Sunan al-Darimi 2988
It is narrated from Ibrahim (may Allah have mercy on him). Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) said (regarding the inheritance of the son of the cursed woman): "His inheritance is for his mother, and those who are the heirs of the mother will pay the debt from it (if there is any debt)." And Qatadah (may Allah have mercy on him) said: It is narrated from Hasan (may Allah have mercy on him): "One-third is for the mother, and the remaining wealth is for the heirs of his mother."
ابراہیم رحمہ اللہ سے مروی ہے سیدنا عبداللہ بن مسعود رضی اللہ عنہ نے (ابن الملاعنہ کی میراث کے بارے میں) کہا: اس کی میراث اس کی ماں کے لئے ہے، ماں کے جو عصبہ ہیں وہ اس سے دیت ادا کریں گے (اگر دیرت ہوتو)۔ اور قتاده رحمہ اللہ نے کہا: حسن رحمہ اللہ سے مروی ہے: ثلث ماں کے لئے اور باقی مال اس کی ماں کے عصبہ کا ہے۔
Ibraheem rehmatullah alaihe se marvi hai saidina Abdullah bin Masood razi Allah anhu ne (ibn ul mulaanah ki miraas ke bare mein) kaha: is ki miraas is ki maan ke liye hai, maan ke jo asba hain wo is se dait ada karenge (agar dairat hoto). Aur Qatadah rehmatullah alaihe ne kaha: Hasan rehmatullah alaihe se marvi hai: suls maan ke liye aur baqi maal is ki maan ke asba ka hai.
(حديث موقوف) حَدَّثَنَا مُحَمَّدُ بْنُ عِيسَى، حَدَّثَنَا سَالِمُ بْنُ نُوحٍ، عَنْ عُمَرَ بْنِ عَامِرٍ، عَنْ حَمَّادٍ، عَنْ إِبْرَاهِيمَ، عَنْ عَبْدِ اللَّهِ، قَالَ: "مِيرَاثُهُ لِأُمِّهِ تَعْقِلُ عَنْهُ عَصَبَةُ أُمِّهِ"، وَقَالَ قَتَادَةُ، عَنْ الْحَسَنِ: لِأُمِّهِ الثُّلُثُ، وَبَقِيَّةُ الْمَالِ لِعَصَبَةِ أُمِّهِ.
