٣٣-
كِتَابُ الْفَرَائِضِ
A slave married a free woman, and then he was freed after having children with her, to whom does the loyalty of his children go
مَمْلُوكٌ تَزَوَّجَ حُرَّةً، ثُمَّ إِنَّهُ أُعْتِقَ بَعْدَمَا وَلَدَتْ لَهُ أَوْلَادًا، لِمَنْ يَكُونُ وَلَاءُ وَلَدِهِ
Musannaf Ibn Abi Shaybah 31547
It is narrated from Qatadah, from Sa'eed and Khalas, that the Prophet (ﷺ) said: "When a slave marries a free woman and she gives birth to many children, then he is set free, he takes the Wala' (right of inheritance) with him."
قتادہ حضرت سعید اور خلاس سے روایت کرتے ہیں فرمایا کہ جب غلام آزاد عورت سے نکاح کرے اور وہ بہت سے بچے جنے پھر اس کو آزاد کردیا جائے تو وہ ولاء کو کھینچ لیتا ہے۔
Qatadah Hazrat Saeed aur Khalas se riwayat karte hain farmaya keh jab ghulam azad aurat se nikah kare aur woh bohat se bache janay phir us ko azad kar diya jaye to woh wilaya ko khench leta hai
حَدَّثَنَا عَبْدُ الصَّمَدِ بْنُ عَبْدِ الْوَارِثِ ، عَنْ حَمَّادِ بْنِ سَلَمَةَ ، عَنْ قَتَادَةَ ، عَنْ سَعِيدٍ ، وَخِلَاسٍ ، أَنَّهُمَا قَالَا : « إِذَا تَزَوَّجَ الْمَمْلُوكُ الْحُرَّةَ ، فَوَلَدَتْ أَوْلَادًا ، ثُمَّ أُعْتِقَ أَنَّهُ يَجُرُّ الْوَلَاءَ »
