It is narrated from Hazrat Jabir (R.A.) that the Holy Prophet (peace and blessings of Allah be upon him) said: The neighbor who shares a common path has a greater right of Shafa'a. If both have an equal right, and the neighbor is absent, he shall be waited for.
حضرت جابر (رض) سے مروی ہے کہ حضور اقدس (صلی اللہ علیہ وآلہ وسلم) نے ارشاد فرمایا : شفیع پڑوسی پر شفعہ کرنے کا زیادہ حق دار ہے، اگر ان دونوں کا راستہ ایک ہو اور شفیع غائب ہو تو اس کا انتظار کیا جائے گا۔
Hazrat Jabir (RA) se marvi hai keh Huzoor Aqdas (Sallallahu Alaihi Wasallam) ne irshad farmaya: Shafi parosi per shafa karne ka zyada haqdaar hai, agar in donon ka rasta ek ho aur shafi ghaib ho to uska intezar kiya jayega.
Hazrat Umar bin Abdul Aziz (may Allah have mercy on him) gave a verdict of Shuffah (preemption) for a partner after ten years, while his partner was absent.
حضرت عمر بن عبد العزیز (رض) نے دس سال بعد شریک کے لیے شفعہ کا فیصلہ فرمایا، اس کا شریک (ساتھی) غائب تھا۔
Hazrat Umar bin Abdul Aziz (RA) ne das saal baad sharik ke liye shuf'a ka faisla farmaya, is ka sharik (sathi) ghaib tha.
Hazrat Shariah (may Allah be pleased with him) says that if a house is sold and its guardian is absent or young, then the absentee has more right to the consideration until he returns, and the young child has the right until he comes of age.
حضرت شریح (رض) فرماتے ہیں کہ اگر گھر فروخت ہو اور اس کا شفیع غائب ہو یا چھوٹا ہو تو غائب واپس آنے تک شفعہ کا زیادہ حق دار ہے اور چھوٹا بچہ بڑا ہونے تک حق دار ہے۔
Hazrat Shurai (RA) farmate hain keh agar ghar farokht ho aur is ka shafi ghaib ho ya chhota ho to ghaib wapas aane tak shafa ka ziada haqdar hai aur chhota bachcha bada hone tak haqdar hai.
Hazrat Shabi (R.A) said that the absent person has the right of Shuffah. A letter will be written to him, if he accepts the Shuffah and sends the price of the house, then it is okay, otherwise there is no Shuffah for him. (The right will be terminated.)
حضرت شعبی (رض) فرماتے ہیں کہ غائب کے لیے شفعہ کا حق ہے۔ اس کو خط لکھا جائے گا، اگر وہ شفعہ کو قبول کرے اور گھر کا ثمن بھیج دے تو ٹھیک وگرنہ اس کے لیے شفعہ نہیں ہے۔ ( حق ختم ہوجائے گا۔ )
Hazrat Shabi (RA) farmate hain ke ghaib ke liye shafa ka haq hai. Iss ko khat likha jaye ga, agar wo shafa ko qubool kare aur ghar ka saman bhej de to theek warna iss ke liye shafa nahi hai. (Haq khatam ho jaye ga.)
