كِتَابُ الْفَرَائِضِ
Regarding a man who converts under the guidance of another man and then dies, who said that he inherits from him?
فِي الرَّجُلِ يُسْلِمُ عَلَى يَدَيْ رَجُلٍ ثُمَّ يَمُوتُ، مَنْ قَالَ: يَرِثُهُ

Musannaf Ibn Abi Shaybah 31581
Abu al-Ashath narrated from his master that he said: I asked Hadrat Umar about a man who became Muslim at my hand and he made a deal with me, and then he died. He said: You are entitled to his wealth when he left no heir. If you refuse, then it is for the Baitulmal.
ابو الاشعث اپنے مولیٰ سے روایت کرتے ہیں فرمایا کہ میں نے حضرت عمر سے ایک آدمی کے بارے میں سوال کیا جو میرے ہاتھ پر مسلمان ہوا تھا اور اس نے میرے ساتھ معاملہ کیا، اور پھر مرگیا ، فرمایا کہ تم اس کے مال سے مستحق ہو جب کہ اس نے کوئی وارث نہ چھوڑا ہو، اگر تم انکار کرو تو یہ بیت المال ہے۔
Abu al ashat apne mawla se riwayat karte hain farmaya keh maine hazrat umar se aik aadmi ke bare mein sawal kya jo mere hath per musalman huwa tha aur usne mere sath muamla kya, aur phir mar gaya, farmaya keh tum uske mal se mustahiq ho jab keh usne koi waris na chora ho, agar tum inkar karo to yeh baitulmal hai.
حَدَّثَنَا ابْنُ إِدْرِيسَ ، عَنْ لَيْثٍ ، عَنْ أَبِي الْأَشْعَثِ ، عَنْ مَوْلَاهُ ، قَالَ : سَأَلْتُ عُمَرَ ، عَنْ رَجُلٍ أَسْلَمَ عَلَى يَدَيَّ ، قَالَ : « أَنْتَ أَحَقُّ النَّاسِ بِمِيرَاثِهِ مَا لَمْ يَتْرُكْ وَارِثًا ، فَإِنْ لَمْ يَتْرُكْ وَارِثًا فَفِي بَيْتِ الْمَالِ »
