Mustadrak Al Hakim 8115
Abu Huraira (may Allah be pleased with him) reported that the Prophet (peace and blessings of Allah be upon him) said: "If a person drinks this (intoxicant), flog him. If he drinks it again, flog him. If he drinks it a third time, flog him. And if he still does not refrain, then execute him." ** This hadith is sahih (authentic) according to the criteria of Imam Muslim (may Allah have mercy on him), but the two Shaykhs (Bukhari and Muslim) did not narrate it.
" حضرت ابوہریرہ رضی اللہ عنہ فرماتے ہیں کہ نبی اکرم ﷺ نے ارشاد فرمایا : اگر کوئی شخص اس پیئے تو اس کو کوڑے مارو ، اگر دوبارہ پیئے ، پھر کوڑے مارو ، تیسری مرتبہ پیئے ، تو پھر بھی کوڑے مارو ، اور اگر پھر بھی باز نہ آئے تو اس کو قتل کر دو ۔ ٭٭ یہ حدیث امام مسلم رحمۃ اللہ علیہ کے معیار کے مطابق صحیح ہے لیکن شیخین نے اس کو نقل نہیں کیا ۔"
Hazrat Abu Huraira Radi Allaho Anho farmate hain keh Nabi Akram Sallallaho Alaihi Wasallam ne irshad farmaya: Agar koi shakhs is piye to usko kore maro, agar dobara piye, phir kore maro, teesri martaba piye, to phir bhi kore maro, aur agar phir bhi baaz na aaye to usko qatl kar do. ** Yeh hadees Imam Muslim Rehmatullah Alaih ke miyaar ke mutabiq sahih hai lekin Shaykhain ne isko naqal nahi kiya.
فَحَدَّثَنَا الْحَسَنُ بْنُ يَعْقُوبَ، الْعَدْلُ، ثَنَا يَحْيَى بْنُ أَبِي طَالِبٍ، ثَنَا عَبْدُ الْوَهَّابِ بْنُ عَطَاءٍ، أَنْبَأَ سَعِيدٌ، عَنْ سُهَيْلِ بْنِ أَبِي صَالِحٍ، عَنْ أَبِيهِ، عَنْ أَبِي هُرَيْرَةَ رَضِيَ اللَّهُ عَنْهُ، أَنَّ النَّبِيَّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ قَالَ: «مَنْ شَرِبَ الْخَمْرَ فَاجْلِدُوهُ، ثُمَّ إِذَا شَرِبَ فَاجْلِدُوهُ، ثُمَّ إِذَا شَرِبَ فَاجْلِدُوهُ، ثُمَّ إِذَا شَرِبَ فِي الرَّابِعَةِ فَاقْتُلُوهُ» وَهَذَا الْإِسْنَادُ صَحِيحٌ عَلَى شَرْطِ مُسْلِمٍ وَلَمْ يُخَرِّجَاهُ "" [التعليق - من تلخيص الذهبي] 8115 - على شرط مسلم
