Mustadrak Al Hakim 2826
Ukrama (may Allah be pleased with him) narrated that the wife of Thabit bin Qais took khula (divorce initiated by wife) from him, so the Messenger of Allah (peace and blessings of Allah be upon him) fixed her waiting period as one menstrual cycle. Aisha (may Allah be pleased with her) narrated: She intended to emancipate two slaves (who were husband and wife). She asked the Prophet (peace and blessings of Allah be upon him) about it, so he (peace and blessings of Allah be upon him) said: Free the man before the woman. This hadith is sahih (authentic) according to the criteria of Imam Bukhari (may Allah have mercy on him) and Imam Muslim (may Allah have mercy on him), but the two Sheikhs did not narrate it.
" حضرت عکرمہ رضی اللہ عنہ فرماتے ہیں کہ ثابت بن قیس کی بیوی نے ان سے خلع لیا تو رسول اللہ نے اس کی عدت ایک حیض قرار دی ۔ ٭٭ حضرت عائشہ رضی اللہ عنہا فرماتی ہیں : انہوں نے دو غلام ( جو کہ دونوں میاں بیوی تھے ) کو آزاد کرنے کا ارادہ کیا تو اس سلسلے میں نبی اکرم ﷺ سے پوچھا تو آپ ﷺ نے فرمایا : عورت سے پہلے مرد کو آزاد کریئے گا ۔ ٭٭ یہ حدیث امام بخاری رحمۃ اللہ علیہ اور امام مسلم رحمۃ اللہ علیہ کے معیار کے مطابق صحیح ہے لیکن شیخین نے اسے نقل نہیں کیا ۔"
Hazrat Akarma RA farmate hain ki Sabit bin Qais ki biwi ne un se khula liya to Rasool Allah ne us ki iddat ek haiz karar di. Hazrat Ayesha RA farmati hain: Unhon ne do ghulam (jo keh donon miyan biwi thay) ko azad karne ka irada kiya to is silsile mein Nabi Akram SAW se poocha to aap SAW ne farmaya: Aurat se pehle mard ko azad kareye ga. Yeh hadees Imam Bukhari RA aur Imam Muslim RA ke miyaar ke mutabiq sahih hai lekin Shekhan ne ise naqal nahin kiya.
حَدَّثَنَاهُ أَبُو بَكْرِ بْنُ إِسْحَاقَ، أَنْبَأَ أَحْمَدُ بْنُ سَلَمَةَ، ثنا إِسْحَاقُ بْنُ إِبْرَاهِيمَ، أَنْبَأَ عَبْدُ الرَّزَّاقِ، عَنْ مَعْمَرٍ، عَنْ عَمْرِو بْنِ مُسْلِمٍ، عَنْ عِكْرِمَةَ، أَنَّ امْرَأَةَ ثَابِتِ بْنِ قَيْسٍ اخْتَلَعَتْ مِنْهُ، «فَجَعَلَ النَّبِيُّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ عِدَّتَهَا حَيْضَةً»
