Chapter: Umar's statement about the grandfather.

باب: في قول عمر في الجد

Sunan al-Darimi 2947

Shu'bi (may Allah have mercy on him) said: The first person in Islam to inherit as a grandfather was Umar ibn al-Khattab (may Allah be pleased with him).


Grade: Sahih

شعبی رحمہ اللہ نے کہا: اسلام میں سب سے پہلے سیدنا عمر رضی اللہ عنہ ہیں جنہوں نے دادا کی حیثیت سے میراث لی۔

Shabi rehmatullah alaih ne kaha: Islam mein sab se pehle Sayyidna Umar (رضي الله تعالى عنه) hain jinhone dada ki haisiyat se miras li.

(حديث مقطوع) أَخْبَرَنَا مُحَمَّدُ بْنُ عُيَيْنَةَ، عَنْ عَلِيِّ بْنِ مُسْهِرٍ، عَنْ عَاصِمٍ، عَنْ الشَّعْبِيِّ، قَالَ: "إِنَّ أَوَّلَ جَدٍّ وَرِثَ فِي الْإِسْلَامِ عُمَرُ.

Sunan al-Darimi 2948

Shabi, may Allah have mercy on him, said: The first grandfather to inherit in Islam was Sayyiduna Umar, may Allah be pleased with him. He took his share, then Sayyiduna Ali and Sayyiduna Zayd, may Allah be pleased with them both, came to him and said, "This is not right, you are also like two brothers [to the deceased]."

شعبی رحمہ اللہ نے کہا: اسلام میں پہلے دادا جو وارث ہوئے سیدنا عمر رضی اللہ عنہ انہوں نے اپنا حصہ لے لیا تو سیدنا علی اور سیدنا زید رضی اللہ عنہما ان کے پاس آئے اور کہا کہ ایسے نہیں، آپ بھی دو بھائیوں کی طرح ہیں۔

Shabi rehmatullah alaih ne kaha: Islam mein pehle dada jo waris huye Sayyidna Umar razi Allah anhu unhon ne apna hissa le liya to Sayyidna Ali aur Sayyidna Zaid razi Allah anhuma un ke paas aaye aur kaha ke aise nahin, aap bhi do bhaiyon ki tarah hain.

(حديث موقوف) حَدَّثَنَا حَدَّثَنَا أَبُو نُعَيْمٍ، حَدَّثَنَا حَسَنٌ، عَنْ عَاصِمٍ، عَنْ الشَّعْبِيِّ، قَالَ: "أَوَّلُ جَدٍّ وَرِثَ فِي الْإِسْلَامِ عُمَر، فَأَخَذَ مَالَهُ، فَأَتَاهُ عَلِيٌّ، وَزَيْدٌ، فَقَالَا: لَيْسَ لَكَ ذَاكَ، إِنَّمَا أَنْتَ كَأَحَدِ الْأَخَوَيْنِ".

Sunan al-Darimi 2949

Shabi (may Allah have mercy on him) said: Sayyidna Umar (may Allah be pleased with him) would include the grandfather in the inheritance with one or two brothers. If there were more brothers, he would give the grandfather a third and a sixth with the offspring.

شعبی رحمہ اللہ نے کہا: سیدنا عمر رضی اللہ عنہ دادا کو ایک یا دو بھائی کے ساتھ تقسیم میں شریک کرتے تھے، اگر بھائی زیادہ ہوتے تو دادا کو ثلث دیتے اور اولاد کے ساتھ سدس دیتے۔

Shabi rehmatullah alaih ne kaha: Sayyiduna Umar razi Allah anhu dada ko ek ya do bhai ke sath taqsim mein sharik karte the, agar bhai zyada hote to dada ko suls dete aur aulad ke sath sudus dete.

(حديث موقوف) حَدَّثَنَا عُبَيْدُ اللَّهِ بْنُ مُوسَى، عَنْ عِيسَى الْخياط، عَنْ الشَّعْبِيِّ، قَالَ: كَانَ عُمَرُ "يُقَاسِمُ بِالْجَدِّ مَعَ الْأَخِ وَالْأَخَوَيْنِ، فَإِذَا زَادُوا أَعْطَاهُ الثُّلُثَ، وَكَانَ يُعْطِيهِ مَعَ الْوَلَدِ السُّدُسَ.

Sunan al-Darimi 2950

Marwan ibn al-Hakam narrated that when Umar ibn al-Khattab, may Allah be pleased with him, was wounded with a spear, he consulted the Companions about his successor and said, "I had an opinion about so-and-so (referring to a specific person). If you wish, follow it." Uthman ibn Affan, may Allah be pleased with him, said, "If we follow your opinion, it is guidance. And if we accept the opinion of the Sheikh (referring to Abu Bakr, may Allah be pleased with him), he was also a man of excellent judgment."


Grade: Sahih

مروان بن الحکم سے مروی ہے کہ سیدنا عمر بن الخطاب رضی اللہ عنہ جب نیزے سے زخمی ہوئے تو دادا کے بارے میں صحابہ سے مشورہ کیا اور کہا کہ دادا کے بارے میں میری ایک رائے تھی، اگر تم چاہو تو پیروی کرنا، سیدنا عثمان رضی اللہ عنہ نے کہا: اگر ہم آپ کی رائے کی پیروی کریں تو یہ راہِ ہدایت ہے اور اگر شیخ (سیدنا ابوبکر رضی اللہ عنہ) کی رائے مانیں تو وہ بھی بہت اچھی رائے والے تھے۔

Marwan bin al-Hakam se marvi hai ki Sayyidna Umar bin al-Khattab (رضي الله تعالى عنه) jab neze se zakhmi huye to dada ke bare mein sahaba se mashwara kiya aur kaha ki dada ke bare mein meri ek raaye thi, agar tum chaho to pairavi karna, Sayyidna Uthman (رضي الله تعالى عنه) ne kaha: Agar hum aap ki raaye ki pairavi karen to yah raah-e-hidayat hai aur agar Shaikh (Sayyidna Abu Bakr (رضي الله تعالى عنه) ) ki raaye manen to woh bhi bahut acchi raaye wale the.

(حديث موقوف) حَدَّثَنَا حَدَّثَنَا مُسْلِمُ بْنُ إِبْرَاهِيمَ، حَدَّثَنَا وُهَيْبٌ، حَدَّثَنَا هِشَامُ بْنُ عُرْوَةَ، عَنْ أَبِيهِ، عَنْ مَرْوَانَ بْنِ الْحَكَمِ: أَنَّ عُمَرَ بْنَ الْخَطَّابِ لَمَّا طُعِنَ، اسْتَشَارَهُمْ فِي الْجَدِّ، فَقَالَ: "إِنِّي كُنْتُ رَأَيْتُ فِي الْجَدِّ رَأْيًا، فَإِنْ رَأَيْتُمْ أَنْ تَتَّبِعُوهُ، فَاتَّبِعُوهُ، فَقَالَ لَهُ عُثْمَانُ: إِنْ نَتَّبِعْ رَأْيَكَ فَإِنَّهُ رَشَدٌ، وَإِنْ نَتَّبِعْ رَأْيَ الشَّيْخِ، فَنِعْمَ ذُو الرَّأْيِ كَانَ.
