Chapter: One Who Intends to Stay Four Days Should Complete the Prayer

Sunan al-Kubra Bayhaqi 5455
(5455) Ata' bin Abdullah Khurasani heard from Sa'eed bin Musayyab that if someone intends to stay for four nights and is a traveler, then he should pray the full prayer. Imam Malik (may Allah have mercy on him) said: This is the opinion of the scholars of knowledge. Note: Imam Shafi'i (may Allah have mercy on him) said: The Prophet (peace and blessings of Allah be upon him) allowed the emigrants to stay for three days after performing the rites of Hajj. Umar (may Allah be pleased with him) set a period of three days after the exile of the Jews. In this regard, if a traveler intends to stay for more than three days, then he is like those about whom the Prophet (peace and blessings of Allah be upon him) and Umar (may Allah be pleased with him) gave a ruling.

(٥٤٥٥) عطاء بن عبداللہ خراسانی نے سعید بن مسیب سے سنا کہ جو چار رات قیام کا ارادہ کرے اور وہ مسافر ہو تو نماز پوری پڑھے۔ امام مالک (رح) فرماتے ہیں : اہل علم کا یہی مذہب ہے۔ نوٹ : امام شافعی (رح) فرماتے ہیں : نبی (صلی اللہ علیہ وآلہ وسلم) : مناسک کی ادائیگی کے بعد مہاجرین کو تین دن قیام کی اجازت دی۔ حضرت عمر (رض) نے یہودیوں کے لییجلا وطنی کے بعد تین دن مقرر کیے۔ اس لحاظ سے مسافر اگر تین دن سے زیادہ زیادہ کا ارادہ رکھتا ہے تو وہ ان کے مشابہہ ہے جن کے بارے میں نبی (صلی اللہ علیہ وآلہ وسلم) اور حضرت عمر (رض) نے حکم دیا۔
(5455) Ata bin Abdullah Khurasani ne Saeed bin Musayyab se suna ki jo chaar raat qayam ka irada kare aur wo musafir ho to namaz poori parhe. Imam Malik (rah) farmate hain : Ahl e ilm ka yahi mazhab hai. Note : Imam Shafi (rah) farmate hain : Nabi ((صلى الله عليه وآله وسلم)) : Manasik ki adayegi ke baad muhajireen ko teen din qayam ki ijazat di. Hazrat Umar (ra) ne yahudiyon ke liye jala watani ke baad teen din muqarrar kiye. Iss lihaz se musafir agar teen din se zyada zyada ka irada rakhta hai to wo un ke mushabaha hai jin ke bare mein Nabi ((صلى الله عليه وآله وسلم)) aur Hazrat Umar (ra) ne hukum diya.
٥٤٥٥ - فَأَخْبَرَنَا أَبُو أَحْمَدَ الْعَدْلُ، أنبأ أَبُو بَكْرِ بْنُ جَعْفَرٍ، ثنا مُحَمَّدُ بْنُ إِبْرَاهِيمَ، ثنا ابْنُ بُكَيْرٍ، ثنا مَالِكٌ، عَنْ عَطَاءِ بْنِ عَبْدِ اللهِ الْخُرَاسَانِيِّ،أَنَّهُ سَمِعَ سَعِيدَ بْنَ الْمُسَيِّبِ يَقُولُ:" مَنْ أَجْمَعَ عَلَى إِقَامَةِ أَرْبَعِ لَيَالٍ وَهُوَ مُسَافِرٌ أَتَمَّ الصَّلَاةَ ".قَالَ مَالِكٌ:وَذَلِكَ الْأَمْرُ الَّذِي لَمْ يَزَلْ عَلَيْهِ أَهْلُ الْعِلْمِ عِنْدَنَا
