كِتَابُ الْسير
On a slave captured by Muslims and then recaptured by the enemy
فِي الْعَبْدِ يَأْسِرُهُ الْمُسْلِمُونَ ثُمَّ يَظْهَرُ عَلَيْهِ الْعَدُوُّ

Hazrat Salman bin Rabee'ah (ra) stated regarding the thing which the enemy has taken away, he said that before the distribution of the spoils of war, its owner is more deserving of it. And if it is divided as spoils of war, then there is nothing for its owner.
حضرت سلمان بن ربیعہ (رض) اس چیز کے متعلق فرماتے ہیں جس کو دشمن اٹھا لے، فرمایا غنیمت کی تقسیم سے قبل اس کا مالک ہی زیادہ حقدار ہے، اور اگر غنیمت میں تقسیم ہوجائے تو پھر اس کے مالک کیلئے کچھ نہیں ہے۔
Hazrat Salman bin Rabia (RA) iss cheez ke mutalliq farmate hain jis ko dushman utha le, farmaya Ghanimat ki taqseem se pehle iss ka malik hi ziada haqdar hai, aur agar Ghanimat mein taqseem hojae to phir iss ke malik ke liye kuch nahi hai.
حَدَّثَنَا يَزِيدُ بْنُ هَارُونَ ، عَنْ حَجَّاجٍ ، عَنْ أَبِي إِسْحَاقَ ، عَنْ سَلْمَانَ بْنِ رَبِيعَةَ ، فِيمَا أَحْرَزَ الْعَدُوُّ قَالَ : « صَاحِبُهُ أَحَقُّ بِهِ مَا لَمْ يُقْسَمْ ، فَإِذَا قُسِمَ فَلَا شَيْءَ »
