Chapter: The Hadd for stealing and the minimum threshold

باب حَدِّ السَّرِقَةِ وَنِصَابِهَا
Sahih Muslim 1684a
Ummul Momineen A'isha (رضي الله تعالى عنها) narrated that Allah's Apostle (صلى الله عليه وآله وسلم) ordered cutting off the hand of a thief for a quarter of a dinar rid upwards.
حضرت عائشہ رضی اللہ تعالی عنہ بیان کرتی ہیں کہ رسول اللہ صلی اللہ علیہ وسلم چور کا ہاتھ چوتھائی دینار اور اس سے زائد پر کاٹتے تھے۔
Hazrat Aisha (Radi Allahu Anha) bayan karti hain ke Rasulullah (Sallallahu Alaihi Wasallam) chor ka hath chouthayi dinar aur us se zaid par kaat-te thay.
Ummul Momineen A'isha (رضي الله تعالى عنها) narrated that Allah's Apostle (صلى الله عليه وآله وسلم) said, the hand of a thief should not be cut off but for a quarter of a dinar and upwards.
حضرت عائشہ رضی اللہ تعالی عنہا بیان کرتی ہیں کہ رسول اللہ صلی اللہ علیہ وسلم نے فرمایا: ”چور کا ہاتھ چوتھائی دینار یا اس سے زیادہ کی چوری کے سوا نہیں کاٹا جائے گا۔“
Hazrat Aisha (Radi Allahu Anha) bayan karti hain ke Rasulullah (Sallallahu Alaihi Wasallam) ne farmaya: 'Chor ka hath chouthayi dinar ya us se zyada ki chori ke siwa nahi kata jaye ga.'
Ummul Momineen A'isha (رضي الله تعالى عنها) narrated that Allah's Apostle (صلى الله عليه وآله وسلم) said, the hand (of a thief) should not be cut off but for a quarter of a dinar and what is above that.
حضرت عائشہ رضی اللہ تعالی عنہا بیان کرتی ہیں کہ میں نے رسول اللہ صلی اللہ علیہ وسلم کو یہ فرماتے ہوئے سنا: ”ہاتھ چوتھائی دینار اور اس سے زیادہ کے سوا نہیں کاٹا جائے گا۔“
Hazrat Aisha (Radi Allahu Anha) bayan karti hain ke main ne Rasulullah (Sallallahu Alaihi Wasallam) ko yeh farmate hue suna: 'Hath chouthayi dinar aur us se zyada ke siwa nahi kata jaye ga.'
Ummul Momineen A'isha (رضي الله تعالى عنها) narrated that Allah's Apostle (صلى الله عليه وآله وسلم) said, the hand of the thief may not be cut off but for a quarter of a dinar and upwards.
حضرت عائشہ رضی اللہ تعالی عنہا بیان کرتی ہیں کہ انہوں نے نبی اکرم صلی اللہ علیہ وسلم سے یہ فرمان سنا: ”چور کا ہاتھ ربع دینار اور اسے زائد کے سوا نہیں کاٹا جائے گا۔“
Hazrat Aisha (Radi Allahu Anha) bayan karti hain ke unhon ne Nabi Akram (Sallallahu Alaihi Wasallam) se yeh farman suna: 'Chor ka hath ruba dinar aur ise zaid ke siwa nahi kata jaye ga.'
Ummul Momineen A'isha (رضي الله تعالى عنها) narrated that during the lifetime of Allah's Apostle (صلى الله عليه وآله وسلم) the hand of the thief was not cut off for less than the price of a shield, iron coat or armor and both of them are valuable.
حضرت عائشہ رضی اللہ تعالی عنہا بیان کرتی ہیں کہ رسول اللہ صلی اللہ علیہ وسلم کے دور میں چور کا ہاتھ مجن، حجفۃ یا ترس کی قیمت سے کم پر نہیں کاٹا گیا، حجفہ اور ترس دونوں قیمتی چیزیں ہیں، (یہ تینوں الفاظ ڈھال کے لیے استعمال ہوتے ہیں)
Hazrat Aisha (Radi Allahu Anha) bayan karti hain ke Rasulullah (Sallallahu Alaihi Wasallam) ke daur mein chor ka hath Mijann, Hajafah ya Turs ki qeemat se kam par nahi kata gaya. Hajafah aur Turs donon qeemti cheezein hain (yeh teenon alfaz dhaal ke liye istemal hote hain).
This Hadith has been narrated on the authority of Hisham through another chain of transmitters, and in the Hadith narrated by Abdur Rahim and Abu Usama (the words are), ‘that (the shield) was valuable those days.’
امام صاحب اپنے تین اساتذہ کی تین سندوں سے ھشام کی مذکورہ بالا سند سے ابن نمیر کی مذکورہ بالا حدیث کی طرح بیان کرتے ہیں، عبدالرحیم اور اسامہ کی حدیث میں یہ الفاظ ہیں اور وہ ان دنوں قیمتی چیز تھیں۔
Imam Sahab apne teen ustadon ki teen sanadon se Hisham ki mazkurah bala sanad se Ibn Numair ki mazkurah bala hadith ki tarah bayan karte hain. Abdul Raheem aur Usama ki hadith mein yeh alfaz hain 'Aur woh un dinon qeemti cheez thin.'
Ibn 'Umar (رضي الله تعالى عنه) narrated that Allah’s Apostle (صلى الله عليه وآله وسلم) ordered to cut off the hand of a thief (in case of the theft) of a shield the price of which was three dirhams.
حضرت ابن عمر رضی اللہ تعالی عنہ سے روایت ہے کہ رسول اللہ صلی اللہ علیہ وسلم نے چور کا ہاتھ ایک ڈھال کے بدلہ میں کاٹا، جس کی قیمت تین درہم تھی۔
Hazrat Ibn Umar (Radi Allahu Anhuma) se riwayat hai ke Rasulullah (Sallallahu Alaihi Wasallam) ne chor ka hath ek dhaal ke badla mein kata, jis ki qeemat teen dirham thi.
حَدَّثَنَا يَحْيَى بْنُ يَحْيَى، قَالَ قَرَأْتُ عَلَى مَالِكٍ عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ، أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَطَعَ سَارِقًا فِي مِجَنٍّ قِيمَتُهُ ثَلاَثَةُ دَرَاهِمَ .
Sahih Muslim 1686b
This Hadith has been narrated on the authority of Ibn 'Umar (رضي الله تعالى عنه) through some other chains of transmitters but with a slight variation of words.
صاحب نے مذکورہ بالا حدیث اپنے تیرہ اساتذہ کی دس سندوں سے، نافع ہی کی مذکورہ بالا سند سے بیان کیا ہے، فرق صرف اتنا ہے کہ بعض نے قیمت کہا ہے اور بعض نے ثمن کا لفظ استعمال کیا ہے، اس کی قیمت تین درہم تھی۔
Imam Sahab ne mazkurah bala hadith apne tera ustadon ki das sanadon se, Nafi' hi ki mazkurah bala sanad se bayan kiya hai. Farq sirf itna hai ke baaz ne qeemat kaha hai aur baaz ne Thaman ka lafz istemal kiya hai, is ki qeemat teen dirham thi.
Abu Huraira (رضي الله تعالى عنه) narrated that the Apostle of Allah (صلى الله عليه وآله وسلم) said, let there be the curse of Allah upon the thief who steals an egg, and his hand is cut off, and steals a rope and his hand is cut off.
حضرت ابوہریرہ رضی اللہ تعالی عنہ بیان کرتے ہیں کہ رسول اللہ صلی اللہ علیہ وسلم نے فرمایا: ”اللہ تعالیٰ چور پر لعنت بھیجے، ایک انڈا چراتا ہے تو اس کا ہاتھ کاٹ دیا جاتا ہے اور ایک رسہ چراتا ہے تو اس کا ہاتھ کاٹ دیا جاتا ہے۔“
Hazrat Abu Hurairah (Radi Allahu Anhu) bayan karte hain ke Rasulullah (Sallallahu Alaihi Wasallam) ne farmaya: 'Allah Ta'ala chor par la'nat bheje, ek anda churata hai to us ka hath kaat diya jata hai aur ek rassa churata hai to us ka hath kaat diya jata hai.'
This Hadith is narrated on the authority of A'mash with the same chain of transmitters with a slight variation of words.
امام صاحب اپنے تین اساتذہ سے اعمش ہی کی مذکورہ بالا سند سے مذکورہ بالا روایت ان الفاظ میں بیان کرتے ہیں کہ آپصلی اللہ علیہ وسلم نے فرمایا: ”اگر وہ رسی چوری کرتا ہے اور اگر وہ انڈا چوری کرتا ہے۔“
Imam Sahab apne teen ustadon se A'mash hi ki mazkurah bala sanad se mazkurah bala riwayat in alfaz mein bayan karte hain ke aap (Sallallahu Alaihi Wasallam) ne farmaya: 'Agar woh rassi chori karta hai aur agar woh anda chori karta hai.'
