Chapter on a woman saying in ownership 'I have divorced you' while intending divorce
باب المرأة تقول في التمليك طلقتك وهي تريد الطلاق

Qasim bin Muhammad said: A man from the tribe of Thaqif gave his wife the right to divorce herself. She said, "You are divorced." He remained silent. The woman said a second time, "You are divorced." He said, "May a stone be in your mouth!" The woman said a third time, "You are divorced." The man said, "May a stone be in your mouth!" Their dispute came to Marwan ibn al-Hakam. The husband said, "I had given her the right for one divorce and I swore an oath." So, Marwan returned the wife to her husband. Qasim liked this decision and thought that he had heard a good thing.

(١٥٠٤٩) قاسم بن محمد فرماتے ہیں کہ ثقیف کے ایک شخص نے اپنا اختیار بیوی کے سپرد کردیا تو اس نے کہہ دیا : تجھے طلاق۔ وہ خاموش رہا۔ دوسری مرتبہ عورت نے کہا : تجھے طلاق۔ اس نے کہا : تیرے منہ میں پتھر۔ تیسری مرتبہ عورت نے کہا : تجھے طلاق۔ مرد کہنے لگا : تیرے منہ میں پتھر۔ دونوں کا جھگڑا مروان بن حکم کے پاس آیا تو خاوند نے کہا : میں نے ایک کا اختیار دیا تھا اور قسم اٹھا دی تو مروان نے بیوی کو واپس کردیا۔ قاسم اس فیصلہ کو پسند کرتے تھے اور ان کا خیال تھا کہ اس نے اچھی چیز سنی ہے۔
Qasim bin Muhammad farmate hain ki Thaqif ke ek shakhs ne apna ikhtiyar biwi ke supurd kardiya to usne keh diya: Tujhe talaq. Woh khamosh raha. Dusri martaba aurat ne kaha: Tujhe talaq. Usne kaha: Tere munh mein pathar. Teesri martaba aurat ne kaha: Tujhe talaq. Mard kehne laga: Tere munh mein pathar. Dono ka jhagda Marwan bin Hakam ke paas aaya to khawan ne kaha: Maine ek ka ikhtiyar diya tha aur qasam utha di to Marwan ne biwi ko wapas kardiya. Qasim is faisla ko pasand karte thay aur unka khayal tha ki usne achhi cheez suni hai.
It is narrated from Abdullah bin Abbas (may Allah be pleased with him) that he was asked about a man who had given his right of divorce to his wife. The woman said: You have three divorces. Abdullah bin Abbas (may Allah be pleased with him) said: Allah declares your action wrong. Beware, you have given yourself three divorces.

(١٥٠٥٠) حضرت عبداللہ بن عباس (رض) سے منقول ہے کہ ان سے ایسے شخص کے بارے میں پوچھا گیا جس نے اپنا اختیار بیوی کے سپرد کردیا تھا تو عورت نے کہا : تجھے تین طلاقیں ہیں۔ حضرت عبداللہ بن عباس (رض) فرماتے ہیں : اللہ تیرے اس کام کو غلط قرار دیتے ہیں۔ خبردار تو نے اپنے آپ کو تین طلاقیں دے دیں ہیں۔
(15050) Hazrat Abdullah bin Abbas (RA) se manqol hai ki unse aise shakhs ke bare mein poocha gaya jis ne apna ikhtiyar biwi ke supurd kar diya tha to aurat ne kaha: Tujhe teen talaaqein hain. Hazrat Abdullah bin Abbas (RA) farmate hain: Allah tere is kaam ko ghalat qarar dete hain. Khabaradar tune apne aap ko teen talaaqein de din.
Saeed bin Jubair narrated from Abdullah bin Abbas (may Allah be pleased with him) that a woman said to her husband: "If the authority that is in your hand was in mine, then you would know who I am." So the man gave his authority to the woman. The woman said: "I have given you three divorces." When Ibn Abbas (may Allah be pleased with him) was asked about this, he said: "May Allah rectify your matter, because she has not divorced herself. Divorce is given to the woman, not by the woman."

(١٥٠٥١) سعید بن جبیر حضرت عبداللہ بن عباس (رض) سے نقل فرماتے ہیں کہ ایک عورت نے اپنے خاوند سے کہا : اگر وہ اختیار مجھے مل جائے جو تیرے ہاتھ میں ہے تو جان لے کہ میں کیا کوئی ہوں تو مرد نے اپنا اختیار عورت کے سپرد کردیا۔ عورت نے کہہ دیا : میں نے تجھے تین طلاقیں دے دیں۔ جب ابن عباس (رض) سے کہا گیا تو فرمانے لگے : اللہ تیرے کام کو غلط قرار دیتے ہیں۔ کیونکہ اس نے اپنے آپ کو طلاق نہ دی ہے۔ طلاق عورت کو دی جاتی ہے نہ کہ مرد کو۔
Saeed bin Jubair Hazrat Abdullah bin Abbas (RA) se naqal farmate hain keh aik aurat ne apne khaawand se kaha: agar woh ikhtiyar mujhe mil jaye jo tere hath mein hai to jaan le keh mein kya koi hun to mard ne apna ikhtiyar aurat ke supurd kar diya. Aurat ne keh diya: mein ne tujhe teen talaaqain de din. Jab Ibn Abbas (RA) se kaha gaya to farmane lage: Allah tere kaam ko ghalat qarar dete hain. Kyunke us ne apne aap ko talaaq nah di hai. Talaaq aurat ko di jati hai na keh mard ko.
(15052) Ikrimah narrated from Abdullah bin Abbas (may Allah be pleased with him) that a woman said to her husband: "If I had the authority to divorce that you have, then I would do something." So, the husband gave her the authority. She said, "I divorce you thrice." Ibn Abbas (may Allah be pleased with him) said that Allah considers her action wrong, why did she not divorce herself?
(b) Ibrahim said that Abdullah bin Abbas (may Allah be pleased with him) said: "Allah considers her action wrong, why did she not say that I divorce myself?" Ibrahim said: "Her statement is the same in both ways: 'I divorce you' and 'I divorce myself.'"
(25) Chapter: The man divorcing his wife in his heart and not uttering it with his tongue.
The husband divorces his wife in his heart without uttering it.

(١٥٠٥٢) عکرمہ حضرت عبداللہ بن عباس (رض) سے نقل فرماتے ہیں کہ ایک عورت نے اپنے خاوند سے کہا : اگر طلاق دینے کا اختیار مجھے ہو جو آپ کے اختیار میں ہے تو پھر کچھ کروں۔ تو خاوند نے یہ اختیار بیوی کو دے دیا۔ وہ کہنے لگی : تجھے تین طلاقیں تو ابن عباس (رض) فرماتے ہیں کہ اللہ تعالیٰ اس کے کام کو غلط قرار دیتے ہیں، اس نے اپنے آپ کو طلاق کیوں نہ دی۔
(ب) ابراہیم فرماتے ہیں کہ حضرت عبداللہ بن عباس (رض) نے فرمایا : اللہ اس کے کام کو غلط قرار دیتے ہیں، اس نے یہ کیوں نہ کہا کہ میں نے اپنے آپ کو طلاق دی ہے۔ ابراہیم کہتے ہیں : اس کا قول دونوں طرح برابر ہے : طَلَّقْتُکَ وَطَلَّقْتُ نَفْسِی۔
(٢٥) باب الرَّجُلِ یُطَلِّقُ امْرَأَتَہُ فِی نَفْسِہِ وَلَمْ یُحَرِّکْ بِہِ لِسَانَہُ
خاوند دل میں بیوی کو طلاق دے دے زبان سے بات نہ کرے
(15052) Akrma Hazrat Abdullah bin Abbas (RA) se naql farmate hain ki ek aurat ne apne khaavand se kaha: Agar talaq dene ka ikhtiyar mujhe ho jo aap ke ikhtiyar mein hai to phir kuch karoon. To khaavand ne ye ikhtiyar biwi ko de diya. Wo kehny lagi: Tujhe teen talaaqain. To Ibn Abbas (RA) farmate hain ki Allah Ta'ala uske kaam ko ghalat qarar dete hain, usne apne aap ko talaq kyon nah di.
(b) Ibrahim farmate hain ki Hazrat Abdullah bin Abbas (RA) ne farmaya: Allah uske kaam ko ghalat qarar dete hain, usne ye kyon nah kaha ki maine apne aap ko talaq di hai. Ibrahim kehte hain: Uska qaul dono tarah barabar hai: Tallaqtuka wa tallaqtu nafsi.
(25) Bab-ur-Rajul-e-Yutallig-o-Imraatahu fi Nafsihi wa Lam Yuharrik Bihi Lisana-hu
Khaavand dil mein biwi ko talaq de de zubaan se baat na kare.
