بَابُ قَوْلِ اللَّهِ تَعَالَى: {وَإِذَا حَضَرَ الْقِسْمَةَ أُولُو الْقُرْبَى وَالْيَتَامَى وَالْمَسَاكِينُ فَارْزُقُوهُمْ مِنْهُ}

Sahih al-Bukhari 2759
Ibn `Abbas (رضي الله تعالی عنہ), narrated that some people claim that the order in the above Verse is cancelled, by Allah, it is not cancelled, but the people have stopped acting on it. There are two kinds of guardians (who are in charge of the inheritance): One is that who inherits; such a person should give (of what he inherits to the relatives, the orphans and the needy, etc.), the other is that who does not inherit (e.g. the guardian of the orphans): such a person should speak kindly and say (to those who are present at the time of distribution), "I cannot give it to you (as the wealth belongs to the orphans).
حضرت ابن عباس ؓ سے روایت ہے، انھوں نے فرمایا: لوگ کہتے ہیں کہ مذکورہ بالاآیت منسوخ ہے۔ نہیں، اللہ کی قسم!یہ منسوخ نہیں ہے، البتہ لوگ اس پر عمل کرنے میں سست ہوگئے ہیں۔ دراصل ترکہ لینے والے دو طرح کے لوگ ہوتے ہیں: ایک تو وہ جوخود وارث ہوں، انھیں تو اس وقت کچھ خرچ کرنے کا حکم ہے، دوسرے وہ جو خود وارث نہیں، انھیں حکم ہے کہ وہ نرمی سے جواب دیں۔ وہ یوں کہے کہ میں تو تمھیں دینے کا اختیار نہیں رکھتا۔
Hazrat Ibn Abbas (Radi Allahu Anhu) se riwayat hai, unhon ne farmaya: log kehte hain ke mazkoora-bala aayat mansookh hai. Nahi, Allah ki qasam! yeh mansookh nahi hai, albatta log is par amal karne mein sust ho gaye hain. Darasul tarka lene wale do tarah ke log hote hain: ek to woh jo khud waris hon, unhein to is waqt kuch kharch karne ka hukm hai, doosre woh jo khud waris nahi, unhein hukm hai ke woh narmi se jawab dein. Woh yun kahe ke main to tumhein dene ka ikhtiyar nahi rakhta.
حَدَّثَنَا مُحَمَّدُ بْنُ الْفَضْلِ أَبُو النُّعْمَانِ ، حَدَّثَنَا أَبُو عَوَانَةَ ، عَنْ أَبِي بِشْرٍ ، عَنْ سَعِيدِ بْنِ جُبَيْرٍ ، عَنْ ابْنِ عَبَّاسٍ رَضِيَ اللَّهُ عَنْهُمَا ، قَالَ :إِنَّ نَاسًا يَزْعُمُونَ أَنَّ هَذِهِ الْآيَةَ نُسِخَتْ ، وَلَا ، وَاللَّهِ مَا نُسِخَتْ وَلَكِنَّهَا مِمَّا تَهَاوَنَ النَّاسُ ، هُمَا وَالِيَانِ : وَالٍ يَرِثُ ، وَذَاكَ الَّذِي يَرْزُقُ ، وَوَالٍ لَا يَرِثُ فَذَاكَ الَّذِي يَقُولُ بِالْمَعْرُوفِ ، يَقُولُ : لَا أَمْلِكُ لَكَ أَنْ أُعْطِيَكَ .
