Sunan al-Darimi 2989
Qatadah (may Allah have mercy on him) reported that Sayyidina Ali and Sayyidina Ibn Mas'ud (may Allah be pleased with them both) said regarding the child of Li'an (a child born after the oath of imprecation): "He who has been separated from his father and paternal uncles, for him is one-third for his grandmother and the remaining two-thirds for his maternal siblings." And Sayyidina Zayd bin Thabit (may Allah be pleased with him) said: "One-sixth for the grandmother and one-third for the maternal siblings, and the rest of the estate will be deposited in the Baitul Maal (treasury)."
قتاده رحمہ اللہ نے خبر دی کہ سیدنا علی اور سیدنا ابن مسعود رضی اللہ عنہما نے ولد الملاعنہ کے بارے میں کہا: جس نے جدہ اور اپنے اخیافی (مادری بھائی) چھوڑے، جدہ (ام الام) کے لئے ثلث اور مادری بھائیوں کے لئے باقی بچے دو ثلث ہیں، اور سیدنا زید بن ثابت رضی اللہ عنہ نے کہا: نانی کو سدس اور مادری بھائیوں کو ثلث، اور جو بچے وہ بیت المال میں جمع ہوگا۔
Qatada rehmatullah ne khabar di ke Sayyidna Ali aur Sayyidna Ibn Masud ( (رضي الله تعالى عنه) a ne walad almulaanah ke bare mein kaha: Jis ne jadah aur apne akhiyaafi (madri bhai) chhode, jadah (umm alumm) ke liye sulus aur madri bhaion ke liye baqi bache do sulus hain, aur Sayyidna Zaid bin Sabit (رضي الله تعالى عنه) ne kaha: Nani ko sudus aur madri bhaion ko sulus, aur jo bache wo baitulmaal mein jama hoga.
(حديث موقوف) أَخْبَرَنَا حَجَّاجُ بْنُ مِنْهَالٍ، حَدَّثَنَا حَمَّادُ بْنُ سَلَمَةَ، أَخْبَرَنَا قَتَادَةُ: أَنَّ عَلِيًّا، وَابْنَ مَسْعُودٍ قَالَا فِي وَلَدِ المُلَاعَنَةٍ تَرْكُ جَدَّتِهِ وَإِخْوَتِهِ لأُمِّهِ، قَالَ: "لِلْجَدَّةِ الثُّلُثُ، وَلِلْإِخْوَةِ الثُّلُثَانِ"، وَقَالَ زَيْدُ بْنُ ثَابِتٍ: لِلْجَدَّةِ السُّدُسُ، وَلِلْإِخْوَةِ لِلْأُمِّ الثُّلُثُ، وَمَا بَقِيَ فَلِبَيْتِ الْمَالِ.
