كِتَابُ الْفَرَائِضِ
The child dies, and one of his parents is Muslim, who inherits from him
الصَّبِيُّ يَمُوتُ وَأَحَدُ أَبَوَيْهِ مُسْلِمٌ، لِمَنْ مِيرَاثُهُ مِنْهُمَا

It is narrated from Hisham from Hasan that if a Jewish or Christian woman dies and she is married to a Muslim man, and they have young children, then the child will stay with their Muslim father. If they die in their childhood then their inheritance will go to their Muslim father and their mother will not have any share in the inheritance until they are young.
ہشام حضرت حسن سے روایت کرتے ہیں کہ جب یہودی یا نصرانی عورت مرجائے اور وہ مسلمان کے نکاح میں ہو جس سے اس کی نابالغ اولاد ہو تو بچہ اپنے مسلمان باپ کے ساتھ ہوگا، پس اگر وہ بچپن ہی میں مرجائیں تو ان کی میراث ان کے مسلمان باپ کے لیے ہوگی، اور ان کی ماں کا میراث میں کچھ حصّہ نہیں، جب تک وہ نابالغ ہوں۔
Hisham Hazrat Hassan se riwayat karte hain ki jab yehudi ya nasrani aurat mar jaye aur woh musalman ke nikah mein ho jis se uski nabaligh aulad ho to baccha apne musalman baap ke sath hoga, pas agar woh bachpan hi mein mar jayen to unki miraas unke musalman baap ke liye hogi, aur unki maan ka miraas mein kuch hissa nahi, jab tak woh nabaligh hon.
حَدَّثَنَا عَبْدُ الْأَعْلَى ، عَنْ هِشَامٍ ، عَنِ الْحَسَنِ ، أَنَّهُ قَالَ : « إِذَا مَاتَتْ يَهُودِيَّةٌ أَوْ نَصْرَانِيَّةٌ تَحْتَ مُسْلِمٍ لَهُ مِنْهَا أَوْلَادٌ صِغَارٌ ، فَإِنَّ الْوَلَدَ مَعَ أَبِيهِمِ الْمُسْلِمِ ، فَإِنْ مَاتُوا وَهُمْ صِغَارٌ فَمِيرَاثُهُمْ لِأَبِيهِمِ الْمُسْلِمِ ، لَيْسَ لِأُمِّهِمْ مِنَ الْمِيرَاثِ شَيْءٌ مَا دَامُوا صِغَارًا »
