The order stated: "Whoever intentionally kills his brother shall inherit nothing from him nor be given anything from his blood money. But if the death of the brother was accidental, he shall receive his share of the inheritance, but nothing from the blood money." They said, "Ata used to say the same."
حکم نے کہا: جو آدمی اپنے بھائی کو عمداً قتل کر ڈالے تو وہ نہ اس کی میراث میں سے کچھ لے سکے گا اور نہ اس کی دیت میں سے اس کو کچھ دیا جائے گا، اور اگر قتل خطا سے بھائی کی موت واقع ہوئی ہو تو میراث میں سے اس کو حصہ ملے گا، دیت میں سے کچھ نہیں ملے گا، انہوں نے کہا: عطاء بھی یہ ہی کہتے تھے۔
Hukm ne kaha: Jo aadmi apne bhai ko amdann qatal kar dale to wo na us ki miraas mein se kuchh le sakega aur na us ki diyat mein se us ko kuchh diya jayega, aur agar qatal khata se bhai ki maut waqe hui ho to miraas mein se us ko hissa milega, diyat mein se kuchh nahin milega, unhon ne kaha: Ata bhi yahi kahte the.
It has been narrated on the authority of Sayyidna Ali, may Allah be pleased with him, that a man hit his mother with a stone and she died. So, (the killer) asked his brothers for his share of the inheritance. So they said: "You have no right in the inheritance." They came to Sayyidna Ali, may Allah be pleased with him, so he imposed the blood money on the killer and deprived him of the inheritance.
خلاس سے مروی ہے سیدنا علی رضی اللہ عنہ نے روایت کیا: ایک آدمی نے اپنی ماں کو پتھر کھینچ مارا، چنانچہ وہ فوت ہو گئی، اس (مارنے والے) نے اپنے بھائیوں سے میراث میں سے اپنا حصہ طلب کیا، تو انہوں نے کہا: میراث میں تمہارا کوئی حق نہیں، وہ لوگ سیدنا علی رضی اللہ عنہ کے پاس آئے تو انہوں نے مارنے والے پر دیت کو لازم کیا اور میراث سے بے دخل کر دیا۔
Khalaas se marvi hai syedna ali raziallahu anhu ne riwayat kia: Ek aadmi ne apni maan ko pathar khench mara, chunancha woh faut ho gai, is (marne wale) ne apne bhaiyon se miraas mein se apna hissa talab kia, to unhon ne kaha: Miraas mein tumhara koi haq nahin, woh log syedna ali raziallahu anhu ke paas aaye to unhon ne marne wale par deet ko laazim kia aur miraas se bedakhal kar dia.
It was narrated from Mujahid that Ibn ‘Abbas (may Allah be pleased with him and his father) said: “The killer does not inherit anything from the one he killed.”

مجاہد سے مروی ہے سیدنا ابن عباس رضی اللہ عنہما نے کہا: قاتل مقتول کی کسی چیز کا وارث نہ ہو گا۔
Mujaahid se marvi hai Sayyidna Ibn Abbas ( (رضي الله تعالى عنه) a ne kaha Qatil maqtool ki kisi cheez ka waris na ho ga.
Mu'ammar narrated from Qatadah: that a man accused his wife (of adultery) and he brought witnesses, as a result of which the woman was stoned to death. Qatadah said: He (the husband) will inherit from her.

معمر نے قتادہ سے روایت کیا کہ ایک آدمی نے اپنی بیوی کو تہمت لگائی اور شہود (گواہ) بھی لایا جس کے نتیجے میں اس عورت کو رجم کر دیا گیا، قتادہ نے کہا: وہ (شوہر) اس کا وارث ہو گا۔
Muammar ne Qatadah se riwayat kya ke aik aadmi ne apni biwi ko tohmat lagai aur shuhood bhi laya jis ke natije mein us aurat ko rajm kar diya gaya, Qatadah ne kaha: woh (shohar) us ka waris ho ga.
Abu Awana reported from Hammad that a man was given a hundred lashes. Nu'man said: Perhaps it resulted in his death. Hammad said: They will be heirs to one another.

ابوعوانہ نے حماد سے بیان کیا کہ ایک آدمی کو کوڑوں کی سزا دی گئی، نعمان نے کہا: شاید جس کے نتیجے میں وہ مر گیا، حماد نے کہا: وہ ایک دوسرے کے وارث ہوں گے۔
Abu Awanah ne Hammad se bayan kya keh ek aadmi ko kordon ki saza di gai, Nauman ne kaha: shayad jis ke natije mein woh mar gaya, Hammad ne kaha: woh ek dusre ke waris honge.
It is narrated on the authority of 'Amir (Sha'bi) that Sayyiduna 'Ali (may Allah be pleased with him) said: "A murderer will neither inherit nor prevent (inheritance) (meaning: nor will he deprive any heir)."

عامر (شعبی) رحمہ اللہ سے مروی ہے سیدنا علی رضی اللہ عنہ نے کہا: قاتل نہ میراث پائے گا نہ حاجب ہوگا (یعنی کسی وارث کو محروم بھی نہ کرے گا)۔
Aamir (Shoabi) Rehmatullah Alaih se marvi hai Sayyidna Ali (رضي الله تعالى عنه) ne kaha Qatil na miras paye ga na hajib hoga (yani kisi waris ko mehroom bhi na kare ga).
It is narrated on the authority of Shabi Rahimahullah, Sayyidina Umar Radiallahu Anhu said: "The killer, whether by mistake or intentionally, will not inherit from [the one he killed]."
شعبی رحمہ اللہ سے مروی ہے سیدنا عمر رضی اللہ عنہ نے فرمایا: خطا اور عمد کسی کا بھی قاتل وارث نہ ہو گا۔
Shubi rehmatullah alaih se marvi hai saidina Umar (رضي الله تعالى عنه) ne farmaya: khata aur amd kisi ka bhi qatil waris na ho ga.
It has been narrated on the authority of Ta'us, on the authority of Ibn Abbas (may peace be upon them) who said: A murderer will not inherit (from his victim).

طاؤوس رحمہ اللہ سے مروی ہے سیدنا ابن عباس رضی اللہ عنہما نے کہا: قاتل وارث نہ ہو گا۔
Taous rehmatullah alaihe se marvi hai saidina ibne abbas razi allaho anhoma ne kaha qatil waris na ho ga.
