Chapter on the governors not being able to leave it with the people of wealth
باب لا يسع الولاة تركه لأهل الأموال
Sunan al-Kubra Bayhaqi 13115
Sayyiduna Abu Hurairah (may Allah be pleased with him) narrated that when the Prophet (peace and blessings of Allah be upon him) passed away and Abu Bakr (may Allah be pleased with him) was made Caliph, some of the Arabs refused to pay Zakat. Umar (may Allah be pleased with him) said: "O Abu Bakr! How will you fight these people, when the Prophet (peace and blessings of Allah be upon him) said: 'I have been ordered to fight the people until they say La ilaha illallah (there is no god but Allah), and whoever says La ilaha illallah, his wealth and his life are protected by me except by right, and his reckoning is with Allah'?" Abu Bakr (may Allah be pleased with him) said: "By Allah! I will definitely fight the one who differentiates between prayer and Zakat. Verily, Zakat is the right of the wealth. By Allah! If they withhold from me even a rope which they used to give during the time of the Prophet (peace and blessings of Allah be upon him), I will fight them for it." Umar (may Allah be pleased with him) said: "By Allah! I saw that Allah had opened the chest of Abu Bakr (may Allah be pleased with him) towards fighting, so I knew that it was the truth."

(١٣١١٥) سیدنا ابوہریرہ (رض) فرماتے ہیں کہ جب نبی (صلی اللہ علیہ وآلہ وسلم) فوت ہوگئے اور ابوبکر (رض) کو خلیفہ بنایا گیا تو عرب کے بعض لوگوں نے زکوۃ دینے سے انکار کردیا، عمر (رض) نے فرمایا : اے ابوبکر ! تو ان لوگوں سے کیسے لڑائی کرے گا، حالانکہ نبی (صلی اللہ علیہ وآلہ وسلم) نے فرمایا تھا : مجھے لوگوں سے لڑائی کا حکم دیا گیا ہے یہاں تک کہ وہ لا الٰہ الا اللہ پڑھ لیں، جس بندے نے لا الہ الا اللہ پڑھ لیا اس نے مجھ سے اپنا مال اور اپنی جان بچا لی مگر اس کا حق اور حساب اللہ تعالیٰ پر ہے۔ ابوبکر (رض) نے فرمایا کہ اللہ کی قسم ! میں اس بندے کے خلاف ضرور لڑائی کروں گا، جس نے نماز اور زکوۃ میں فرق کیا۔ بیشک زکوۃ مال کا حق ہے، اللہ کی قسم ! اگر وہ مجھ سے ایک رسی بھی روک لیں گے جو وہ آپ (صلی اللہ علیہ وآلہ وسلم) کے دور میں دیا کرتے تھے تو میں ان سے لڑائی کروں گا، عمر (رض) نے کہا کہ اللہ کی قسم ! میں نے دیکھا، ابوبکر (رض) کے سینے کو اللہ پاک نے لڑائی کے لیے کھول دیا ہے تو میں نے جان لیا کہ یہ حق ہے۔
(13115) سیدنا ابوہریرہ فرماتے ہیں کہ جب نبی فوت ہوگئے اور ابوبکر کو خلیفہ بنایا گیا تو عرب کے بعض لوگوں نے زکوۃ دینے سے انکار کردیا، عمر نے فرمایا : اے ابوبکر ! تو ان لوگوں سے کیسے لڑائی کرے گا، حالانکہ نبی نے فرمایا تھا : مجھے لوگوں سے لڑائی کا حکم دیا گیا ہے یہاں تک کہ وہ لا الٰہ الا اللہ پڑھ لیں، جس بندے نے لا الہ الا اللہ پڑھ لیا اس نے مجھ سے اپنا مال اور اپنی جان بچا لی مگر اس کا حق اور حساب اللہ تعالیٰ پر ہے۔ ابوبکر نے فرمایا کہ اللہ کی قسم ! میں اس بندے کے خلاف ضرور لڑائی کروں گا، جس نے نماز اور زکوۃ میں فرق کیا۔ بیشک زکوۃ مال کا حق ہے، اللہ کی قسم ! اگر وہ مجھ سے ایک رسی بھی روک لیں گے جو وہ آپ کے دور میں دیا کرتے تھے تو میں ان سے لڑائی کروں گا، عمر نے کہا کہ اللہ کی قسم ! میں نے دیکھا، ابوبکر کے سینے کو اللہ پاک نے لڑائی کے لیے کھول دیا ہے تو میں نے جان لیا کہ یہ حق ہے۔.
Imam Kasai (may Allah have mercy on him) said: "'Aqqal is a general term for charity." It is narrated from Asmai that so-and-so was sent to collect the 'aqqal of such-and-such tribe; this means that he was sent to collect their zakat.

(١٣١١٧) امام کسائی (رح) فرماتے ہیں : عقال عام صدقہ کو کہتے ہیں۔ اصمعی سے روایت ہے کہ فلاں کو فلاں قبیلے کی عقال لینے کے لیے بھیجا گیا یہ اس وقت ہے جب اسے زکوۃ لینے کے لیے بھیجا گیا۔
(13117) Imam Kasai (rah) farmate hain : Aqal aam sadqa ko kahte hain. Asmai se riwayat hai ki falan ko falan qabeele ki aqal lene ke liye bheja gaya yeh us waqt hai jab use zakat lene ke liye bheja gaya.
Hizam bin Hisham bin Habish Khuza'i heard his father say that he saw Sayyidina Umar bin Khattab (ra) tying his waist tightly with a rope and he used to tie the charity camels with it. Mansur says: I remember that he used to sell the extra camels, and when he sold a camel, he would tie it with his rope, then he would give that rope in charity.

(١٣١١٨) حزام بن ہشام بن حبیش خزاعی نے اپنے والد کو فرماتے ہوئے سنا کہ میں نے سیدنا عمر بن خطاب (رض) کو دیکھا، وہ اپنی کمر کو مضبوطی کے ساتھ رسی سے باندھ لیتے اور وہ ان سے صدقے کے اونٹوں کو باندھنے کی مشقت کرتے تھے، منصور کہتے ہیں : مجھے یاد ہے کہ وہ زائد اونٹوں کو بیچ دیتے تھے، جب اونٹ بیچتے تو اس کو اپنی رسی کے ساتھ باندھتے، پھر اس کو صدقہ کردیتے، یعنی اس رسی کو۔
Hazam bin Hisham bin Habish Khuzai ne apne wald ko farmate huye suna keh maine Sayyiduna Umar bin Khattab (RA) ko dekha, woh apni kamar ko mazbooti ke sath rassi se bandh lete aur woh un se sadqe ke oonton ko bandhne ki mushqat karte the, Mansoor kehte hain : mujhe yaad hai keh woh zaid oonton ko bech dete the, jab unt bechte to us ko apni rassi ke sath bandhte, phir us ko sadqa karte, yani is rassi ko.
Narrated Abu Huraira: The Prophet (ﷺ) said: I have been ordered to fight against people until they testify that there is none worthy of worship but Allah and that Muhammad is the Messenger of Allah, and until they establish prayer and pay Zakat. If they do so, they will have gained protection from me for their lives and property, unless they do something which incurs punishment according to Islam, and their reckoning will be with Allah.

(١٣١١٩) سیدنا ابوہریرہ (رض) سے روایت ہے کہ نبی (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : مجھے حکم دیا گیا ہے کہ میں لوگوں سے لڑائی کروں یہاں تک کہ وہ لا الٰہ الا اللہ کا اقرار کرلیں اور وہ نماز قائم کرنے لگ جائیں اور زکوۃ کی ادائیگی شروع کردیں، جب وہ یہ کام کرلیں گے تو ان کے خون اور مال مجھ پر حرام ہوگئے لیکن ان کا معاملہ اللہ تعالیٰ کے سپرد ہے۔
Saina Abu Huraira (RA) se riwayat hai keh Nabi ((صلى الله عليه وآله وسلم)) ne farmaya: mujhe hukm diya gaya hai keh main logon se larai karoon yahan tak keh woh la ilaha illallah ka iqrar kar lein aur woh namaz qaim karne lag jayen aur zakat ki adaegi shuru kar dein, jab woh yeh kaam kar lenge to unke khoon aur maal mujh par haram ho gaye lekin unka mamla Allah Ta'ala ke supurd hai.
Abu Huraira reported: The Messenger of Allah (ﷺ) said: I have been commanded to fight against people till they testify that there is none worthy of worship but Allah and that Muhammad is the Messenger of Allah, and they establish prayer and pay Zakat, so if they do it, they will save their lives and property from me, except for the right of Islam, and their reckoning will be with Allah.

(١٣١٢٠) سیدنا ابوہریرہ (رض) سے روایت ہے کہ نبی (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : مجھے حکم دیا گیا ہے کہ میں لوگوں سے قتال کروں یہاں تک کہ وہ کلمے کا اقرار کرلیں، اور نماز کی ادائیگی شروع کردیں اور زکوۃ دینے لگ جائیں۔ جب وہ یہ کام کرنے لگ جائیں گے تو انھوں نے مجھ سے اپنے مال اور اپنے خون کو بچا لیا مگر اس کا حق اور حساب اللہ کے سپرد ہے۔
Sydna Abu Hurairah (RA) se riwayat hai keh Nabi (SAW) ne farmaya: mujhe hukum diya gaya hai keh main logon se qatal karoon yahan tak keh woh kalme ka iqrar kar len, aur namaz ki अदाaygi shuru kar den aur zakat dene lag jayen. Jab woh ye kaam karne lag jayen ge to unhon ne mujh se apne mal aur apne khoon ko bacha liya magar iska haq aur hisab Allah ke supurd hai.
