (رح) کے پاس لایا گیا۔ ہشام فرماتے ہیں کہ میرے والد نے کہا کہ اس کا ہاتھ معمولی چیز پر نہیں کاٹا جائے گا۔ پھر فرمایا کہ مجھے عائشہ (رض) نے حدیث بیان کی کہ نبی (صلی اللہ علیہ وآلہ وسلم) کے زمانے میں چور کا ہاتھ نہیں کاٹا جاتا تھا جحفہ اور ترس ڈھال کی قیمت سے کم میں۔
HIsham se manqool hai ki aik shakhs ne aik piala chori kiya to us ko Hazrat Umar bin Abdul Aziz (rah) ke paas laya gaya. HIsham farmate hain ki mere walid ne kaha ki is ka hath mamooli cheez par nahi kaata jayega. Phir farmaya ki mujhe Ayesha (raz) ne hadees bayaan ki ki Nabi ((صلى الله عليه وآله وسلم)) ke zamane mein chor ka hath nahi kaata jata tha juhfa aur taras dhaal ki qeemat se kam mein.
