Sunan al-Kubra Bayhaqi 13699
The Prophet (peace and blessings of Allah be upon him) said: “Do not conclude a marriage contract with a previously married woman without consulting her, and do not conclude a marriage contract with a virgin until you have sought her permission.” They asked: “O Messenger of Allah, how do we seek her permission?” He said: “Her silence (is her permission).”

(٩٩ ١٣٦) نبی (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : شادی شدہ سے نکاح نہ کیا جائے۔ یہاں تک کہ اس سے مشورہ کرلیا جائے اور کنواری سے نکاح نہ کیا جائے حتیٰ کہ اس سے اجازت طلب کرلی جائے تو صحابہ (رض) نے پوچھا : اس کی اجازت کیسے ہوگی، اے اللہ کے نبی ؟ آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : خاموشی اس کی اجازت ہے۔
99 136 Nabi ne farmaya : shadi shuda se nikah na kiya jaye. yahan tak ke us se mashwara kar liya jaye aur kunwari se nikah na kiya jaye hatta ke us se ijazat talab kar li jaye to sahaba ne pucha : us ki ijazat kaise hogi, aye Allah ke Nabi ? Aap ne farmaya : khamoshi us ki ijazat hai.
١٣٦٩٩ - وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ إِسْحَاقُ بْنُ مُحَمَّدِ بْنِ يُوسُفَ السُّوسِيُّ، ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ، ثنا أَبُو عُثْمَانَ سَعِيدُ بْنُ عُثْمَانَ التَّنُوخِيُّ، ثنا بِشْرُ بْنُ بَكْرٍ،ح قَالَ:وَأنبأ الْعَبَّاسُ بْنُ الْوَلِيدِ،أنبأ أَبِي قَالَا:ثنا الْأَوْزَاعِيُّ، ثنا يَحْيَى بْنُ أَبِي كَثِيرٍ، حَدَّثَنِي أَبُو سَلَمَةَ بْنُ عَبْدِ الرَّحْمَنِ،عَنْ أَبِي هُرَيْرَةَ رَضِيَ اللهُ عَنْهُ قَالَ:قَالَ رَسُولُ اللهِ صلَّى الله عَلَيْهِ وَسَلَّمَ:" لَا تُنْكَحُ الثَّيِّبُ حَتَّى تُسْتَأْمَرَ، وَلَا تُنْكَحُ الْبِكْرُ حَتَّى تُسْتَأْذَنَ "،قَالُوا:كَيْفَ إِذْنُهَا يَا رَسُولَ اللهِ؟فَقَالَ:" الصُّمُوتُ "، أَخْرَجَهُ مُسْلِمٌ فِي الصَّحِيحِ مِنْ حَدِيثِ الْأَوْزَاعِيِّ
