Chapter that he promises them with the sakhall (hair) that their livestock produce, and nothing is taken from it if there remains a mother.

Sunan al-Kubra Bayhaqi 7314
Bushar bin 'Asim narrates on the authority of his father, and he from his grandfather, that 'Umar (may Allah be pleased with him) appointed me as the collector of Zakat for my people. I included their young goats in the count. They complained to him, saying, "If he counts our young ones as goats, then he should also collect Zakat from them." They said, "We included them in the count." Later, when I met 'Umar (may Allah be pleased with him), I said, "My people found fault with me because I included their young goats in the count, and they said that if I count them as goats, then I should also collect Zakat from them." 'Umar (may Allah be pleased with him) said, "O Safiyan! Include even those young ones of your people that a shepherd can lift in his hand. And tell your people that we leave for you the best milk-yielding, pregnant, and meaty goats, as well as the billy goat, and we collect only the *Jaza'a* and *Thaniyyah*. This is a moderate approach between us and you regarding wealth."

(٧٣١٤) بشر بن عاصم اپنے والد سے اور وہ اپنے دادا سے نقل فرماتے ہیں کہ مجھے عمر (رض) نے زکوۃ پر عامل بنایا اپنی قوم میں تو میں نے ان کے بچے بھی شمار کیے تو انھوں نے میری شکایت کی اور کہا : اگر تو انھیں بکریوں میں شمار کرتا ہے تو پھر ان سے زکوۃ بھی وصول کر ۔ وہ کہتے ہیں : ہم نے وہ شمار کیں، پھر میں عمر (رض) سے ملا تو میں نے کہا : میری قوم نے مجھ پر عیب لگایا ہے کہ میں ان کی بکریوں کے چھوٹے بچے بھی شمار کرتا ہوں۔ اور انھوں نے کہا ہے کہ اگر تو انھیں بکریوں میں شمار کرتا ہے تو پھر زکوۃ بھی ان میں وصول کر تو عمر (رض) نے فرمایا : اے سفیان ! تو اپنی قوم کے ان بچوں کو بھی شمار کر جو چرواہا اپنے ہاتھ میں اٹھاتا ہے اور اپنی قوم سے کہہ کہ ہم تمہارے لیے عمدہ دودھ والی اور حاملہ اور گوشت والی اور بکریوں کا سانڈ چھوڑتے ہیں اور ہم جزع اور ثنیہ وصول کرتے ہیں۔ یہ ہمارے اور تمہارے لیے مال میں درمیانہ راستہ ہے۔
7314 Bashr bin Asim apne walid se aur wo apne dada se naqal farmate hain ki mujhe Umar (RA) ne zakat par amil banaya apni qaum mein to maine un ke bache bhi shumar kiye to unhon ne meri shikayat ki aur kaha: Agar tu unhen bakriyon mein shumar karta hai to phir un se zakat bhi wasool kar. Wo kahte hain: Hum ne wo shumar kin, phir main Umar (RA) se mila to maine kaha: Meri qaum ne mujh par aib lagaya hai ki main un ki bakriyon ke chhote bache bhi shumar karta hun. Aur unhon ne kaha hai ki agar tu unhen bakriyon mein shumar karta hai to phir zakat bhi un mein wasool kar to Umar (RA) ne farmaya: Ae Saifan! Tu apni qaum ke un bachon ko bhi shumar kar jo charwaha apne hath mein uthata hai aur apni qaum se kah ki hum tumhare liye umda doodh wali aur hamil aur gosht wali aur bakriyon ka sand chhorte hain aur hum jaza aur saniyah wasool karte hain. Ye humare aur tumhare liye maal mein darmiyana rasta hai.
٧٣١٤ - أَخْبَرَنَا أَبُو الْحُسَيْنِ عَلِيُّ بْنُ مُحَمَّدِ بْنِ عَبْدِ اللهِ بْنِ بِشْرَانَ الْعَدْلُ بِبَغْدَادَ، ثنا إِسْمَاعِيلُ بْنُ مُحَمَّدٍ الصَّفَّارُ، ح وَأَخْبَرَنَا أَبُو بَكْرٍ أَحْمَدُ بْنُ الْحَسَنِ الْقَاضِي، ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ،قَالَا:ثنا الْحَسَنُ بْنُ عَلِيِّ بْنِ عَفَّانَ، ثنا عَبْدُ اللهِ بْنُ نُمَيْرٍ، عَنْ عُبَيْدِ اللهِ يَعْنِي ابْنَ عُمَرَ، عَنْ بِشْرِ بْنِ عَاصِمٍ، عَنْ أَبِيهِ، عَنْ جَدِّهِ،قَالَ:اسْتَعْمَلَنِي عُمَرُ رَضِيَ اللهُ عَنْهُ عَلَى صَدَقَاتِ قَوْمِي فَاعْتَدَدْتُ عَلَيْهِمْ بِالْبُهْمِ فَاشْتَكَوْا ذَلِكَ وَقَالُوا: إِنْ كُنْتَ تَعُدُّهَا مِنَ الْغَنَمِ فَخُذْ مِنْهَا ⦗١٧٣⦘ صَدَقَتَكَ،قَالَ:فَاعْتَدَدْنَا عَلَيْهِمْ بِهَا ثُمَّ لَقِيتُ عُمَرَ رَضِيَ اللهُ عَنْهُ فَقُلْتُ: إِنَّ قَوْمِي اسْتَنْكَرُوا عَلَيَّ أَنِ اعْتَدَدْتُ عَلَيْهِمْ بِالْبُهْمِ وَقَالُوا: إِنْ كُنْتَ تَرَاهَا مِنَ الْغَنَمِ فَخُذْ مِنْهَا صَدَقَتَكَ،فَقَالَ عُمَرُ رَضِيَ اللهُ عَنْهُ:اعْتَدَّ عَلَى قَوْمِكَ يَا سُفْيَانُ بِالْبُهْمِ وَإِنْ جَاءَ بِهَا الرَّاعِي يَحْمِلُهَا فِي يَدِهِ،وَقُلْ لِقَوْمِكَ:إِنَّا نَدَعُ لَهُمُ الْمَاخِضَ وَالرُّبَّى وَشَاةَ اللَّحْمِ وَفَحْلَ الْغَنَمِ وَنَأْخُذُ الْجَذَعَ وَالثَّنِيَّ وَذَلِكَ وَسَطٌ بَيْنَنَا وَبَيْنَكُمْ فِي الْمَالِ "
