Sunan al-Kubra Bayhaqi 11758
Abdullah bin Habshi (may Allah be pleased with him) narrated that the Messenger of Allah (peace and blessings of Allah be upon him) said: “Whoever cuts down a berry tree, Allah will put his head in the Fire.”

(١١٧٥٨) حضرت عبداللہ بن حبشی (رض) فرماتی ہیں کہ رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : جس نے بیری کا درخت کاٹا اللہ اس کا سر آگ میں ڈالیں گے۔
Hazrat Abdullah bin Habshi (RA) farmate hain keh Rasool Allah (SAW) ne farmaya: Jis ne beri ka darakht kata Allah uska sar aag mein dalen ge.
Nasr b. 'Ali narrated it, according to the narration of Abu Dawud, except the chain of narration here is different: Ibn Jubair b. Mut'im narrated from 'Abdullah b. Hubshi from the Prophet (peace and blessings of Allah be upon him).

(١١٧٥٩) نصر بن علی نے ابو داؤد کی روایت کی طرح بیان کیا ہے، صرف یہاں سے سند مختلف ہے : عَنِ ابْنِ جُبَیْرِ بْنِ مُطْعِمٍ عَنْ عَبْدِ اللَّہِ بْنِ حُبْشِیٍّ عَنِ النَّبِیِّ (صلی اللہ علیہ وآلہ وسلم) ۔
Nasr bin Ali ne Abu Dawood ki riwayat ki tarah bayan kiya hai, sirf yahan se sanad mukhtalif hai : An Ibn Jubair bin Mut'im an Abdullah bin Hubshi an al-Nabi ((صلى الله عليه وآله وسلم)).
Narrated Jabir bin 'Abdullah (RA): Allah's Messenger (ﷺ) said, "Whoever cuts a lote-tree (Sidr tree), Allah will throw him in the Fire."

(١١٧٦٠) حضرت جابر بن عبداللہ (رض) سے منقول ہے کہ رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : جس نے بیری کا درخت کاٹا اللہ اس کا سر آگ میں ڈالیں گے۔
Hazrat Jabir bin Abdullah (RA) se manqol hai keh Rasul Allah (SAW) ne farmaya: Jis ne beri ka darakht kata Allah us ka sar aag mein dalen ge.
'Urwa bin Zubair narrated the first raised tradition: "Torment will be inflicted on him," or he said: "His head will be thrown into the Fire." The narrator, Thaqif, said: "The sons of 'Urwa informed me that 'Urwa had a Jujube tree cut down that was in the garden, and a door to the garden was made from it."

(١١٧٦١) عروہ بن زبیر بیری اولی حدیث مرفوع بیان کرتے ہیں : اس پر عذاب پیش کیا جائے گا یا فرمایا : اس کا سر آگ میں پھینکا جائے گا۔ راوی ثقیف کہتے ہیں : مجھے عروہ کے بیٹوں نے خبر دی کہ عروہ نے بیری کو کاٹا جو باغ میں تھی اس سے باغ کے لیے دروازہ بنایا گیا۔
Urwa bin Zubair bayri ula hadees marfoo bayan karte hain is par azab pesh kiya jaye ga ya farmaya is ka sar aag mein phenka jaye ga ravi saqif kehte hain mujhe Urwa ke beton ne khabar di ke Urwa ne bayri ko kata jo bagh mein thi is se bagh ke liye darwaza banaya gaya
'Urwah narrates that the Messenger of Allah (peace and blessings of Allah be upon him) said: "Those who cut down lote trees, Allah will throw them into the fire headfirst."'

(١١٧٦٢) عروہ فرماتے ہیں کہ رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : جو لوگ بیری کاٹتے ہیں اللہ ان کو سر کے بل آگ میں ڈالے گا۔
(11762) Urwa farmate hain ke Rasul Allah ((صلى الله عليه وآله وسلم)) ne farmaya: Jo log beri katte hain Allah un ko sar ke bal aag mein dale ga.
It was narrated from Aisha (may Allah be pleased with her) that the Messenger of Allah (peace and blessings of Allah be upon him) said: “Those who cheat when measuring will be thrown into the Fire headfirst.”

(١١٧٦٣) حضرت عائشہ (رض) سے منقول ہے کہ رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : جو لوگ بیری کاٹتے ہیں ان کو سروں کے بل آگ میں ڈالا جائے گا۔
(11763) Hazrat Ayesha (Raz) se manqol hai keh Rasool Allah ((صلى الله عليه وآله وسلم)) ne farmaya: Jo log beri kat te hain un ko saron ke bal aag mein dala jaye ga.
'Urwa bin Aws reported: I saw an old man from Banu Thaqif whose field was damaged by a lote tree. I said: Why don't you cut it? Allah's Messenger (ﷺ) forbade cutting it except in the case of harm to crops. He said: I heard Allah's Messenger (ﷺ) say, "He who cuts a lote tree except as harm to crops, Allah will inflict punishment on him." I dislike that I should cut it (even) for the harm (it does) to crops or otherwise.

(١١٧٦٤) عروہ بن اوس فرماتی ہیں : میں نے بنی ثقیف کے ایک بزرگ کو دیکھا کہ بیری کے درخت نے اس کے کھیتوں کو خراب کردیا تھا۔ میں نے کہا : تم اسے کاٹ کیوں نہیں دیتے۔ رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے کھیتی کے علاوہ کاٹنے سے منع کیا ہے۔ اس نے کہا : میں نے رسول اللہ (صلی اللہ علیہ وآلہ وسلم) سے سنا ہے کہ جس نے بیری کو کھیتی کے علاوہ کاٹا اس پر عذاب برسایا جائے گا ، میں ناپسند کرتا ہوں کہ اسے کھیتی سے کاٹوں یا اس کے علاوہ سے۔
Urwa bin Aus farmati hain : main ne Bani Saqeef ke aik buzurg ko dekha keh beri ke darakht ne us ke kheeton ko kharab kar diya tha. main ne kaha : tum ise kaat kyun nahin dete. Rasul Allah ((صلى الله عليه وآله وسلم)) ne kheti ke ilawa kaatne se mana kiya hai. us ne kaha : main ne Rasul Allah ((صلى الله عليه وآله وسلم)) se suna hai keh jis ne beri ko kheti ke ilawa kata us par azab barsaya jaye ga , main napasand karta hun keh ise kheti se katoon ya us ke ilawa se.
It is narrated on the authority of Ali (may Allah be pleased with him) that the Messenger of Allah (peace and blessings of Allah be upon him) said: Announce among the people, from Allah and not from the Messenger of Allah (peace and blessings of Allah be upon him), that Allah curses the one who cuts down a berry tree.

(١١٧٦٥) حضرت علی (رض) سے روایت ہے کہ رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : لوگوں میں اعلان کر دو اللہ کی طرف سے نہ کہ رسول اللہ (صلی اللہ علیہ وآلہ وسلم) کی طرف سے کہ اللہ بیری کے درخت کاٹنے والے پر لعنت کرے گا۔
(11765) Hazrat Ali (RA) se riwayat hai keh Rasool Allah (SAW) ne farmaya: Logon mein elaan kar do Allah ki taraf se nah keh Rasool Allah (SAW) ki taraf se keh Allah beri ke darakht kaatne wale par laanat kare ga.
Abu Ja'far narrated that the Messenger of Allah (peace and blessings be upon him and his family) said to Ali during his final illness: “O Ali! Go and announce from Allah, not from the Messenger, that Allah curses the one who cuts down the berry trees."

(١١٧٦٧) حضرت ابو جعفر سے منقول ہے کہ رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے اپنی وفات والی مرض میں علی سے کہا : اے علی ! جاؤ اللہ کی طرف سے اعلان کرو نہ کہ رسول کی طرف سے کہ اللہ لعنت کرے اس پر جو بیری کاٹے۔
Hazrat Abu Jaffar se manqol hai keh Rasul Allah ((صلى الله عليه وآله وسلم)) ne apni wafat wali marz mein Ali se kaha: Aye Ali! jao Allah ki taraf se elaan karo na keh Rasul ki taraf se keh Allah laanat kare uss par jo beri kaate.
Bahazz bin Hakeem narrated from his father, and he from his grandfather, that the Messenger of Allah (peace and blessings of Allah be upon him) said: “May Allah put the one who cuts down a Sidr tree into the Fire.”

(١١٧٦٨) بہز بن حکیم اپنے والد سے اور وہ دادا سے روایت کرتے ہیں کہ رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : بیری کاٹنے والے کا سر اللہ آگ میں ڈالے گا۔
Behza bin Hakeem apne walid se aur wo dada se riwayat karte hain ki Rasool Allah ((صلى الله عليه وآله وسلم)) ne farmaya : Beri katne wale ka sar Allah aag mein dale ga.
Bahaz bin Hakim narrated from his father, and he from his grandfather, that the Prophet (peace and blessings of Allah be upon him) said: "This is from Allah, not from the Messenger of Allah, that the curse of Allah be upon the one who uproots the berry tree."

(١١٧٦٩) بہز بن حکیم اپنے والد سے اور وہ دادا سے روایت کرتے ہیں کہ آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : یہ اللہ کی طرف سے ہے نہ کہ رسول (صلی اللہ علیہ وآلہ وسلم) کی طرف سے کہ اللہ کی لعنت ہے بیری اکھاڑنے والے پر۔
(11769) Behza bin Hakeem apne wald se aur wo dada se riwayat karte hain ke aap ((صلى الله عليه وآله وسلم)) ne farmaya: Ye Allah ki taraf se hai na ke Rasool ((صلى الله عليه وآله وسلم)) ki taraf se ke Allah ki laanat hai bayri ukharne wale par.
(70117) (a) Hassan bin Ibrahim said: I asked Hisham bin Urwah about cutting the berry tree while he was sitting with his back against the wall of Urwah’s house. He said: Look at these doors and frames. They are from Urwah's berry tree. Urwah cut it from his land and said: There is no harm in it. And he said: O Iraqi! You have brought this innovation. Hassan said: I said that innovation is from your side. I have heard from the people of Makkah that the Messenger of Allah (peace and blessings of Allah be upon him) cursed the one who cuts the berry tree. Abu Dawud said: Whoever cuts a berry tree from a place where travelers and animals take shade, he has oppressed and he will be responsible for it.
(b) Imam Ahmad (may Allah have mercy on him) said: Abu Thawr asked Imam Shafi'i (may Allah have mercy on him) about cutting the berry tree, so he said: There is no harm in it. It has been narrated from the Prophet (peace and blessings of Allah be upon him) that you should wash him with water and berry leaves.
(c) I said: The hadith in which there is an order to cut will be specific to the Thoon tree in Imam Abu Dawud's narration.
(d) Urwah bin Zubair used to cut it from his land. This was asked of Ismail bin Yahya al-Muzani, so he said: The Messenger of Allah (peace and blessings of Allah be upon him) was asked about this tree on which someone has placed a restriction, or it belongs to an orphan, or it is cut for something that Allah has forbidden. So it will be specific to that. The listener heard the answer and did not hear the question, and it is like the hadith narrated from Usamah bin Zaid that he said: There is usury in debt. This narrator also did not hear the question and heard the answer, and he (the Prophet) said: Do not sell gold for gold except for an equal amount.
(e) And Imam Shafi'i (may Allah have mercy on him) took the evidence that the Prophet (peace and blessings of Allah be upon him) allowed the deceased to be washed with berry leaves. If it were forbidden, then it would not be permissible to benefit from it. He said: The leaves of the berry tree are like branches, and the Messenger of Allah (peace and blessings of Allah be upon him) treated the prohibition of cutting the trees of the sanctuary equally, whether they are leaves or something else. When I did not see anyone stopping them from using the leaves, then this provides justification for cutting the berry tree.

(٧٠ ١١٧) (الف) حسان بن ابراہیم فرماتے ہیں : میں نے ہشام بن عروہ سے بیری کو کاٹنے کے بارے میں سوال کیا اور وہ عروہ کے مکان سے ٹیک لگا کر بیٹھے تھے۔ انھوں نے کہا : ان دروازوں اور چوکھٹوں کو دیکھتے ہو۔ وہ عروہ کی بیری کے ہیں۔ عروہ نے اپنی زمین سے کاٹا تھا اور کہا تھا : اس میں کوئی حرج نہیں ہے اور کہا : اے عراقی ! یہ بدعت تو لے کر آیا ہے، حسان کہتے ہیں : میں نے کہا کہ بدعت تو تمہاری طرف سے ہے، میں نے اہل مکہ سے سنا کہ رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے بیری کاٹنے والے پر لعنت کی ہے۔ ابو داؤد کہتے ہیں : جس نے بیری ایسی جگہ سے کاٹی جہاں سے مسافر اور جانور سایہ لیتے ہوں، اس نے ظلم کیا اور وہ اس کا ذمہ دار ہوگا۔
(ب) امام احمد (رح) فرماتے ہیں : ابو ثورنے امام شافعی (رح) سے بیری کاٹنے کے بارے میں سوال کیا تو انھوں نے فرمایا : اس میں کوئی حرج نہیں ہے۔ نبی (صلی اللہ علیہ وآلہ وسلم) سے روایت کیا گیا ہے کہ اس کو پانی کے ساتھ اور بیری کے ساتھغسل دو ۔
(ج) میں نے کہا : وہ حدیث جس میں کاٹنے کا حکم ہے وہ امام ابو داؤد کی تو جیح پر محمول ہوگی۔
(د) عروہ بن زبیر اپنی زمین سے اس کو کاٹ دیتے تھے۔ اسماعیل بن یحییٰ مزنی سے اس بارے میں سوال کیا گیا تو انھوں نے کہا : رسول اللہ (صلی اللہ علیہ وآلہ وسلم) سے اس درخت کے بارے میں سوال کیا گیا تھا جس پر کسی نے پابندی لگائی ہو یا کسی یتیم کا ہو یا اللہ کی حرام کردہ اشیاء کے لیے کاٹا جائے۔ پس اس پر ہی محمول ہوگا سننے والے نے جواب سن لیا اور سوال نہ سنا اور وہ اس حدیث کی طرح ہے جو اسامہ بن زید سے منقول ہے کہ آپ نے فرمایا : ادھار میں سود ہے۔ اس راوی نے بھی سوال نہ سنا اور جواب سن لیا اور آپ نے فرمایا : سونے کو سونے کے بدلے نہ بیچو مگر برابر برابر۔
(ر) اور امام شافعی (رح) نے دلیل پکڑی ہے کہ نبی (صلی اللہ علیہ وآلہ وسلم) نے میت کو بیری سے غسل دینے کی اجازت دی ہے۔ اگر حرام تھی تو اس سے فائدہ اٹھانا جائز نہ ہوتا۔ فرمایا : بیری کے پتے گویا کہ شاخیں ہیں اور رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے حرم کے درختوں کو کاٹنے کی حرمت کو برابر رکھاچا ہے صرف پتے ہوں یا کوئی اور چیز۔ جب میں نے کسی کو پتوں سے روکتے نہیں دیکھا تو یہ بیری کے کاٹنے پر جواز فراہم کرتا ہے۔
(70 117) (alif) Hasan bin Ibrahim farmate hain : mein ne Hisham bin Urwah se beri ko kaatne ke bare mein sawal kya aur wo Urwah ke makan se tek laga kar baithe the. Unhon ne kaha : in darwazon aur chaukhton ko dekhte ho. Wo Urwah ki beri ke hain. Urwah ne apni zameen se kata tha aur kaha tha : is mein koi harj nahin hai aur kaha : aye Iraqi ! yeh bidat to lekar aaya hai, Hasan kahte hain : mein ne kaha ki bidat to tumhari taraf se hai, mein ne ahle Makkah se suna ki Rasul Allah ((صلى الله عليه وآله وسلم)) ne beri kaatne wale par lanat ki hai. Abu Dawood kahte hain : jis ne beri aisi jagah se kati jahan se musafir aur janwar saya lete hon, us ne zulm kya aur wo is ka zimmedar hoga.
(be) Imam Ahmad (rah) farmate hain : Abu Thawr ne Imam Shafai (rah) se beri kaatne ke bare mein sawal kya to unhon ne farmaya : is mein koi harj nahin hai. Nabi ((صلى الله عليه وآله وسلم)) se riwayat kya gaya hai ki is ko pani ke sath aur beri ke sath ghusl do.
(jeem) mein ne kaha : wo hadees jis mein kaatne ka hukm hai wo Imam Abu Dawood ki to jeeh par mahmul hogi.
(daal) Urwah bin Zubair apni zameen se is ko kaat dete the. Ismail bin Yahya Mazni se is bare mein sawal kya gaya to unhon ne kaha : Rasul Allah ((صلى الله عليه وآله وسلم)) se is darakht ke bare mein sawal kya gaya tha jis par kisi ne paabandi lagai ho ya kisi yateem ka ho ya Allah ki haram karda ashiya ke liye kata jaye. Pas is par hi mahmul hoga sunne wale ne jawab sun liya aur sawal na suna aur wo is hadees ki tarah hai jo Osama bin Zaid se manqol hai ki aap ne farmaya : udhar mein sud hai. Is ravi ne bhi sawal na suna aur jawab sun liya aur aap ne farmaya : sone ko sone ke badle na becho magar barabar barabar.
(re) aur Imam Shafai (rah) ne daleel pakdi hai ki Nabi ((صلى الله عليه وآله وسلم)) ne mait ko beri se ghusl dene ki ijazat di hai. Agar haram thi to is se faidah uthana jaiz na hota. Farmaya : beri ke patte goya ki shakhen hain aur Rasul Allah ((صلى الله عليه وآله وسلم)) ne haram ke darakhton ko kaatne ki hurmat ko barabar rakhacha hai sirf patte hon ya koi aur cheez. Jab mein ne kisi ko patton se rokte nahin dekha to yeh beri ke kaatne par jawaz faraham karta hai.
