Chapter on selling charity before it reaches its recipients without necessity.
باب بيع الصدقة قبل وصولها إلى أهلها من غير حاجة.
Sunan al-Kubra Bayhaqi 7628
(7628) Imam Shafi'i (may Allah have mercy on him) said: An old man from the people of Makkah told me: I heard Thawban while I was standing over his head, and he was asked about selling something before its zakat becomes due. Thawban said: By the Lord of this House! It is not permissible to sell it before it is acquired, nor after it is acquired.
Imam Shafi'i (may Allah have mercy on him) said: This is because the Messenger of Allah (peace and blessings of Allah be upon him) said: “Take it from the rich and give it to the poor.” The needy and poor should be given the actual thing, not its price.
The old man said: The narrations that have been reported regarding the obligation of sadaqah (charity) are evidence for this matter.

(٧٦٢٨) امام شافعی (رح) فرماتے ہیں کہ مجھے اہل مکہ کے ایک شیخ نے کہا : میں نے طاؤس کو کہتے ہوئے سنا جب کہ میں اس کے سر پر کھڑا تھا اور وہ زکوۃ کے قبضے میں آنے سے پہلے فروخت کرنے کے بارے میں پوچھ رہا تھا تو طاؤس نے کہا : مجھے اس گھر کے رب کی قسم ! اس کا فروخت کرنا روا نہیں اس سے پہلے کہ اسے قبضے میں لیا جائے اور نہ ہی قبضے میں آنے کے بعد۔
امام شافعی (رح) فرماتے ہیں، یہ اس لیے کہ رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : اسے امیروں سے لے کر محتاجوں کو دے دیا جائے۔ حاجت مندوں اور فقراء کو اصل چیز دی جائے نہ کہ اس کی قیمت۔
شیخ فرماتے ہیں : وہ روایات جو صدقات کے فرض ہونے میں وارد ہوئیں اس مسئلے کی دلیل ہے۔
(7628) Imam Shafi (rah) farmate hain keh mujhe ahle Makkah ke aik sheikh ne kaha: mein ne taous ko kehte huye suna jab keh mein us ke sar par khara tha aur wo zakat ke qabze mein aane se pehle farokht karne ke bare mein pooch raha tha to taous ne kaha: mujhe iss ghar ke rabb ki qasam! Iss ka farokht karna rawa nahi iss se pehle keh usey qabze mein liya jaye aur na hi qabze mein aane ke baad.
Imam Shafi (rah) farmate hain, yeh iss liye keh Rasul Allah ((صلى الله عليه وآله وسلم)) ne farmaya: isey ameeron se lekar mohtajon ko de diya jaye. Hajatmandon aur fuqra ko asal cheez di jaye na keh iss ki qeemat.
Sheikh farmate hain: wo riwayat jo sadqat ke farz hone mein ward huin iss masle ki daleel hain.
Kulthum narrates from her father that he requested the Holy Prophet (peace and blessings of Allah be upon him) to buy from him the remaining portion of his wealth that was left after paying Zakat. The Prophet (peace and blessings of Allah be upon him) replied, "We cannot sell anything from Zakat unless it comes into our possession."

(٧٦٢٩) کلثوم اپنے والد سے نقل فرماتے ہیں کہ انھوں نے نبی کریم (صلی اللہ علیہ وآلہ وسلم) سے درخواست کی کہ آپ ان سے وہ بقیہ حصہ خرید لیں جو زکوۃ سے بچ رہا ہے تو آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : ہم زکوۃ میں سے کچھ بھی فروخت نہیں کرسکتے حتیٰ کہ ہمارے قبضے میں ہو۔
(7629) Kulsoom apne walid se naql farmate hain ke unhon ne Nabi Kareem ((صلى الله عليه وآله وسلم)) se darkhwast ki ke aap un se wo baqiya hissa khareed len jo zakat se bach raha hai to aap ((صلى الله عليه وآله وسلم)) ne farmaya: Hum zakat mein se kuchh bhi farokht nahin kar sakte hatta ke hamare qabze mein ho.
(7630) Narrated Muhammad bin Rashid Makhzoomi: The Messenger of Allah (ﷺ) said: Do not sell the Zakat of Sadaqat (charity) until it is assessed and taken into possession.

(٧٦٣٠) محمد بن راشد مکحول سے نقل فرماتے ہیں کہ رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : زکوۃ صدقات کو فروخت نہ کرو حتیٰ کہ اسے مقرر نہ کرایا جائے اور قبضے میں نہ آجائے۔
(7630) Muhammad bin Rashid Makhool se naqal farmate hain ke Rasul Allah ((صلى الله عليه وآله وسلم)) ne farmaya : Zakat sadqat ko farokht na karo hata ke use muqarar na kiya jaye aur qabze mein na aajaye.
