Sunan al-Kubra Bayhaqi 21418
Ali ibn Ahmad ibn Abdān told us, Sulaiman ibn Ahmad al-Lakhmi told us, ‘Abdān ibn Ahmad and al-Hasan ibn Ali al-Ma’mari told us, they said, Abu ‘Umayr ibn al-Nuḥās told us, Damrah ibn Rabi’ah told us, on the authority of Thawri, on the authority of ‘Abd Allah ibn Dinar, on the authority of Ibn ‘Umar, on the authority of the Prophet (May God bless him and his family) who said: “Whoever possesses a close relative who is forbidden for him, then she is free.” Sulaiman said: “No one narrated this hadith from Sufyan except Damrah.” The Shaykh (may God have mercy upon him) said: “The hadith preserved in this chain forbids the selling of a freed slave woman and the giving of her as a gift.” It was narrated by Abu ‘Umayr, from Damrah, from Thawri, together with the first hadith. [Munkar].

(٢١٤١٩) أَخْبَرَنَا عَلِیُّ بْنُ أَحْمَدَ بْنِ عَبْدَانَ أَنْبَأَنَا سُلَیْمَانُ بْنُ أَحْمَدَ اللَّخْمِیُّ حَدَّثَنَا عَبْدَانُ بْنُ أَحْمَدَ وَالْحَسَنُ بْنُ عَلِیٍّ الْمَعْمَرِیُّ قَالاَ حَدَّثَنَا أَبُو عُمَیْرِ بْنُ النُّحَاسِ حَدَّثَنَا ضَمْرَۃُ بْنُ رَبِیعَۃَ عَنِ الثَّوْرِیِّ عَنْ عَبْدِ اللَّہِ بْنِ دِینَارٍ عَنِ ابْنِ عُمَرَ عَنِ النَّبِیِّ - (صلی اللہ علیہ وآلہ وسلم) - قَالَ : مَنْ مَلَکَ ذَا رَحِمٍ مَحْرَمٍ فہُوَ عَتِیقٌ ۔ قَالَ سُلَیْمَانُ لَمْ یَرْوِ ہَذَا الْحَدِیثَ عَنْ سُفْیَانَ إِلاَّ ضَمْرَۃُ قَالَ الشَّیْخُ رَحِمَہُ اللَّہُ الْمَحْفُوظُ بِہَذَا الإِسْنَادِ حَدِیثٌ نَہَی عَنْ بَیْعِ الْوَلاَئِ وَعَنْ ہِبَتِہِ وَقَدْ رَوَاہُ أَبُو عُمَیْرٍ عَنْ ضَمْرَۃَ عَنِ الثَّوْرِیِّ مَعَ الْحَدِیثِ الأَوَّلِ ۔[منکر ]

٢١٤١٧ - أَخْبَرَنَا أَبُو عَلِيٍّ الرُّوذْبَارِيُّ، أنبأ مُحَمَّدُ بْنُ بَكْرٍ، ثنا أَبُو دَاوُدَ، ثنا مُحَمَّدُ بْنُ سُلَيْمَانَ الْأَنْبَارِيُّ، ثنا عَبْدُ الْوَهَّابِ، عَنْ سَعِيدٍ، عَنْ قَتَادَةَ، أَنَّ عُمَرَ بْنَ الْخَطَّابِ،رَضِيَ اللهُ عَنْهُ قَالَ:" مَنْ مَلَكَ ذَا رَحِمٍ مَحْرَمٍ فَهُوَ حُرٌّ ".٢١٤١٨ - أَخْبَرَنَا أَبُو عَلِيٍّ، أنبأ مُحَمَّدُ بْنُ بَكْرٍ، ثنا أَبُو دَاوُدَ، ثنا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ، ثنا أَبُو أُسَامَةَ، عَنْ سَعِيدٍ، عَنْ قَتَادَةَ، عَنْ جَابِرِ بْنِ زَيْدٍ، وَالْحَسَنِ مِثْلَهُ.قَالَ أَبُو دَاوُدَ:وَسَعِيدٌ أَحْفَظُ مِنْ حَمَّادٍ.قَالَ أَحْمَدُ:وَرُوِيَ بِإِسْنَادٍ آخَرَ وَهِمَ فِيهِ رَاوِيهِ
