Chapter on those who said to leave for the owner of the wall what he and his family eat and what the destitute expose, so it is not counted against him.
باب من قال يترك لرب الحائط قدر ما يأكل هو وأهله وما يعري المساكين منها لا يخرص عليه

Sunan al-Kubra Bayhaqi 7445
Bashir bin Yasar said: Umar bin Khattab (may Allah be pleased with him) used to send Abu Hathama (may Allah be pleased with him) to estimate the yield of dates. He [Umar] would instruct him [Abu Hathama], "When you find the people in their gardens, leave for them what they eat and do not include it in the estimate."

(٧٤٤٥) بشیربن یسار فرماتے ہیں کہ عمر بن خطاب (رض) ابو حثمہ (رض) کو اندازے کے لیے بھیجتے، وہ کھجوروں کا اندازہ لگاتے تھے اور انھیں حکم دیا کرتے کہ جب تم قوم کو ان کے باغ میں پاؤ تو ان کے لیے وہ چھوڑ دے جسے وہ کھائیں اور اس کا اندازہ نہ لگاؤ۔
7445 Bashir bin Yasar farmate hain ki Umar bin Khattab (Raz) Abu Hatmah (Raz) ko andazay ke liye bhejte, woh khajuron ka andaza lagate thay aur unhen hukm diya karte ke jab tum qaum ko un ke bagh mein pao to un ke liye woh chhor de jise woh khayen aur is ka andaza na lagao.
٧٤٤٥ - أَخْبَرَنَا أَبُو صَالِحِ بْنُ أَبِي طَاهِرٍ الْعَنْبَرِيُّ ابْنِ بِنْتِ يَحْيَى بْنِ مَنْصُورٍ الْقَاضِي، أنبأ جَدِّي، أنبأ مُحَمَّدُ بْنُ عَمْرٍو كَشْمَرْدَ، ثنا الْقَعْنَبِيُّ، ثنا سُلَيْمَانُ هُوَ ابْنُ بِلَالٍ عَنْ يَحْيَى يَعْنِي ابْنَ سَعِيدٍ، عَنْ بُشَيْرِ بْنِ يَسَارٍ، أَنَّ عُمَرَ بْنَ الْخَطَّابِ رَضِيَ اللهُ عَنْهُ، كَانَ يَبْعَثُ أَبَا حَثْمَةَ خَارِصًا يَخْرُصُ النَّخْلَ، فَيَأْمُرُهُ إِذَا وَجَدَ الْقَوْمَ فِي حَائِطِهِمْ يَخْرُصُونَهُ أَنْ يَدَعَ لَهُمْ مَا يَأْكُلُونَهُ فَلَا يَخْرُصُهُ. وَقَدْ ذَكَرَهُ الشَّافِعِيُّ فِي الْقَدْيمِ عَنْ رَجُلٍ عَنْ يَحْيَى بْنِ سَعِيدٍ وَقَدْ رَوَاهُ حَمَّادُ بْنُ زَيْدٍ عَنْ يَحْيَى مَوْصُولًا
