باب مَا لاَ قَطْعَ فِيهِ
Sunan an-Nasa'i 4960
Amr bin Shuaib narrated from his father, that his grandfather said that the Apostle of Allah ( صلى الله عليه وآله وسلم) was asked, ‘for how much is the hand (of the thief) to be cut off?’ He said, ‘the hand (of the thief) is not to be cut off for (stealing) fruit on the tree, but if (the fruit) has been taken to the place where it is stored to dry, then the (thief's) hand is to be cut off (if what is stolen is equivalent to) the price of a shield. The (thief's) hand is not to be cut off for a sheep (stolen) from the grazing land, but if it had been put in the pen, then the (thief's) hand is to be cut off (if what is stolen is equivalent to) the price of a shield.’

رافع بن خدیج رضی اللہ عنہ کہتے ہیں کہ میں نے رسول اللہ ﷺ کو فرماتے ہوئے سنا: ”نہ پھلوں کے چرانے میں ہاتھ کاٹا جائے گا اور نہ کھجور کے گابے کے چرانے میں“۔
Rafi' bin Khadij (رضي الله تعالى عنه) kehte hain ke main ne Rasool Allah (صلى الله عليه وآله وسلم) ko farmate huye suna: "Nah phalon ke churanay main hath kata jaega aur nah khajoor ke gabe ke churanay main".
Amr bin Shuaib narrated from his father, that his grandfather Abdullah bin Amr ( رضي الله تعالى عنه) said that the Apostle of Allah (صلى الله عليه وآله وسلم) wsa asked about fruit on the tree. He said, ‘whatever a needy person takes without putting any in his pocket (and taking it away), there is no penalty on him. But whoever takes anything away, he must pay a penalty of twice its value, and be punished. Whoever steals something after it has been stored properly, and its value is equal to that of a shield, his hand must be cut off. Whoever steals something worth less than that, he must pay a penalty of twice its value and be punished.’

رافع بن خدیج رضی اللہ عنہ کہتے ہیں کہ میں نے رسول اللہ ﷺ کو فرماتے سنا: ”نہ پھل میں ہاتھ کاٹا جائے گا اور نہ کھجور کے گابے کے چرانے میں“۔
Rafe bin Khadeej (رضي الله تعالى عنه) kehte hain ke main ne Rasool Allah (صلى الله عليه وآله وسلم) ko farmate suna: "Na phal mein hath kata jaye ga aur na khajoor ke gabe ke charane mein".
Amr bin Shuaib narrated from his father, that his grandfather Abdullah bin Amr ( رضي الله تعالى عنه) said that a man from Muzainah came to the Apostle of Allah (صلى الله عليه وآله وسلم) and said, ‘O Apostle of Allah (صلى الله عليه وآله وسلم), what do you think about a sheep stolen from the pasture?’ He said, ‘the thief must pay double and be punished. There is no cutting off of the hand for (stealing) livestock, except what which has been put in the pen, if its value is equal to that of a shield, in which case the (thief's) hand is to be cut off. If its value is not equal to that of a shield, then he should pay a penalty of twice its value and be flogged as a punishment.’ He said, ‘O Apostle of Allah (صلى الله عليه وآله وسلم)! What do you think about fruit on the tree?’ He said, ‘the thief must pay double and be punished. There is no cutting off of the hand for (stealing) fruit on the tree, except for that which has been stored properly if its value is equal to that of a shield, in which case the (thief's) hand is not equal to that of a shield, then he should pay a penalty of twice its value and be flogged as a punishment.’

أَخْبَرَنِي يَحْيَى بْنُ حَبِيبِ بْنِ عَرَبِيٍّ، قَالَ حَدَّثَنَا حَمَّادٌ، عَنْ يَحْيَى، عَنْ مُحَمَّدِ بْنِ يَحْيَى بْنِ حَبَّانَ، عَنْ رَافِعِ بْنِ خَدِيجٍ، قَالَ سَمِعْتُ رَسُولَ اللَّهِ صلى الله عليه وسلم يَقُولُ " لاَ قَطْعَ فِي ثَمَرٍ وَلاَ كَثَرٍ " .

رافع بن خدیج رضی اللہ عنہ روایت کرتے ہیں کہ نبی اکرم ﷺ نے فرمایا: ”نہ پھل کے چرانے میں اور نہ گابے کے چرانے میں ہاتھ کاٹا جائے گا“۔
Rafe' bin Khadeej (رضي الله تعالى عنه) riwayat karte hain ke Nabi-e-Akram (صلى الله عليه وآله وسلم) ne farmaya: "Na phal ke chrane mein aur na gabe ke chrane mein hath kata jaega".
أَخْبَرَنَا عَبْدُ الْحَمِيدِ بْنُ مُحَمَّدٍ، قَالَ حَدَّثَنَا مَخْلَدٌ، قَالَ حَدَّثَنَا سُفْيَانُ، عَنِ يَحْيَى، عَنْ مُحَمَّدِ بْنِ يَحْيَى بْنِ حَبَّانَ، عَنْ رَافِعِ بْنِ خَدِيجٍ، عَنِ النَّبِيِّ صلى الله عليه وسلم قَالَ " لاَ قَطْعَ فِي ثَمَرٍ وَلاَ كَثَرٍ " .

رافع بن خدیج رضی اللہ عنہ کہتے ہیں کہ میں نے رسول اللہ ﷺ کو فرماتے ہوئے سنا: ”نہ پھل چرانے میں اور نہ «کثر» چرانے میں ہاتھ کاٹا جائے گا“، اور «کثر» کھجور کے گابا ( خوشہ ) کو کہتے ہیں۔
Rafi' bin Khadeej (رضي الله تعالى عنه) kehte hain ke main ne Rasool Allah (صلى الله عليه وآله وسلم) ko farmate huye suna: "nah phal churanay mein aur nah "khasr" churanay mein hath kaata jaega", aur "khasr" khajoor ke gaba (khusha) ko kehte hain.
Rafi bin Khadij (رضي الله تعالى عنه) narrated that he heard the Apostle of Allah ( صلى الله عليه وآله وسلم) say, ‘the hand is not to be cut off for (stealing) produce or the spadix of palm trees.’

رافع بن خدیج رضی اللہ عنہ سے روایت ہے کہ رسول اللہ ﷺ نے فرمایا: ”پھل چرانے میں، اور نہ ہی گابا چرانے میں ہاتھ کاٹا جائے گا“۔ ابوعبدالرحمٰن ( نسائی ) کہتے ہیں: یہ غلط ہے، میں ابومیمون کو نہیں جانتا ۔
Rafi bin Khadeej (رضي الله تعالى عنه) se riwayat hai ke Rasool Allah (صلى الله عليه وآله وسلم) ne farmaya: "Phal churanay mein, aur nahin hi GABA churanay mein hath kata jaaye ga" Aboo Abdur Rahman (Nasa'i) kahte hain: yeh ghalat hai, main Aboo Maimoon ko nahin jaanta

Imam Abu Abdur-Rahman (An-Nasai) said, ‘this is a mistake, and I do not know who Abu Maimun (one of the narrators) is.’

جابر رضی اللہ عنہ کہتے ہیں کہ رسول اللہ ﷺ نے فرمایا: ”امانت میں خیانت کرنے والے، علانیہ لوٹ کر لے جانے اور اچک لینے والے کا ہاتھ نہیں کاٹا جائے گا“ ۱؎۔ ( ابوعبدالرحمٰن نسائی کہتے ہیں: ) اسے سفیان نے ابو الزبیر سے نہیں سنا۔ ( اس کی دلیل اگلی سند ہے )
Jabir (رضي الله تعالى عنه) Kehte Hain Ke Rasool Allah (صلى الله عليه وآله وسلم) Ne Farmaya: "Amaanat Mein Khyanat Karne Wale, Alania Loot Kar Le Jane Aur Achak Le Jane Wale Ka Hath Nahin Kata Jayega" 1. (Abu Abdul Rahman Nasai Kehte Hain:) Isay Sufiyan Ne Abu Al Zubair Se Nahin Suna. (Is Ki Dalil Agli Sand Hai)

Jabir (رضي الله تعالى عنه) kehte hain ke Rasul Allah (صلى الله عليه وآله وسلم) ne farmaya: "Emaanat mein khyanat karne wala, loot le jaane aur achk le jane wala ka hath nahin kata jayega" (Abu Abdur Rahman Nasa'i kehte hain: ) Isse Ibn Jareej ne bhi Abu az-Zubair se nahin suna ( Is ke mutalliq mu'allif ki wazahat aage aa rahi hai)

جابر رضی اللہ عنہ کہتے ہیں کہ رسول اللہ ﷺ نے فرمایا: ”اچک کر لے جانے والے کا ہاتھ نہیں کاٹا جائے گا“۔
Jabir (رضي الله تعالى عنه) kehte hain ke Rasool Allah (صلى الله عليه وآله وسلم) ne farmaya: "Uchak kar le jaane wala ka hath nahin kata jaega".
أَخْبَرَنِي إِبْرَاهِيمُ بْنُ الْحَسَنِ، عَنْ حَجَّاجٍ، قَالَ قَالَ ابْنُ جُرَيْجٍ قَالَ أَبُو الزُّبَيْرِ عَنْ جَابِرٍ، عَنْ رَسُولِ اللَّهِ صلى الله عليه وسلم " لَيْسَ عَلَى الْمُخْتَلِسِ قَطْعٌ " .
Sunan an-Nasa'i 4974
Sufyan narrated from Abu Az-Zubair (رضي الله تعالى عنه), from Jabir (رضي الله تعالى عنه) that the Apostle of Allah (صلى الله عليه وآله وسلم) said, ‘the hand of the traitor, robber and pilferer is not to be cut off.’
Sufyan did not hear it from Abu Az-Zubair (رضي الله تعالى عنه).
Grade: Da'if
جابر رضی اللہ عنہ کہتے ہیں کہ کسی خیانت کرنے والے کا ہاتھ نہیں کاٹا جائے گا۔ ابوعبدالرحمٰن ( نسائی ) کہتے ہیں: اس حدیث کو ابن جریج سے: عیسیٰ بن یونس، فضل بن موسیٰ، ابن وہب، محمد بن ربیعہ، مخلد بن یزید اور سلمہ بن سعید، یہ بصریٰ ہیں اور ثقہ ہیں، نے روایت کیا ہے۔ ابن ابی صفوان کہتے ہیں - اور یہ سب اپنے زمانے کے سب سے بہتر آدمی تھے: ان میں سے کسی نے «حدثنی ابوالزبیر» یعنی ”مجھ سے ابوالزبیر نے بیان کیا“ نہیں کہا۔ اور میرا خیال ہے ان میں سے کسی نے ابوالزبیر سے اسے سنا بھی نہیں ہے، واللہ اعلم ۔
Jaber (رضي الله تعالى عنه) Kehte Hain Ke Kisi Khiyanat Karne Wale Ka Hath Nahin Kata Jayega. Abu Abdur Rahman ( Nasai ) Kehte Hain: Is Hadith Ko Ibn Jareej Se: Esa Bin Yunus, Fazl Bin Musa, Ibn Wahb, Muhammad Bin Rabi'a, Mukhled Bin Yazid Aur Salma Bin Saeed, Yah Basri Hain Aur Thiqa Hain, Ne Riwayat Kiya Hai. Ibn Abi Sufawan Kehte Hain - Aur Yah Sab Apne Zamane Ke Sab Se Behtar Admi The: In Mein Se Kisi Ne «Hadathani Abualzubair» Yani ”Mujh Se Abualzubair Ne Bayan Kiya“ Nahin Kaha. Aur Mera Khayal Hai In Mein Se Kisi Ne Abualzubair Se Ise Suna Bhi Nahin Hai, Wallahu A'lam 1؎.
It was narrated from Sufyan, from Abu Az-Zubair, that Jabir said:
The Messenger of Allah said: 'The pilferer is not to be cut off. ' (Sahih) Ibn Juraij also did not hear it from Abu Az-Zubair. Ibn Juraij also did not hear it from Abu Az-Zubair.

جابر رضی اللہ عنہ کہتے ہیں کہ رسول اللہ ﷺ نے فرمایا: ”نہ تو اچک کر لے جانے والے کا، نہ کسی لوٹنے والے کا، اور نہ ہی کسی خائن کا ہاتھ کاٹا جائے گا“۔
Jabir (رضي الله تعالى عنه) Kehte Hain Ke Rasool Allah SALLALLAHU ALAIHI WASALLAM Ne Farmaya: "Na To Achk Kar Le Jane Wale Ka, Na Kisi Lootne Wale Ka, Aur Na Hi Kisi Khain Ka Hath Kata Jayega".
