Chapter on one who sees dawn and has something in his mouth, he should spit it out and complete his fast, based on the evidence.
باب من طلع الفجر وفي فيه شيء لفظه وأتم صومه استدلالا بما
Sunan al-Kubra Bayhaqi 8018
(8018) Umar bin Khattab (may Allah be pleased with him) said: One day I went near my wife and kissed her and came to the Prophet (peace and blessings of Allah be upon him) and I was fasting. I said: I have committed a great sin today, that I kissed while fasting, so the Messenger of Allah (peace and blessings of Allah be upon him) said: What do you think if you rinse your mouth with water while fasting? He said: I said: There is no harm in it, so the Messenger of Allah (peace and blessings of Allah be upon him) said: Then what are you worried about?
Imam Shafi'i (may Allah have mercy on him) said that if a morsel is swallowed after Fajr, then one day's qada will be made up for it.

(٨٠١٨) عمر بن خطاب (رض) فرماتے ہیں : ایک دن میں بیوی کے قریب ہوا اور بوسہ دیا اور نبی کریم (صلی اللہ علیہ وآلہ وسلم) کے پاس آیا اور میں روزے سے تھا۔ میں نے کہا : میں نے آج بہت بڑا گناہ کیا ہے، کہ میں نے روزے کی حالت میں بوسہ دیا ہی تو رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : تیرا کیا خیال ہے اگر تو روزے کی حالت میں پانی سے کلی کرے ۔ وہ کہتے ہیں : میں نے کہا : اس کا کوئی حرج نہیں ہے تو رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : پھر کس بات سے پریشان ہے۔
امام شافعی (رح) فرماتے ہیں کہ اگر بعد فجر لقمہ نگلا ہے تو اس کے عوض ایک دن کی قضاکرے گا
(8018) Umar bin Khattab (RA) farmate hain : Aik din main biwi ke qareeb hua aur bosa diya aur Nabi Kareem (SAW) ke pass aaya aur main rozedar tha. Maine kaha : Maine aaj bahut bada gunah kiya hai, keh maine rozedar halat main bosa diya hai to Rasool Allah (SAW) ne farmaya : Tera kya khayal hai agar tu rozedar halat main pani se kuli kare. Woh kehte hain : Maine kaha : Iss ka koi haraj nahin hai to Rasool Allah (SAW) ne farmaya : Phir kis baat se pareshan hai.
Imam Shafi (RA) farmate hain keh agar baad fajr luqma nigla hai to iss ke awaz ek din ki qaza kare ga.
Abu Hurairah (may Allah be pleased with him) reported that the Messenger of Allah (peace and blessings be upon him) said: "When any one of you hears the Adhan while he has a utensil in his hand, he should not put it down until he has satisfied his need from it."

(٨٠١٩) ابوہریرہ (رض) فرماتے ہیں کہ نبی کریم (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : جب تم میں سے کوئی اذان سنے اور برتن اس کے ہاتھ میں ہو تو اسے اتنی دیر نہ رکھے جب تک اس سے اپنی ضرورت پوری نہ کرلے۔
(8019) Abu Hurairah (RA) farmate hain keh Nabi Kareem ((صلى الله عليه وآله وسلم)) ne farmaya : Jab tum mein se koi azan sune aur bartan uske hath mein ho to use itni dair na rakhe jab tak us se apni zaroorat puri na karle.
Abu Huraira (may Allah be pleased with him) narrated that when the dawn had risen, the Mu'adh-dhin (caller to prayer) would pronounce the Adhan (call to prayer) and the Messenger of Allah (peace and blessings of Allah be upon him) said: “When any of you hears the Adhan while the utensil is in his hand, let him finish his need.”

(٨٠٢٠) حضرت ابوہریرہ (رض) فرماتے ہیں کہ مؤذن اذان کہتے جب فجرروشن ہوجاتی اور رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : جب تم میں سے کوئی اذان سنے اور برتن اس کے ہاتھ میں ہو تو ضرورت پوری کرلے۔
(8020) Hazrat Abu Huraira (RA) farmate hain ke moazzin azaan kehte jab fajr roshan hojati aur Rasool Allah (SAW) ne farmaya: Jab tum mein se koi azaan sune aur bartan uske hath mein ho to zaroorat puri karle.
(8021) Narrated Abdullah bin Mas'ud (RA): The Prophet (ﷺ) said: "Do not let Bilal's call to the morning prayer prevent any of you from offering the prayer, for he calls (the Adhan) so as to awaken the sleeping person from his sleep and to make the one who has already got up (for Tahajjud prayer) return (to his bed and sleep). Jarir said: Meaning by that the breadth of the day and not its length because (the day) is not long (at that time).

(٨٠٢١) عبداللہ بن مسعود (رض) سے روایت ہے کہ آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : تم میں سے کسی کو بلال کی اذان سحری سے نہ روکے ، وہ تو تمہیں نیند سے بیدار کرنے کے لیے اذان کہتا ہے اور قیام کرنے والے کو لوٹاتا ہے۔
جریر فرماتے ہیں کہ انھوں نے لمبائی کی طرف اشارہ کرتے ہوئے فجر کی نشاندہی نہیں کی ، بلکہ چوڑائی کی طرف اشارہ کیا کیونکہ وہ لمبائی میں نہیں ہوتی۔
(8021) Abdullah bin Masood (RA) se riwayat hai ki aap ((صلى الله عليه وآله وسلم)) ne farmaya: Tum mein se kisi ko Bilal ki azan sehri se na roke, woh to tumhein neend se bedar karne ke liye azan kehta hai aur qayam karne wale ko lautata hai.
Jarir farmate hain ki unhon ne lambai ki taraf ishara karte huye fajar ki nishandai nahi ki, balki churaai ki taraf ishara kiya kyunki woh lambai mein nahi hoti.
Aisha (may Allah be pleased with her) narrated that the Messenger of Allah (peace and blessings of Allah be upon him) said: "Bilal calls the Adhan at night, so eat and drink until you hear the Adhan of Ibn Umm Maktum."

(٨٠٢٢) سیدہ عائشہ (رض) فرماتی ہیں کہ رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : بیشک بلال رات کو اذان کہتا ہے، سو تم کھاؤ پیو یہاں تک کہ ابن ام مکتوم کی اذان سن لو۔
(8022) Syeda Ayesha (RA) farmati hain keh Rasool Allah (SAW) ne farmaya: Beshak Bilal raat ko azan kehta hai, so tum khao piyo yahan tak keh Ibn Um Maktoom ki azan sun lo.
(8023) Shaiban (may Allah be pleased with him) narrates, “I entered the mosque and gave the call to prayer. Then I sat in a corner. The Messenger of Allah (peace and blessings of Allah be upon him) said, ‘O Abu Yahya!’ I said, ‘At your service.’ He said, ‘Come closer and eat.’ I said, ‘I intend to fast.’ He said, ‘I also intend to fast. However, our Mu'adh-dhin has something wrong with his eyesight, or something else is the matter, for he has given the call to prayer before the break of dawn.’
Ash'ath bin Sawar is alone in narrating this hadith. If it is sound, like the call to prayer by Ibn Maktoom (may Allah be pleased with him) before dawn, you (peace and blessings of Allah be upon him) did not forbid him from eating. It is for this reason that we have mentioned it. Not all reports agree.

(٨٠٢٣) شیبان (رض) فرماتے ہیں کہ میں مسجد میں داخل ہوا اور میں نے اذان کہی اور کونے میں بیٹھ گیا تو مجھے رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : ابو یحییٰ ! میں نے کہا : جی ہاں آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : قریب ہو اور کھالے ۔ میں نے کہا : میں روزہ رکھنا چاہتا ہوں۔ آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : میں بھی روزہ رکھنا چاہتا ہوں۔ لیکن ہمارے مؤذن کے آنکھ میں برائی ہے یا کچھ اور ہے کہ اس نے طلوع فجر سے پہلے اذان کہہ دی۔
اس حدیث میں اشعت بن سوار اکیلے ہیں۔ اگر یہ صحیح ہے جیسے ابن مکتوم (رض) کی اذان فجر سے پہلے ہوئی تو آپ (صلی اللہ علیہ وآلہ وسلم) نے کھانے سے منع نہیں کیا ، اسی وجہ سے ہم نے اس کا تذکرہ کیا ہے اور تمام اخبار موافق نہیں۔
(8023) Shaiban (RA) farmate hain ke main masjid mein dakhil hua aur maine azan kahi aur kone mein beth gaya to mujhe Rasool Allah ((صلى الله عليه وآله وسلم)) ne farmaya : Abu Yahya! maine kaha : ji haan aap ((صلى الله عليه وآله وسلم)) ne farmaya : qareeb ho aur khao. maine kaha : main roza rakhna chahta hun. aap ((صلى الله عليه وآله وسلم)) ne farmaya : main bhi roza rakhna chahta hun. lekin hamare muazzin ke aankh mein burai hai ya kuchh aur hai ke usne talua fajr se pehle azan keh di.
Is hadees mein Ash'as bin Sawar akele hain. agar ye sahi hai jaise Ibn Maktoom (RA) ki azan fajr se pehle hui to aap ((صلى الله عليه وآله وسلم)) ne khane se mana nahi kiya, isi wajah se humne iska tazkira kiya hai aur tamam akhbar muwafiq nahin.
