Chapter: Confirmation of oath by time, and swearing on the Quran
باب: تأكيد اليمين بالزمان، والحلف على المصحف
Sunan al-Kubra Bayhaqi 20700
Abu Musa Ash'ari (may Allah be pleased with him) said about the story of the will that this matter did not happen during the lifetime of the Prophet (peace and blessings of Allah be upon him). Then he made the two who had betrayed swear an oath after the afternoon prayer.

(٢٠٧٠٠) ابو موسیٰ اشعری (رض) وصیت کے قصہ کے بارے کہتے ہیں کہ یہ معاملہ نبی (صلی اللہ علیہ وآلہ وسلم) کے زمانہ کے بعد نہیں ہوا۔ پھر انھوں نے ان دونوں سے عصر کے بعد قسم لی جنہوں نے خیانت کی۔
(20700) abu musa ash'ari (rz) wasiyat ke qissa ke bare kehte hain ki ye mamla nabi ((صلى الله عليه وآله وسلم)) ke zamana ke baad nahin hua phir unhon ne in donon se asr ke baad qasam li jinhon ne khiyanat ki
Abu Huraira reported: The Prophet (ﷺ) said, "Allah will not speak to three persons, nor will He purify them, and theirs will be a painful chastisement: 1. A man who withholds extra water from travelers. 2. A man who swears allegiance to an Imam for worldly gain. If he is given something, he fulfills his pledge, otherwise he does not. 3. A man who sells goods after the Asr prayer and boasts, 'I got so much for it,' and another man confirms it." In another narration reported by Wakee', it is said: "A man who swears allegiance to an Imam..."

(٢٠٧٠١) حضرت ابوہریرہ (رض) فرماتے ہیں کہ نبی (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : اللہ تین آدمیوں سے نہ کلام کرے گا اور نہ ہی پاک کرے گا اور ان کے لیے دردناک عذاب ہے۔ 1 وہ آدمی جو زائد پانی مسافروں سے روکتا ہے۔ 2 وہ آدمی جو امام سے دنیا کے لییبیعت کرتا ہے۔ اگر دنیا ملے تو بیعت پوری کرتا ہے وگرنہ بیعت پوری نہیں کرتا۔ 3 عصر کے بعد سامان کا سودا کرنے والا۔ اللہ کی قسم ! اٹھا کر کہتا ہے مجھے اتنے کا ملا ہے، دوسرا اس کی تصدیق کرتا ہے۔ وکیع کی حدیث میں ہے کہ وہ آدمی جو امام کی بیعت کرتا ہے۔
(20701) Hazrat Abu Huraira (RA) farmate hain keh Nabi ((صلى الله عليه وآله وسلم)) ne farmaya: Allah teen admiyon se na kalam karega aur na hi pak karega aur unke liye dardnak azab hai. 1 Woh aadmi jo zaid pani musafiron se rokta hai. 2 Woh aadmi jo imam se duniya ke liye bai'at karta hai. Agar duniya mile to bai'at puri karta hai warna bai'at puri nahi karta. 3 Asr ke baad saman ka سودا karne wala. Allah ki qasam! Utha kar kehta hai mujhe itne ka mila hai, dusra uski tasdeeq karta hai. Waqi ki hadees mein hai keh woh aadmi jo imam ki bai'at karta hai.
Prophet Muhammad (peace be upon him) said, "There are three people with whom Allah will not speak on the Day of Judgment, nor will He purify them, nor will He look at them with mercy: 1. One who falsely takes an oath after the Asr prayer in order to usurp the wealth of a Muslim; 2. One who says, 'I can get you this item for a price lower than what you are offering,' while lying; 3. One who withholds excess water. Allah will say, 'I will withhold My bounty from you, just as you withheld the excess water, even though you did not create it." (Hadith No. 20702)

(٢٠٧٠٢) حضرت ابوہریرہ (رض) نبی (صلی اللہ علیہ وآلہ وسلم) سے نقل فرماتے ہیں کہ آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : تین آدمیوں سے اللہ کلام بھی نہ کرے گا اور پاک بھی نہ کرے گا اور نظر رحمت سے دیکھے گا بھی نہیں : 1 عصر کے بعد قسم اٹھا کر مسلمان بھائی کا مال ہڑپ کرنے والا 2 وہ آدمی جو کہتا ہے مجھے سامان کے زائد قیمت ملتی ہے، جتنی آپ دے رہے ہیں اور وہ جھوٹا بھی ہے۔ 3 زائد پانی کو روکنے والا۔ اللہ فرماتے ہیں میں بھی زائد پانی کو روک لوں گا جیسے تو نے روکا ہے۔ حالانکہ تو نے اس میں کام نہ کیا تھا۔
20702 Hazrat Abu Huraira (RA) Nabi (SAW) se naqal farmate hain ke aap (SAW) ne farmaya: Teen aadmiyon se Allah kalaam bhi na kare ga aur pak bhi na kare ga aur nazar e rehmat se dekhe ga bhi nahi: 1 Asr ke baad qasam utha kar musalman bhai ka maal hadap karne wala 2 Wo aadmi jo kehta hai mujhe saman ke zyada qeemat milti hain, jitni aap de rahe hain aur wo jhoota bhi hai. 3 Zyada pani ko rokne wala. Allah farmate hain main bhi zyada pani ko rok lunga jaise tune roka hai. Halan ke tune us mein kaam na tha.
Ibn Abi Mulaika reported that he wrote to Ibn Abbas (may Allah be pleased with him) about two girls, one of whom had hit the other, but there was no witness. He said: "Stop them after the Asr prayer. Then recite this verse to them: 'Indeed, those who exchange the covenant of Allah and their oaths for a small price...' (Quran 3:77). He (Ibn Abi Mulaika) said: I did so, and one of them confessed."

(٢٠٧٠٣) ابن ابی ملیکہ فرماتے ہیں کہ میں نے ابن عباس (رض) کو دو بچیوں کے بارے میں لکھا کہ ایک نے دوسری کو مارا تھا لیکن گواہ بھی موجود نہ تھا تو انھوں نے فرمایا کہ عصر کے بعد ان کو روکو۔ پھر ان پر اس آیت کی تلاوت کرو : { اِنَّ الَّذِیْنَ یَشْتَرُوْنَ بِعَھْدِ اللّٰہِ وَ اَیْمَانِھِمْ ثَمَنًا قَلِیْلًا } [آل عمران ٧٧] ” وہ لوگ جو اللہ کے عہد اور اپنی قسموں کے ذریعہ تھوڑی قیمت خریدتے ہیں۔ “ وہ کہتے ہیں : میں نے ایسا کیا تو اس نے اعتراف کرلیا۔
20703 Ibn e Abi Malika farmate hain ke maine Ibn e Abbas (RA) ko do bachiyon ke bare mein likha ke ek ne dusri ko mara tha lekin gawah bhi mojood na tha to unhon ne farmaya ke asr ke baad un ko roko phir un per is ayat ki tilawat karo { inna allatheena yashtaroona biAAahdi Allahi wa aymanihim thamanan qaleelan } [Al-Imran 77] " woh log jo Allah ke ahd aur apni qasmon ke zariye thori qeemat kharidte hain " woh kahte hain : maine aisa kya to us ne ikrar karliya.
(20704) Mutarrif bin Mazin narrated from his chain of narration, but I do not remember, that Ibn Zubair said: “Swear by the Quran.”
Imam Shafi’i (may Allah have mercy upon him) said: “I saw Mutarrif in Sana’a, he used to swear by the Quran and the rulers around him also used to swear by the Quran.”

(٢٠٧٠٤) مطرف بن مازن اپنی سند سے نقل فرماتے ہیں، لیکن مجھے یاد نہیں کہ ابن زبیر نے کہا : قرآن کی قسم اٹھاؤ۔
امام شافعی (رح) فرماتے ہیں میں نے مطرف کو صنعا میں دیکھا، وہ قرآن پر قسم اٹھاتے تھے اور اطراف کے حکمران بھی قرآن پر قسم لیتے تھے۔
20704 Mutraf bin Mazin apni sanad se naql farmate hain, lekin mujhe yaad nahi ki Ibn Zubair ne kaha: Quran ki qasam uthao.
