Sunan al-Kubra Bayhaqi 15716
Fatima bint Qais, who is the sister of Dahak bin Qais, informed that she was in the marriage of Abu Amr bin Hafs, and he divorced her by giving three pronouncements. Her representative ordered him to pay for her expenses, but he refused. Her representative said to her, “There is no obligation upon us for your expenses.” So, she came to the Messenger of Allah, peace and blessings be upon him, and she asked him about it. The Prophet said, “He has spoken the truth,” and he instructed her to stay at the house of Ibn Umm Maktum. The people refused (to marry her) because she declared her waiting period had ended before it was permissible.

(١٥٧١٦) فاطمہ بنت قیس جو ضحاک بن قیس کی بہن ہے۔ اس نے اس کو خبر دی کہ وہ ابو عمرو بن حفص کے نکاح میں تھی، اس نے اس کو تین طلاقیں دے دیں۔ اس کے وکیل نے اس کو اس عورت کے لیے خرچے کا حکم دیا، اس نے اس سے بےرغبتی کی۔ مجھے اس کے وکیل نے کہا : تیرے لیے ہمارے ذمے خرچہ نہیں ہے، وہ رسول اللہ (صلی اللہ علیہ وآلہ وسلم) کے پاس آئی۔ اس نے اس کے بارے میں آپ (صلی اللہ علیہ وآلہ وسلم) سے سوال کیا تو آپ نے فرمایا : اس نے سچ کہا اور اس کو ابن ام مکتوم کی طرف منتقل کردیا۔ اس پر لوگوں نے انکار کیا جو وہ حلال ہونے سے پہلے خروج بیان کرتی ہے۔
Fatima bint Qais jo Zahak bin Qais ki behan hai us ne us ko khabar di ke wo Abu Amr bin Hafs ke nikah mein thi us ne us ko teen talaqain de dein Us ke wakeel ne us ko is aurat ke liye kharche ka hukum diya us ne is se bairغبti ki Mujhe us ke wakeel ne kaha tere liye humare zimme kharcha nahi hai wo Rasool Allah ((صلى الله عليه وآله وسلم)) ke paas aai us ne is ke bare mein aap ((صلى الله عليه وآله وسلم)) se sawal kiya to aap ne farmaya us ne sach kaha aur us ko Ibn Umm Maktoom ki taraf muntaqil kar diya is par logon ne inkar kiya jo wo halal hone se pehle khurooj bayan karti hai
١٥٧١٦ - أَخْبَرَنَا عَلِيُّ بْنُ أَحْمَدَ بْنِ عَبْدَانَ، أنا أَحْمَدُ بْنُ عُبَيْدٍ الصَّفَّارُ، نا ابْنُ مِلْحَانَ، نا يَحْيَى عَنِ اللَّيْثِ، حَدَّثَنِي عُقَيْلُ بْنُ خَالِدٍ، عَنِ ابْنِ شِهَابٍ،أَنَّهُ قَالَ:أَخْبَرَنِي أَبُو سَلَمَةَ بْنُ عَبْدِ الرَّحْمَنِ، أَنَّ فَاطِمَةَ بِنْتَ قَيْسٍ،وَهِيَ أُخْتُ الضَّحَّاكِ بْنِ قَيْسٍ أَخْبَرَتْهُ أَنَّهَا كَانَتْ تَحْتَ أَبِي عَمْرِو بْنِ حَفْصٍ فَطَلَّقَهَا ثَلَاثًا فَأَمَرَ وَكِيلَهُ لَهَا بِنَفَقَةٍ فَرَغِبَتْ عَنْهَا فَقَالَ لِي وَكِيلُهُ:مَا لَكِ عَلَيْنَا مِنْ نَفَقَةٍ،فَجَاءَتْ رَسُولَ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ فَسَأَلَتْهُ عَنْ ذَلِكَ فَقَالَ لَهَا:" صَدَقَ "، وَنَقَلَهَا إِلَى ابْنِ أُمِّ مَكْتُومٍ فَأَنْكَرَ النَّاسُ عَلَيْهَا مَا كَانَتْ تُحَدِّثُ مِنْ خُرُوجِهَا قَبْلَ أَنْ تَحِلَّ
