Sunan al-Kubra Bayhaqi 17109
(17109) Abdullah bin Umar had one of his slave-girls flogged and he told the one who was flogging her to strike below the two ankles and softly. We said, "Then what about the command of Allah wherein He says, "And let not pity for the two of them restrain you in the religion of Allah" [An-Nur:2] So he said, "Should I then kill her?" Imam Shafi'i said that the Ansar and those after them used to have their slaves flogged.

(١٧١٠٩) عبداللہ بن عمر نے اپنی ایک لونڈی کو حد لگوائی اور جو کوڑے مارنے والا تھا اسے کہا کہ دونوں ٹانگوں سے نیچے مارنا اور آہستہ تو ہم نے کہا کہ پھر اللہ کے اس فرمان کا کیا ہے کہ ” ان کے ساتھ اللہ کے دین میں کوئی نرمی نہ برتو ؟ “ [النور : ٢] تو فرمایا : کیا پھر میں اس کو قتل کردیتا۔ امام شافعی فرماتے ہیں کہ انصار اور ان کے بعد غلاموں کو حد لگایا کرتے تھے۔
17109 Abdullah bin Umar ne apni aik londi ko had lagwai aur jo koray marne wala tha usay kaha keh donon taangon se neechay marna aur ahistah to hum ne kaha keh phir Allah ke is farman ka kya hai keh "In ke sath Allah ke deen mein koi narmi na barto?" [Al Noor: 2] To farmaya: kya phir mein us ko qatal karta. Imam Shafai farmate hain keh Ansar aur un ke baad ghulamon ko had lagaya karte thay.
١٧١٠٩ - أَخْبَرَنَا أَبُو طَاهِرٍ الْفَقِيهُ، أنبأ أَبُو بَكْرٍ الْقَطَّانُ، ثنا أَبُو الْأَزْهَرِ، ثنا رَوْحُ بْنُ عُبَادَةَ، ثنا ابْنُ جُرَيْجٍ، أَخْبَرَنِي ابْنُ أَبِي مُلَيْكَةَ، عَنْ عَبْدِ اللهِ بْنِ عَبْدِ اللهِ بْنِ عُمَرَ، عَنْ أَبِيهِ،أَنَّهُ حَدَّ جَارِيَةً لَهُ زَنَتْ فَقَالَ لِلَّذِي يَجْلِدُهَا أَسْفَلَ رِجْلَيْهَا:خَفِّفْ،قَالَ:فَقُلْنَا: أَيْنَ قَوْلُ اللهِ عَزَّ وَجَلَّ:{وَلَا تَأْخُذْكُمْ بِهِمَا رَأْفَةٌ فِي دِينِ اللهِ}[النور: ٢]؟قَالَ:أَنَا أَقْتُلُهَا وَالرِّوَايَةُ عَنْ عَبْدِ اللهِ بْنِ عُمَرَ فِي قَطْعِهِ عَبْدًا لَهُ سَرَقَ مَذْكُورَةٌ فِي قَطْعِ الْآبِقِ إِذَا سَرَقَ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ: وَكَانَ الْأَنْصَارُ وَمَنْ بَعْدَهُمْ يَحِدُّونَ إِمَاءَهُمْ
