Chapter on what has been mentioned about freeing the offspring of adultery
باب ما جاء في إعتاق ولد الزنا
Sunan al-Kubra Bayhaqi 19998
Maqburi narrates that someone asked Abu Hurairah (may Allah be pleased with him) about a man who has to free a slave, can he free an illegitimate child (for this purpose)? Abu Hurairah (may Allah be pleased with him) replied: Yes.

(١٩٩٩٨) مقبری فرماتے ہیں کہ حضرت ابوہریرہ (رض) سے ایک آدمی کے بارے میں پوچھا گیا جس کے ذمہ گردن کا آزاد کرنا ہے، کیا وہ حرامی بچہ آزاد کر دے ؟ ابوہریرہ (رض) نے فرمایا : ہاں۔
(19998) Maqbri farmate hain ki Hazrat Abu Huraira (RA) se ek aadmi ke bare mein poocha gaya jis ke zimme gardan ka azad karna hai, kya wo harami bachcha azad kar de? Abu Huraira (RA) ne farmaya: Haan.
Umm Hakim bint Tariq narrated from Aisha (RA) that the ruling regarding illegitimate children is that you should free them and treat them well.

(٢٠٠٠٠) ام حکیم بنت طارق حضرت عائشہ (رض) سے نقل فرماتی ہیں کہ حرامی اولاد کے بارے میں حکم یہ ہے کہ تم ان کو آزاد کرلو اور ان سے اچھا سلوک کرو۔
(20000) Umm Hakeem bint Tariq Hazrat Ayesha (RA) se naqal farmati hain ki harami aulad ke bare mein hukm yeh hai ki tum un ko azad karlo aur un se achha sulook karo.
Umar bin Abdul Rahman Qarshi narrated from Sayyidina Ibn Abbas (may Allah be pleased with him) that he was asked about an illegitimate child and also about the emancipation of a legitimate boy, so he said: "See which of these two has a higher price." So they looked into it and found that the price of the illegitimate child was one dinar more, so he gave his verdict accordingly.

(٢٠٠٠١) عمر بن عبدالرحمن قرشی سیدنا ابن عباس (رض) سے نقل فرماتے ہیں کہ حرامی بچے کے بارے میں پوچھا گیا اور صحیح النسب لڑکے کی آزادی کے بارے میں بھی تو فرمایا دیکھو ! ان دونوں میں سے کس کی قیمت زیادہ ہے تو انھوں نے دیکھا، حرامی بچے کی قیمت ایک دینار زیادہ تھی چنانچہ آپ نے اس کا حکم دیا۔
20001 Umar bin Abdurrahman Qarshi Sayyidina Ibn Abbas (raz) se naql farmate hain ki harami bache ke bare mein poocha gaya aur sahih un nasab ladke ki azadi ke bare mein bhi to farmaya dekho! In donon mein se kis ki qeemat zyada hai to unhon ne dekha, harami bache ki qeemat ek dinar zyada thi chunache aap ne is ka hukum diya.
(20002) It is narrated from Hassan that he said about illegitimate children that they are equal in their freedom.
(b) It is narrated from Firas Shu'bi that [the price should be] whichever is higher.

(٢٠٠٠٢) حضرت حسن سے منقول ہے کہ وہ حرامی بچے کے بارے میں فرماتے ہیں کہ ان کی آزادی برابر ہے۔
(ب) فراس شعبی سے نقل فرماتے ہیں کہ قیمت میں جو زیادہ ہو۔
(20002) Hazrat Hassan se manqol hai ki woh harami bache ke bare mein farmate hain ki un ki azadi barabar hai.
(b) Firas Shobi se naql farmate hain ki qeemat mein jo ziada ho.
Nafi' narrates from Ibn Umar (may Allah be pleased with him) that he emancipated a child born out of wedlock and said that Allah and His Messenger have commanded us to be kind to evil people. Allah says: "So, [the option is] either kindness afterward or ransom." (Muhammad 4) It is narrated from Umar (may Allah be pleased with him) that he disliked this.

(٢٠٠٠٤) نافع ابن عمر (رض) سے نقل فرماتے ہیں کہ انھوں نے حرامی بچے آزاد کیا اور کہا کہ اللہ اور رسول نے ہمیں حکم دیا کہ ہم برے لوگوں پر احسان کریں، اللہ کا فرمان : { فَاِمَّا مَنًّا بَعْدُ وَاِمَّا فِدَائً } [محمد ٤] ” احسان کرنا یا فدیہ لینا۔ “ حضرت عمر (رض) سی منقول ہے کہ وہ اس کو ناپسند فرماتے تھے۔
20004 Nafe Ibn Umar (RA) se naql farmate hain keh unhon ne harami bache azad kiya aur kaha keh Allah aur Rasool ne humain hukm diya keh hum bure logon per ehsaan karen, Allah ka farmaan : { Fa imma mannan ba'du wa imma fidaya } [Muhammad 4] ” Ehsaan karna ya fidya lena. “ Hazrat Umar (RA) se manqol hai keh woh is ko napasand farmate thay.
Abu Hasan, the freed slave of Abdullah bin Harith, was one of the old Qurayshi slaves and among the people of knowledge and those who were fond of righteousness. He heard a woman saying to Abdullah bin Nawfal, "I have to free a slave from bondage, tell me about it." So Abdullah bin Nawfal said: "You will not be absolved of your liability by freeing the neck of a child from among the children of Persia." Ibn Nawfal said that I heard from Umar (may Allah be pleased with him), he was saying that I prefer to give two shoes in the way of Allah than to free a slave child of Persia.

(٢٠٠٠٥) ابوحسن جو عبداللہ بن حارث کے آزاد کردہ غلام ہیں اور وہ قدیم قریشی غلاموں اور اہل علم اور صلاح پسند لوگوں میں سے تھے۔ اس نے ایک عورت سے سنا جو عبداللہ بن نوفل سے کہہ رہی تھی کہ میرے ذمہ گردن کا آزاد کرنا ہے اس کے بارے میں بتائیں۔ تو عبداللہ بن نوفل نے فرمایا : حرامی بچے کی گردن آزاد کرنے سے تو بری الذمہ نہ ہوگی۔ ابن نوفل فرماتے ہیں کہ میں نے حضرت عمر (رض) سے سنا، وہ فرما رہے تھے کہ میں جوتے اللہ کے راستے میں دوں یہ مجھے زیادہ پسند ہے کہ میں حرامی بچے کو آزاد کر دوں۔
20005 Abuhasan jo Abdullah bin Haris ke azad kardah gulam hain aur wo qadeem Qurayshi gulamon aur ahle ilm aur salah pasand logon mein se thay. Usne ek aurat se suna jo Abdullah bin Nofal se keh rahi thi ke mere zimme gardan ka azad karna hai uske bare mein bataen. To Abdullah bin Nofal ne farmaya: Harami bache ki gardan azad karne se to bari uz zimma na hogi. Ibn Nofal farmate hain ke maine Hazrat Umar (Raz) se suna, wo farma rahe thay ke mein joote Allah ke raste mein dun ye mujhe ziada pasand hai ke mein harami bache ko azad kar dun.
