Sunan al-Kubra Bayhaqi 14285
(14285) Abdullah bin Umar (may Allah be pleased with him) narrates: If a slave woman who is married to a slave is freed, she has the right to choose before her husband consummates the marriage with her. (b) In the narration of Malik, there is an addition that if the husband has consummated the marriage, then she has no choice.

(١٤٢٨٥) حضرت عبداللہ بن عمر (رض) فرماتے ہیں : جو لونڈی غلام کے نکاح میں ہو اس کو آزادی مل جائے تو خاوند کے مجامعت کرنے سے پہلے اس کو اپنے نفس کا اختیار ہوتا ہے۔ (ب) مالک کی روایت میں زیادتی ہے کہ اگر خاوند نے مجامعت کرلی تو پھر کوئی اختیار نہیں ہے۔
(14285) Hazrat Abdullah bin Umar (RA) farmate hain : Jo londi ghulam ke nikah mein ho us ko azadi mil jaye to khawande ke mujamaat karne se pehle us ko apne nafs ka ikhtiyar hota hai. (b) Malik ki riwayat mein ziyadati hai ke agar khawande ne mujamaat karli to phir koi ikhtiyar nahin hai.
١٤٢٨٥ - أَخْبَرَنَا أَبُو بَكْرٍ أَحْمَدُ بْنُ الْحَسَنِ الْقَاضِي، ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ، أنبأ الرَّبِيعُ بْنُ سُلَيْمَانَ، أنبأ الشَّافِعِيُّ، أنبأ مَالِكٌ، ح وَأَخْبَرَنَا أَبُو الْحُسَيْنِ بْنُ بِشْرَانَ، أنبأ إِسْمَاعِيلُ بْنُ مُحَمَّدٍ الصَّفَّارُ، ثنا الْحَسَنُ بْنُ عَلِيِّ بْنِ عَفَّانَ، ثنا عَبْدُ اللهِ بْنُ نُمَيْرٍ، ثنا عُبَيْدُ اللهِ بْنُ عُمَرَ، كِلَاهُمَا عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ رَضِيَ اللهُ عَنْهُمَا أَنَّهُ كَانَ يَقُولُ فِي الْأَمَةِ تَكُونُ تَحْتَ الْعَبْدِ فَتَعْتِقُ" أَنَّ لَهَا الْخِيَارَ مَا لَمْ يَمَسَّهَا "،زَادَ مَالِكٌ فِي رِوَايَتِهِ:فَإِنْ مَسَّهَا فَلَا خِيَارَ لَهَا
