كِتَابُ الْبُيُوعِ وَالْأَقْضِيَةِ
Who said: The profit is according to what they agreed upon, and the loss is on the principal amount
مَنْ قَالَ: الرِّبْحُ عَلَى مَا اصْطَلَحَا عَلَيْهِ وَالْوَضِيعَةُ عَلَى رَأْسِ الْمَالِ

Hazrat Tawus was asked about two men who entered into a partnership in which one man's capital was greater than the other's and he also incurred a greater loss. So they (i.e., the scholars) said that there will be no peacock (tawaan) on this, only the distribution of wealth will be necessary.
حضرت طاوس سے سوال کیا گیا کہ دو آدمیوں نے اس طرح شراکت داری کی کہ ایک کا مال دوسرے سے زیادہ تھا اور اس کو نقصان میں بھی زیادہ کیا گیا۔ تو انھوں نے فرمایا کہ اس پر تاوان نہیں ہوگا اس پر صرف راس المال ہی لازم ہوگا۔
Hazrat Tawoos se sawal kya gaya keh do admiyon ne is tarah shirkat dari ki keh aik ka maal dosre se zyada tha aur us ko nuqsan mein bhi zyada kya gaya to unhon ne farmaya keh is par tawan nahin hoga is par sirf raas ul maal hi lazim hoga
نَا غُنْدَرٌ ، عَنْ عَبْدِ الرَّحْمَنِ بْنِ حُصَيْنٍ ، قَالَ : سُئِلَ طَاوُسٌ وَأَنَا أَسْمَعُ عَنْ شَرِيكَيْنِ اشْتَرَكَا أَحَدُهُمَا أَكْثَرُ رَأْسَ مَالٍ ، وَأَسْنَى فِي الْوَضِيعَةِ فَقَالَ طَاوُسٌ : « لَا يَغْرَمُ وَلَهُ رَأْسُ مَالِهِ »
