Chapter: Whoever is given the right of his brother through a judicial decision

بَابُ مَنْ قُضِيَ لَهُ بِحَقِّ أَخِيهِ فَلاَ يَأْخُذْهُ، فَإِنَّ قَضَاءَ الْحَاكِمِ لاَ يُحِلُّ حَرَامًا وَلاَ يُحَرِّمُ حَلاَلاً

Sahih al-Bukhari 7182
Narrated `Aisha: (the wife of the Prophet) `Utba bin Abi Waqqas said to his brother Sa`d bin Abi Waqqas, The son of the slave girl of Zam`a is from me, so take him into your custody. So in the year of Conquest of Mecca, Sa`d took him and said. (This is) my brother's son whom my brother has asked me to take into my custody. `Abd bin Zam`a got up before him and said, (He is) my brother and the son of the slave girl of my father, and was born on my father's bed. So they both submitted their case before Allah's Apostle. Sa`d said, O Allah's Apostle! This boy is the son of my brother and he entrusted him to me. `Abd bin Zam`a said, This boy is my brother and the son of the slave girl of my father, and was born on the bed of my father. Allah's Apostle said, The boy is for you, O `Abd bin Zam`a! Then Allah's Apostle further said, The child is for the owner of the bed, and the stone is for the adulterer, He then said to Sauda bint Zam`a, Veil (screen) yourself before him, when he saw the child's resemblance to `Utba. The boy did not see her again till he met Allah.
نبی ﷺ کی زوجہ محترمہ سیدنا عائشہ ؓ سے روایت ہے انہوں نے فرمایا: عتبہ بن ابی وقاص نے اپنے بھائی سعد بن ابی وقاص ؓ کی یہ وصیت کی تھی کہ زمعہ کی لونڈی کا لڑکا میرا ہے، تم اسے اپنی پرورش میں لے لینا، چنانچہ فتح مکہ کے دن سیدنا سعد ؓ نے اسے اپنے قبضے میں لے لیا اور کہا: یہ میرا بھتیجا ہے اور مجھے میرے بھائی نے اس کے متعلق وصیت کی تھی۔ اس دوران میں عبد بن زمعہ کھڑے ہوئے اور کہا: یہ میرا بھائی ہے میرے والد کی لونڈی کا لڑکا ہے اور انھی کے بستر پر پیدا ہوا ہے چنانچہ وہ دونوں رسول اللہ ﷺ کے پاس اپنا مقدمہ لے کر گئے۔ سیدنا سعد ؓ نے کہا: اللہ کے رسول! یہ میرے بھائی کا لڑکا ہے اور اسی کے بستر پر پیدا ہوا ہے۔ رسول اللہ ﷺ نے فرمایا: ”عبد بن زمعہ! یہ تمہارا (بھائی) ہے“ اس کےبعد رسول اللہ ﷺ نے فرمایا ”بچہ بستر والے کا ہوتا ہے اور زانی بدکار کے لیے تو پتھر ہیں۔ آپ نے سیدہ سودہ بنت زمعہ ؓ سے فرمایا: ”تم اس (لڑکے) سے پردہ کیا کرو“ کیونکہ آپ نے عتبہ سے اس کی مشابہت دیکھ لی تھی، چنانچہ اس نے سیدہ سودہ ؓ کو مرنے تک نہیں دیکھا۔
Nabi (Sallallahu Alaihi Wasallam) ki zauja mohtarma Sayyidah Aisha (Radi Allahu Anha) se riwayat hai unhon ne farmaya: Utba bin Abi Waqas ne apne bhai Saad bin Abi Waqas (Radi Allahu Anhu) ki yeh wasiyat ki thi ke Zam'a ki londi ka larka mera hai, tum usay apni parwarish mein le lena, chunancha fatah-e-Makkah ke den Sayyiduna Saad (Radi Allahu Anhu) ne usay apne qabze mein le liya aur kaha: Yeh mera bhatija hai aur mujhe mere bhai ne is ke mutaliq wasiyat ki thi. Is douran mein Abd bin Zam'a kharay huye aur kaha: Yeh mera bhai hai mere walid ki londi ka larka hai aur unhi ke bister par paida hua hai chunancha woh dono Rasul Allah (Sallallahu Alaihi Wasallam) ke paas apna muqaddama le kar gaye. Sayyiduna Saad (Radi Allahu Anhu) ne kaha: Allah ke Rasul! Yeh mere bhai ka larka hai aur isi ke bister par paida hua hai. Rasul Allah (Sallallahu Alaihi Wasallam) ne farmaya: "Abd bin Zam'a! Yeh tumhara (bhai) hai" is ke baad Rasul Allah (Sallallahu Alaihi Wasallam) ne farmaya "baccha bister wale ka hota hai aur zani bad-kar ke liye to patthar hain." Aap ne Sayyidah Saudah bint Zam'a (Radi Allahu Anha) se farmaya: "Tum is (larke) se parda kiya karo" kyunke aap ne Utba se is ki mushabihat dekh li thi, chunancha is ne Sayyidah Saudah (Radi Allahu Anha) ko marne tak nahin dekha.
حَدَّثَنَا إِسْمَاعِيلُ ، قَالَ : حَدَّثَنِي مَالِكٌ ، عَنِ ابْنِ شِهَابٍ ، عَنْ عُرْوَةَ بْنِ الزُّبَيْرِ ، عَنْ عَائِشَةَ زَوْجِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، أَنَّهَا قَالَتْ : كَانَ عُتْبَةُ بْنُ أَبِي وَقَّاصٍ عَهِدَ إِلَى أَخِيهِ سَعْدِ بْنِ أَبِي وَقَّاصٍ أَنَّ ابْنَ وَلِيدَةِ زَمْعَةَ مِنِّي فَاقْبِضْهُ إِلَيْكَ ، فَلَمَّا كَانَ عَامُ الْفَتْحِ أَخَذَهُ سَعْدٌ ، فَقَالَ ابْنُ أَخِي : قَدْ كَانَ عَهِدَ إِلَيَّ فِيهِ فَقَامَ إِلَيْهِ عَبْدُ بْنُ زَمْعَةَ ، فَقَالَ : أَخِي وَابْنُ وَلِيدَةِ أَبِي وُلِدَ عَلَى فِرَاشِهِ ، فَتَسَاوَقَا إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقَالَ سَعْدٌ : يَا رَسُولَ اللَّهِ ، ابْنُ أَخِي كَانَ عَهِدَ إِلَيَّ فِيهِ ، وَقَالَ عَبْدُ بْنُ زَمْعَةَ : أَخِي وَابْنُ وَلِيدَةِ أَبِي وُلِدَ عَلَى فِرَاشِهِ ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : هُوَ لَكَ يَا عَبْدُ بْنَ زَمْعَةَ ، ثُمَّ قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : الْوَلَدُ لِلْفِرَاشِ ، وَلِلْعَاهِرِ الْحَجَرُ ، ثُمَّ قَالَ لِسَوْدَةَ بِنْتِ زَمْعَةَ : احْتَجِبِي مِنْهُ لِمَا رَأَى مِنْ شَبَهِهِ بِعُتْبَةَ ، فَمَا رَآهَا حَتَّى لَقِيَ اللَّهَ تَعَالَى .
