Chapter: Evidence that the predominance of resemblances has an effect on lineage, and it has a ruling if there is nothing stronger than it such as bedding or other evidence

باب: الدليل على أن لغلبة الأشباه تأثيرا في الأنساب، وأن لها حكما إذا لم يكن ما هو أقوى منها من فراش، أو غيره.

Sunan al-Kubra Bayhaqi 21276

(21277) And Abu 'Ali al-Rudhbari informed us, he said: Muhammad ibn Bakr informed us: Abu Dawud told us: Muhammad ibn Bashshar told us: Ibn Abi 'Adi said: Hisham ibn Hassan informed us, he said: 'Ikrimah told me, on the authority of Ibn 'Abbas: that Hilal ibn Umayyah accused his wife before the Prophet - (peace and blessings of Allah be upon him and his family) - of adultery with Sharik ibn Sahma'. Then he mentioned the hadith concerning the story of Li'an (mutual invocation of the curse of Allah by a husband and wife when the husband accuses his wife of adultery but does not have the witnesses required to prove his claim). He said: So the Prophet - (peace and blessings of Allah be upon him and his family) - said: "Observe her, for if she comes with a child who is Akhlak al-'Aynayn (having black eyes lined with kohl), Sabigh al-Ilyatayn (having fleshy buttocks), and Khadlaj al-Saqayn (having slender legs), then he is for Sharik ibn Sahma." So she came with him like that. So the Prophet - (peace and blessings of Allah be upon him and his family) - said: "Were it not for what has preceded in the Book of Allah, surely there would have been something between me and her." Narrated by al-Bukhari in al-Sahih, on the authority of Muhammad ibn Bashshar. [Sahih. Agreed upon].

(٢١٢٧٧) وَأَخْبَرَنَا أَبُو عَلِیٍّ الرُّوذْبَارِیُّ أَنْبَأَنَا مُحَمَّدُ بْنُ بَکْرٍ حَدَّثَنَا أَبُو دَاوُدَ حَدَّثَنَا مُحَمَّدُ بْنُ بَشَّارٍ حَدَّثَنَا ابْنُ أَبِی عَدِیٍّ قَالَ أَنْبَأَنَا ہِشَامُ بْنُ حَسَّانَ قَالَ حَدَّثَنِی عِکْرِمَۃُ عَنِ ابْنِ عَبَّاسٍ : أَنَّ ہِلاَلَ بْنَ أُمَیَّۃَ قَذَفَ امْرَأَتَہُ عِنْدَ النَّبِیِّ - (صلی اللہ علیہ وآلہ وسلم) - بِشَرِیکِ ابْنِ سَحْمَائَ فَذَکَرَ الْحَدِیثَ فِی قِصَّۃِ اللِّعَانِ قَالَ فَقَالَ النَّبِیُّ - (صلی اللہ علیہ وآلہ وسلم) - : أَبْصِرُوہَا فَإِنْ جَائَ تْ بِہِ أَکْحَلَ الْعَیْنَیْنِ سَابِغَ الإِلْیَتَیْنِ خَدَلَّجَ السَّاقَیْنِ فَہُوَ لِشَرِیکِ ابْنِ سَحْمَائَ ۔ فَجَائَ تْ بِہِ کَذَلِکَ فَقَالَ النَّبِیُّ - (صلی اللہ علیہ وآلہ وسلم) - : لَوْلاَ مَا مَضَی مِنْ کِتَابِ اللَّہِ لَکَانَ لِی وَلَہَا شَأْنٌ ۔ رَوَاہُ الْبُخَارِیُّ فِی الصَّحِیحِ عَنْ مُحَمَّدِ بْنِ بَشَّارٍ ۔ [صحیح۔ متفق علیہ ]

(21277) Wa akhbarana abu ali ar-ruzdbari anbaana muhammad ibn bakr haddasana abu dawud haddasana muhammad ibn bashshar haddasana ibn abi adiyy qala anbaana hisham ibn hassan qala haddasani ikrimat an ibn abbas : anna hilal ibn umayyat qadzaf amraatahu 'ind an-nabiyy - ((صلى الله عليه وآله وسلم)) - bi sharik ibn sahmai fa dhakaral-hadith fi qissat al-li'an qala faqala an-nabiyy - ((صلى الله عليه وآله وسلم)) - : absiruha fain ja'at bihi akhalal-'ainain sabighal-ilyatain khadallaj as-saqain fa huwa li sharik ibn sahmai . Fa ja'at bihi kadhalik faqala an-nabiyy - ((صلى الله عليه وآله وسلم)) - : lawla ma maza min kitabillahi lakana li wa laha sha'n . Rawahu al-bukhariyy fi as-sahih 'an muhammad ibn bashshar . [sahih. Muttafaqun alaih ].

٢١٢٧٦ - أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ، أَخْبَرَنِي أَبُو أَحْمَدَ الْحَافِظُ، أنبأ مُحَمَّدُ بْنُ سُلَيْمَانَ الْوَاسِطِيُّ، ثنا مُحَمَّدُ بْنُ الْمُثَنَّى، ثنا عَبْدُ الْأَعْلَى، ثنا هِشَامُ بْنُ حَسَّانَ، عَنْ مُحَمَّدِ بْنِ سِيرِينَ، عَنْ أَنَسِ بْنِ مَالِكٍ،فِي قِصَّةِ اللِّعَانِ قَالَ:فَقَالَ رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ:" أَبْصِرُوهَا، فَإِنْ جَاءَتْ بِهِ أَبْيَضَ سَبِطًا قَضِيءَ الْعَيْنَيْنِ فَهُوَ لِهِلَالِ بْنِ أُمَيَّةَ، وَإِنْ جَاءَتْ بِهِ أَكْحَلَ جَعْدًا حَمْشَ السَّاقَيْنِ فَهُوَ لِشَرِيكِ بْنِ سَحْمَاءَ "،قَالَ:فَأُنْبِئْتُ أَنَّهَا جَاءَتْ بِهِ أَكْحَلَ جَعْدًا حَمْشَ السَّاقَيْنِ. رَوَاهُ مُسْلِمٌ فِي الصَّحِيحِ عَنْ مُحَمَّدِ بْنِ مُثَنًّى
