كِتَابُ الْفَرَائِضِ
Regarding grandmothers, how much do they inherit
فِي الْجَدَّاتِ كَمْ تَرِثُ مِنْهُنَّ

Hazrat Qasim narrates that a man died and left behind his two grandmothers, i.e., maternal and paternal grandmothers. Hazrat Abu Bakr (R.A.) made the maternal grandmother an heir and deprived the other. Then an Ansari said that if these two grandmothers had died and their sons were alive, then the son of the grandmother whom you have made an heir would not have inherited, and the son of the one whom you have left would have inherited. So, Hazrat Abu Bakr (R.A.) made her an heir as well and made them both partners in one-sixth of the property.
حضرت قاسم فرماتے ہیں کہ ایک آدمی فوت ہوا اور اس نے اپنی دو دادیاں یعنی نانی اور دادی چھوڑیں، حضرت ابوبکر (رض) نے نانی کو وارث بنایا اور دوسری کو محروم فرما دیا، تو ایک انصاری نے کہا کہ اگر یہ دو دادیاں فوت ہوچکی ہوتیں اور ان کے بیٹے زندہ ہوتے تو جس دادی کو آپ نے وارث بنایا ہے اس کا بیٹا وارث نہ بنتا، اور جس کو آپ نے چھوڑ دیا ہے اس کا بیٹا وارث بنتا ، چنانچہ حضرت ابوبکر (رض) نے اس کو بھی وارث بنادیا اور ان کو مال کے چھٹے حصّے میں شریک فرمایا۔
Hazrat Qasim farmate hain keh aik aadmi foot hua aur us ne apni do dadiyaan yani Nani aur dadi chhorain, Hazrat Abubakar (RA) ne Nani ko waris banaya aur doosri ko mehroom farma diya, to aik Ansaari ne kaha keh agar ye do dadiyaan foot ho chuki hoti aur in ke bete zinda hote to jis dadi ko aap ne waris banaya hai us ka beta waris na banta, aur jis ko aap ne chhor diya hai us ka beta waris banta, chunancha Hazrat Abubakar (RA) ne us ko bhi waris bana diya aur in ko maal ke chhate hisse mein sharik farma diya.
حَدَّثَنَا يَعْلَى ، عَنْ يَحْيَى ، عَنِ الْقَاسِمِ ، قَالَ : " تُوُفِّيَ رَجُلٌ وَتَرَكَ جَدَّتَيْهِ أُمَّ أُمِّهِ وَأَمَّ أَبِيهِ فَوَرَّثَ أَبُو بَكْرٍ أُمَّ أُمِّهِ وَتَرَكَ الْأُخْرَى ، فَقَالَ لَهُ رَجُلٌ مِنَ الْأَنْصَارِ : لَقَدْ تَرَكْتُ امْرَأَةً لَوْ أَنَّ الْجَدَّتَيْنِ مَاتَتَا وَابْنَهُمَا حَيٌّ ، مَا وَرِثَ مِنَ الَّتِي وَرَّثْتُهَا مِنْهُ شَيْئًا ، وَوَرِثَ الَّتِي تَرَكَتِ ابْنُ ابْنِهِ ، فَوَرَّثَهَا أَبُو بَكْرٍ فَشَرَّكَ بَيْنَهُمَا فِي السُّدُسِ "
