Chapter on juice pledged as collateral becoming wine, so it must be released from the pledge, and it is not permissible to transform wine through human action
باب العصير المرهون يصير خمرا فيخرج من الرهن ولا يحل تخليل الخمر بعمل آدمي
Sunan al-Kubra Bayhaqi 11197
Anas (may Allah be pleased with him) narrates that the Messenger of Allah (peace and blessings of Allah be upon him) was asked: Can alcohol be considered stolen property? He replied: No. In another narration it states: The Messenger of Allah (peace and blessings of Allah be upon him) was asked: Can alcohol be considered stolen property? He (peace and blessings of Allah be upon him) disliked it.

(١١١٩٧) حضرت انس (رض) فرماتے ہیں کہ رسول اللہ (صلی اللہ علیہ وآلہ وسلم) سے پوچھا گیا : کیا شراب کو سرقہ بنا سکتے ہیں ؟ آپنی فرمایا : نہیں ایک حدیث کے الفاظ یوں ہیں : رسول اللہ (صلی اللہ علیہ وآلہ وسلم) سے پوچھا گیا : کیا شراب کو سرقہ بنا سکتے ہیں ؟ تو آپ (صلی اللہ علیہ وآلہ وسلم) نے اسے ناپسند کیا۔
(11197) Hazrat Anas (RA) farmate hain ki Rasul Allah (SAW) se poocha gaya: kya sharaab ko surqa bana sakte hain? Aap ne farmaya: nahi. Ek hadees ke alfaz yun hain: Rasul Allah (SAW) se poocha gaya: kya sharaab ko surqa bana sakte hain? To aap (SAW) ne ise napasand kiya.
Anas (may Allah be pleased with him) narrated: A man came to the Messenger of Allah (peace and blessings of Allah be upon him). He had orphan children in his custody and he had wine, while alcohol had been prohibited at that time. He said: O Messenger of Allah! Shall I make the wine into vinegar? He said: No. So he poured it out until the valley flowed with it. Imam Wakee narrated from Sufyaan that he said regarding Abu Talha that he asked the Messenger of Allah (peace and blessings of Allah be upon him) about wine that belonged to orphans. So he said: Destroy it. He said: Shall I make it into vinegar? He (peace and blessings of Allah be upon him) said: No.

(١١١٩٨) حضرت انس (رض) فرماتے ہیں : ایک آدمی رسول اللہ (صلی اللہ علیہ وآلہ وسلم) کے پاس آیا۔ اس کی گود میں یتیم بچے تھے اور اس کے پاس شراب تھی جب کہ اس وقت شراب حرام کردی گئی تھی۔ اس نے کہا : اے اللہ کے رسول ! میں شراب کو سرقہ بنالوں ؟ آپ نے فرمایا : نہیں تو اس نے اسے انڈیل دیا حتیٰ کے وادی بہہ پڑی۔ امام وکیع نے سفیان سے روایت کیا ہے کہ انھوں نے ابو طلحہ کے بارے میں کہا کہ انھوں نے رسول اللہ (صلی اللہ علیہ وآلہ وسلم) سے یتیموں کو ملی ہوئی شراب کے بارے میں پوچھا تو آپ نے فرمایا : اسیبہا دو انھوں نے کہا : کیا میں اسے سرقہ بنا لوں ؟ آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : نہیں۔
(11198) Hazrat Anas (RA) farmate hain : Ek aadmi Rasul Allah ((صلى الله عليه وآله وسلم)) ke paas aaya. Uski god mein yateem bache thay aur uske paas sharaab thi jab keh us waqt sharaab haram kardi gayi thi. Usne kaha : Aye Allah ke Rasul ! Main sharaab ko surqa banalun ? Aap ne farmaya : Nahin to usne use undel diya hatta ke wadi beh padi. Imam Waqi ne Sufiyan se riwayat ki hai keh unhon ne Abu Talha ke bare mein kaha keh unhon ne Rasul Allah ((صلى الله عليه وآله وسلم)) se yateemon ko mili hui sharaab ke bare mein pucha to aap ne farmaya : Aseebaha do unhon ne kaha : Kya mein use surqa bana lun ? Aap ((صلى الله عليه وآله وسلم)) ne farmaya : Nahin.
Anas bin Malik (may Allah be pleased with him) narrated: My father was an orphan under the guardianship of (someone). My father bought some wine. When the prohibition of wine was revealed, he came to the Prophet (peace and blessings of Allah be upon him) and mentioned that to him and said: Should I steal it (and get rid of it)? He (the Prophet) said: No. So he poured it out. (By "father," he refers to Abu Talha, as he was married to Anas's mother).

(١١١٩٩) حضرت انس بن مالک (رض) فرماتی ہیں : میرے باپ کی پرورش میں یتیم تھے۔ میرے باپ نے شراب خریدی۔ جب شراب کی حرمت نازل ہوئی تو وہ آپ کے پاس آئے اور اس بات کا تذکرہ کیا اور کہا : کیا میں اسے سرقہ بنا لوں ؟ آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : نہیں تو انھوں نے اسے انڈیل دیا (باپ سے مراد ابو طلحہ ہیں کیونکہ وہ ان کی ماں کے خاوند تھے ) ۔
Hazrat Anas bin Malik (RA) farmati hain mere baap ki parvarish mein yateem thay mere baap ne sharab kharidi jab sharab ki hurmat nazil hui to woh aap ke pass aye aur is baat ka tazkara kiya aur kaha kya main ise surqa bana loon aap ((صلى الله عليه وآله وسلم)) ne farmaya nahi to unhon ne ise undel diya baap se murad abu talha hain kyunki woh un ki maan ke khawand thay
Jabir bin Abdullah (may Allah be pleased with him) narrated that a man had some property belonging to orphans. He used to buy old, worn-out things for them, repair them, and sell them. One day, he bought some wine and stored it in clay pots. Then, Allah revealed the prohibition of alcohol. He came to the Prophet (peace and blessings of Allah be upon him) and asked him about it. The Prophet (peace and blessings of Allah be upon him) said: "Spill the wine." He asked again, and the Prophet (peace and blessings of Allah be upon him) gave him the same reply. He said: "O Messenger of Allah! This is all the wealth they have." The Prophet (peace and blessings of Allah be upon him) said: "Pour it out." So, he poured it out.

(١١٢٠٠) حضرت جابر بن عبداللہ (رض) فرماتے ہیں : ایک آدمی کے پاس یتیموں کا مال تھا تو وہ ان کے لیے پرانی اور خراب چیزیں خریدتا اور ان کو درست کر کے بیچ دیتا تھا۔ ایک دن اس نے شراب خریدی اور مٹکوں میں ڈال لی۔ پھر اللہ نے شراب کی حرمت نازل کی۔ وہ بنی اللہ (صلی اللہ علیہ وآلہ وسلم) کے پاس آیا اور اس کے بارے میں پوچھا تو آپ نے اسے فرمایا : شراب بہا دو ، پھر انھوں نے پوچھا تو آپ (صلی اللہ علیہ وآلہ وسلم) نے پھر وہی جواب دیا، اس نے پھر کہا : اے اللہ کے رسول ! ان کا صرف یہی مال ہے۔ آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : انڈیل دو چنانچہ اس نے اسے انڈیل دیا۔
Hazrat Jabir bin Abdullah (RA) farmate hain : Ek aadmi ke pass yatimon ka maal tha to woh un ke liye purani aur kharab cheezen khareedta aur un ko durust kar ke bech deta tha. Ek din usne sharaab khareedi aur matkon mein daal li. Phir Allah ne sharaab ki hurmat nazil ki. Woh Bani Allah ((صلى الله عليه وآله وسلم)) ke pass aaya aur uske bare mein poocha to aap ne use farmaya : Sharaab baha do, phir unhon ne poocha to aap ((صلى الله عليه وآله وسلم)) ne phir wohi jawab diya, usne phir kaha : Aye Allah ke Rasool ! In ka sirf yahi maal hai. Aap ((صلى الله عليه وآله وسلم)) ne farmaya : Andel do chunancha usne use andel diya.
Narrated by Aslam, the freed slave of 'Umar bin Al-Khattab (may Allah be pleased with him) that: A container of wine was brought to 'Umar bin Al-Khattab (may Allah be pleased with him) at a place called Jabiyah, and it was cooked on that day. It was like a thick syrup of dates, etc. Then, 'Umar bin Al-Khattab (may Allah be pleased with him) said: "There is alcohol in it, which has been forbidden. Do not drink vinegar made from wine that has gone bad until Allah clarifies its corruption, then it will become pure and there will be no harm in buying and selling it." They found this (vinegar) with the People of the Book, and they did not know that they had intentionally turned it into vinegar after it had become wine.

(١١٢٠١) حضرت عمر بن خطاب (رض) کے آزادکردہ غلام حضرت اسلم سے روایت ہے کہ : حضرت عمر بن خطاب (رض) کے پاس جابیہنامی جگہ پر ایکطلائلایا گیا اور وہ اس دن کچھ پکایا گیا تھا ۔ گویا کہ وہ کچھ کھجور وغیرہ کا گاڑھا شیرہ ہے تو حضرت عمر بن خطاب (رض) نے کہا : اس میں شراب ہے، جس سے منع کیا گیا ہے۔ شراب کا سرکہ نہ پیا جائے جو خراب ہوچکا ہو۔ یہاں تک کہ اللہ اس کا فسادواضح کر دے ، پھر یہ پاک ہوجائے گی اور اس کی خریدو فروخت کرنے میں آدمی پر کوئی حرج نہیں ۔ انھوں نے اہل کتاب کے پاس اس (سرکہ ) کو پایا، جس کا انھیں علم نہ ہوا کہ انھوں نے جان بوجھ کر اس سے سرکہ بنایا جبکہ وہ شراب بن چکی تھی ۔
Hazrat Umar bin Khattab (RA) ke azad karda ghulam Hazrat Aslam se riwayat hai ki: Hazrat Umar bin Khattab (RA) ke pass Jabia nami jaga per ek talailaya gaya aur wo us din kuch pakaya gaya tha. Goya ki wo kuch khajoor waghaira ka garha sheera hai to Hazrat Umar bin Khattab (RA) ne kaha: Is mein sharaab hai, jis se mana kiya gaya hai. Sharaab ka sirka na piya jaye jo kharab ho chuka ho. Yahan tak ki Allah is ka fasad wazeh kar de, phir ye pak ho jayegi aur is ki khareed o farokht karne mein aadmi per koi harj nahin. Unhon ne ahl e kitab ke pass is (sirka) ko paya, jis ka unhein ilm na hua ki unhon ne jaan boojh kar is se sirka banaya jabki wo sharaab ban chuki thi.
