كِتَابُ الْسير
What they said about a combatant who kills and takes wealth.
مَا قَالُوا فِي الْمُحَارِبِ إِذَا قَتَلَ وَأَخَذَ الْمَالَ

Hazrat Imran bin Hadeer (R.A) narrates that Hazrat Abu Mijlaz (R.A) asked about this verse (of the Holy Quran): Translation: This is the recompense of those who wage war against Allah and His Messenger (peace and blessings of Allah be upon him).... You (R.A) said: When this man kills and also takes wealth, then he will be killed, and when he snatches wealth and makes the way unsafe, then he will be crucified, and when he kills and does not return to this work, then he will be killed, and when he steals wealth and does not kill, then his hands and feet will be cut off, and when he spreads mischief, then he will be expelled from the country.
حضرت عمران بن حدیر (رض) فرماتے ہیں کہ حضرت ابو مجلز (رض) نے اس آیت کے بارے میں : ترجمہ : صرف یہی جزاء ہے ان لوگوں کی جو اللہ اور اس کے رسول (صلی اللہ علیہ وآلہ وسلم) سے جنگ کرتے ہیں۔۔۔ آپ (رض) نے یوں ارشاد فرمایا : جب یہ آدمی قتل کرے اور مال بھی لے لے ۔ تو اس کو قتل کردیا جائے گا اور جب مال چھین لے اور راستہ کو پرخطر بنا دے تو اس کو سولی دی جائے گی۔ اور جب قتل کرے اور اس کام کو دوبارہ نہ لوٹائے تو اس کو قتل کردیا جائے گا ۔ اور جب مال چھین لے اور یہ قتل نہ کرے تو اس کے ہاتھ پاؤں کاٹے جائیں گے۔ اور جب فساد پھیلائے تو اس کو ملک سے نکال دیا جائے گا۔
Hazrat Imran bin Hadeer (RA) farmate hain keh Hazrat Abu Majliz (RA) ne is ayat ke bare mein : Tarjuma : Sirf yahi jaza hai un logon ki jo Allah aur uske Rasool (Sallallahu Alaihi Wasallam) se jang karte hain... Aap (RA) ne yun irshad farmaya : Jab yeh aadmi qatl kare aur maal bhi le le . To is ko qatl kar diya jayega aur jab maal chheen le aur rasta ko prkhatar bana de to is ko suli di jayegi. Aur jab qatl kare aur is kaam ko dobara na loutaye to is ko qatl kar diya jayega . Aur jab maal chheen le aur yeh qatl na kare to is ke hath paon kaate jayenge. Aur jab fasad phelaye to is ko mulk se nikal diya jayega.
حَدَّثَنَا وَكِيعٌ ، عَنْ عِمْرَانَ بْنِ حُدَيْرٍ ، عَنْ أَبِي مِجْلَزٍ ، فِي هَذِهِ الْآيَةِ ﴿ إِنَّمَا جَزَاءُ الَّذِينَ يُحَارِبُونَ اللَّهَ وَرَسُولَهُ ﴾ [ المائدة : ٣٣ ] قَالَ : « إِذَا قَتَلَ وَأَخَذَ الْمَالَ قُتِلَ ، وَإِذَا أَخَذَ الْمَالَ وَأَخَافَ السَّبِيلَ صُلِبَ ، وَإِذَا قَتَلَ وَلَمْ يُعِدْ ذَلِكَ قُتِلَ ، وَإِذَا أَخَذَ الْمَالَ لَمْ يُعِدْ ذَلِكَ قُطِعَ وَإِذَا أَفْسَدَ نُفِيَ »
