Musnad Ahmad ibn Hanbal 4852
It is narrated on the authority of Sayyiduna Ibn Umar (may Allah be pleased with them both) that a man bought a date palm tree that had been grafted. The two of them had a dispute, and the matter was brought before the Prophet (peace and blessings of Allah be upon him). The Prophet (peace and blessings of Allah be upon him) ruled that the fruit belonged to the owner of the tree upon which the grafting had been done, unless the buyer had stipulated that he was buying the tree with its fruit.

سیدنا ابن عمر رضی اللہ عنہما سے مروی ہے کہ ایک آدمی نے کھجور کا پیوندکاری شدہ درخت خریدا، ان دونوں کا جھگڑا ہو گیا، نبی کریم ﷺ کی خدمت میں یہ جھگڑا پیش ہوا، تو نبی کریم ﷺ نے یہ فیصلہ کیا کہ پھل درخت کے مالک کا ہے جس نے اس کی پیوندکاری کی ہے الاّ یہ کہ مشتری (خریدنے والا) نے پھل سمیت درخت خریدنے کی شرط لگائی ہو۔
Sayyidna Ibn Umar ( (رضي الله تعالى عنه) a se marvi hai ki ek aadmi ne khajoor ka paywandkari shuda darakht khareeda, in donon ka jhagda ho gaya, Nabi Kareem (صلى الله عليه وآله وسلم) ki khidmat mein yeh jhagda pesh hua, to Nabi Kareem (صلى الله عليه وآله وسلم) ne yeh faisla kiya ki phal darakht ke malik ka hai jisne is ki paywandkari ki hai illa yeh ki mushteri (kharidne wala) ne phal samit darakht kharidne ki shart lagayi ho.
حَدَّثَنَا يَزِيدُ ، أَخْبَرَنَا حَمَّادُ بْنُ سَلَمَةَ ، عَنْ عِكْرِمَةَ بْنِ خَالِدٍ الْمَخْزُومِيِّ ، عَنِ ابْنِ عُمَرَ أَنَّ رَجُلًا اشْتَرَى نَخْلًا قَدْ أَبَّرَهَا صَاحِبُهَا، فَخَاصَمَهُ إِلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ،" فَقَضَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنَّ الثَّمَرَةَ لِصَاحِبِهَا الَّذِي أَبَّرَهَا، إِلَّا أَنْ يَشْتَرِطَ الْمُشْتَرِي".
