Sunan al-Kubra Bayhaqi 15094
Abdullah bin Abbas (may Allah be pleased with him) narrated that the Messenger of Allah (peace and blessings of Allah be upon him) said: Allah, the Lord of Glory, has forgiven my Ummah for their mistakes, forgetfulness, and what they are forced to do.

(١٥٠٩٤) حضرت عبداللہ بن عباس (رض) فرماتے ہیں کہ رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : اللہ رب العزت نے میری امت کو غلطی، بھول اور جس پر ان کو مجبور کیا جائے معاف کردیا ہے۔
(15094) Hazrat Abdullah bin Abbas (RA) farmate hain keh Rasul Allah (SAW) ne farmaya: Allah Rab ul Izzat ne meri ummat ko ghalti, bhool aur jis par un ko majboor kya jaye maaf kar diya hai.
Uqbah ibn Amir narrated that the Messenger of Allah (peace and blessings of Allah be upon him) said: Allah, the Lord of Glory, has forgiven my Ummah for their mistakes, forgetfulness, and what they are forced to do.

(١٥٠٩٦) عقبہ بن عامر فرماتے ہیں کہ رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : اللہ رب العزت نے میری امت کو غلطی، بھول اور جس پر ان کو مجبور کیا جائے معاف کردیا ہے۔
(15096) Aqba bin Aamir farmate hain ki Rasul Allah ((صلى الله عليه وآله وسلم)) ne farmaya: Allah Rab ul Izzat ne meri ummat ko ghalti, bhool aur jis par un ko majboor kia jaye maaf kar diya hai.
Aisha (may Allah be pleased with her) narrated that the Messenger of Allah (peace and blessings of Allah be upon him) said: "Divorce and emancipation are not valid under compulsion."

(١٥٠٩٧) حضرت عائشہ (رض) فرماتی ہیں کہ رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : طلاق اور آزادی زبردستی سے واقع نہیں ہوتی۔
(15097) Hazrat Ayesha (Raz) farmati hain keh Rasool Allah ((صلى الله عليه وآله وسلم)) ne farmaya: talaq aur azadi zabardasti se waqe nahi hoti.
(15098) Aisha (may Allah be pleased with her) narrated that the Messenger of Allah (peace and blessings of Allah be upon him) said: "Divorce and emancipation are not valid under compulsion."

(١٥٠٩٨) حضرت عائشہ (رض) فرماتی ہیں کہ رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : طلاق اور آزادی زبردستی سے واقع نہیں ہوتی۔
15098 Hazrat Aisha (rz) farmati hain keh Rasool Allah ((صلى الله عليه وآله وسلم)) ne farmaya: talaq aur azadi zabardasti se waqe nahi hoti.
Abdul Malik bin Qadama bin Ibrahim bin Muhammad bin Hatib Jami narrated from his father that a person was extracting honey near [his house] during the time of Umar (RA). His wife came and stood on the rope. She swore that she would cut the rope or he should divorce her three times. He pleaded with her in the name of Allah and Islam, but the woman refused [to get down] and demanded that he divorces her three times. When the man came down, he came to Umar (RA) and mentioned what had happened to him. Umar (RA) said: Go to your family, meaning your wife. This is not a divorce.

(١٥٠٩٩) عبدالملک بن قدامہ بن ابراہیم بن محمد بن حاطب جمعی اپنے والد سے نقل فرمات یہیں کہ ایک شخص حضرت عمر (رض) کے دور میں قریب ہی سے شہد اتار رہا تھا۔ اس کی عورت آکر رسی کے اوپر کھڑی ہوگئی۔ اس نے قسم اٹھا کر کہا کہ وہ رسی کو کاٹ دے گی یا مجھے تین طلاقیں دے تو اس نے اللہ اور اسلام کا واسطہ دیا، لیکن عورت نے انکار کردیا کہ اسے تین طلاقیں دے۔ جب شخص نیچے اتر آیا تو حضرت عمر (رض) کے پاس آکر تذکرہ کیا جو واقع اس کے ساتھ پیش آیا تھا، حضرت عمر (رض) فرماتے ہیں : اپنے گھر والی کے پاس جا یعنی بیوی کے۔ یہ طلاق نہیں ہے۔
Abdulmalik bin Qadama bin Ibrahim bin Muhammad bin Hatim jami apne walid se naql farmate hain kah ek shakhs Hazrat Umar (RA) ke dor mein qareeb hi se shahad utar raha tha. Uski aurat aakar rassi ke upar khari hogayi. Usne qasam utha kar kaha kah woh rassi ko kaat degi ya mujhe teen talaaqain de to usne Allah aur Islam ka wasta diya, lekin aurat ne inkar kardiya kah use teen talaaqain de. Jab shakhs neeche utar aaya to Hazrat Umar (RA) ke pass aakar tazkira kiya jo waqea uske sath pesh aaya tha, Hazrat Umar (RA) farmate hain : Apne ghar wali ke pass ja yani biwi ke. Yeh talaaq nahin hai.
(15100) Abd al-Malik ibn Qudamah al-Jumahi narrated from his father, who narrated from Umar (may Allah be pleased with him), that when the case came to Umar (may Allah be pleased with him), he separated the woman from her husband. Abu Ubayd said: There is also something different from Umar (may Allah be pleased with him) on this issue.
(b) Ali, Abdullah ibn Abbas, Abdullah ibn Umar, Abdullah ibn Zubayr (may Allah be pleased with them all), Ata', and Abdullah ibn Ubayd ibn Umair all said: This divorce is not permissible.

(١٥١٠٠) عبدالملک بن قدامہ جمحی اپنے والد سے نقل فرماتے ہیں جو حضرت عمر (رض) سے اس قصہ کو نقل فرماتے ہیں کہ جب معاملہ حضرت عمر (رض) کے پاس آیا تو حضرت عمر (رض) نے عورت کو اس شخص سے جدا کردیا۔ ابو عبید فرماتے ہیں کہ حضرت عمر (رض) سے اس کے الٹ بھی ہے۔
(ب) حضرت علی، عبداللہ بن عباس، عبداللہ بن عمر، عبداللہ بن زبیر (رض) عطاء، عبداللہ بن عبید بن عمیر سب کہتے ہیں : یہ طلاق جائز نہیں ہے۔
(15100) Abdulmalik bin Qadama Jamhi apne walid se naqal farmate hain jo Hazrat Umar (Raz) se is qissa ko naqal farmate hain ki jab mamla Hazrat Umar (Raz) ke paas aaya to Hazrat Umar (Raz) ne aurat ko is shakhs se juda kar diya. Abu Ubaid farmate hain ki Hazrat Umar (Raz) se is ke ulat bhi hai.
(b) Hazrat Ali, Abdullah bin Abbas, Abdullah bin Umar, Abdullah bin Zubair (Raz) Ata, Abdullah bin Ubaid bin Umair sab kahte hain : ye talaq jaiz nahi hai.
Yahya bin Abi Kathir narrates that Abdullah bin Abbas (may Allah be pleased with him) said: "Divorce given by a person under duress is not permissible."

(١٥١٠٢) یحییٰ بن ابی کثیر فرماتے ہیں کہ حضرت عبداللہ بن عباس (رض) نے فرمایا : مجبور شخص کا طلاق دینا جائز نہیں ہے۔
(15102) yahya bin abi kathir farmate hain keh hazrat abdullah bin abbas (raz) ne farmaya : majboor shakhs ka talaq dena jaiz nahi hai.
Ikrama was asked about a man who was forced by thieves to divorce his wife. He said: "This divorce is not valid."

(١٥١٠٣) حضرت عکرمہ فرماتے ہیں کہ ان سے ایسے شخص کے بارے میں سوال کیا گیا جسے چوروں نے مجبور کردیا تھا کہ وہ اپنی بیوی کو طلاق دے۔ فرماتے ہیں : یہ طلاق نہیں ہے۔
(15103) Hazrat Akrma farmate hain ki un se aise shakhs ke bare mein sawal kiya gaya jise choron ne majboor kar diya tha ki woh apni biwi ko talaq de. Farmate hain : Yeh talaq nahin hai.
Imam Malik narrated from Thabit Al-Ahnaf. Thabit said, “I married the slave-girl of Abdur-Rahman bin Zaid bin Khattab. Abdullah bin Abdur-Rahman called me. When I went to him, he had whips and an iron chain placed before him and two slaves were sitting with him. He said, 'Divorce her or else...' He swore that he would do such and such to me. I said, 'A thousand divorces.'
When I left him, I met Abdullah bin Umar (may Allah be pleased with him) on the way to Makkah. I told him my situation, so Abdullah (may Allah be pleased with him) got angry and said, ‘This is not a divorce. Your wife is not forbidden to you. Go back to your family.’
Thabit said, “My heart was not content until I went to Abdullah bin Zubair (may Allah be pleased with him). He was in Makkah that day. I told him about my situation and he said the same as Abdullah bin Umar (may Allah be pleased with him) had said. Then Abdullah bin Zubair said to me, ‘She is not forbidden to you. Go back to your wife.’ He then looked for Jabir bin Al-Aswad Az-Zahri who was the governor of Madinah to punish Abdullah bin Abdur-Rahman and not to let him come between me and my wife.
When I came (back), Safiyyah bint Abi Ubaid, i.e., the wife of Ibn Umar (may Allah be pleased with him), prepared my wife and let her enter upon me with Ibn Umar’s knowledge. Later I invited Abdullah bin Umar (may Allah be pleased with him) to the Waleemah (wedding feast) of my slave-girl.”

(١٥١٠٥) امام مالک ثابت احنف سے نقل فرماتے ہیں اس نے عبدالرحمن بن زید بن خطاب کی ام ولد سے شادی کرلی۔ کہتے ہیں کہ عبداللہ بن عبدالرحمن نے مجھے بلایا جب میں ان کے پاس آیا تو ان کے سامنے کوڑے رکھے ہوئے تھے اور لوہے کی زنجیر تھی اور دو غلام اس نے بٹھا رکھے تھے۔ کہنے لگے : اس کو طلاق دو وگرنہ۔۔۔ اس نے قسم اٹھا کے کہا : میں تیرے ساتھ یہ یہ کروں گا، کہتے ہیں : میں نے کہا : ہزار طلاقیں۔ میں اس کے پاس سے نکلا تو میں نے حضرت عبداللہ بن عمر کو مکہ کے راستے میں پایا۔ میں نے ان کو اپنی حالت بتائی تو حضرت عبداللہ (رض) غصے ہوئے اور فرمانے لگے : یہ کوئی طلاق نہیں ہے، تیری بیوی تیرے لیے حرام نہیں ہوئی تو اپنے اہل کے پاس جا۔ کہتے ہیں : میرا دلی اطمینان نہ ہوا یہاں تک کہ میں عبداللہ بن زبیر (رض) کے پاس آیا، وہ اس دن مکہ میں تھے۔ میں نے ان کو اپنی حالت بتائی تو انھوں نے بھی عبداللہ بن عمر (رض) کی طرح کہا تو عبداللہ بن زبیر نے مجھے فرمایا : وہ تیرے اوپر حرام نہیں تو اپنی بیوی کے پاس جا اور جابر بن اسود زہری کو دیکھا جو مدینہ کے امیر تھے کہ وہ عبداللہ بن عبدالرحمن کو سزا دے اور یہ کہ وہ میرے اور میری گھر والی کے درمیان رکاوٹ نہ بنے۔ میں آیا تو صفیہ بنت ابی عبید یعنی ابن عمر (رض) کی بیوی نے میری عورت کو تیار کیا اور ابن عمر (رض) کے جانتے ہوئے اس کو میرے اوپر داخل کردیا۔ پھر میں نے اپنے ولیمے کی دعوت میں حضرت عبداللہ بن عمر (رض) کو بھی بلایا۔
15105 Imam Malik Sabit Ahnaf se naql farmate hain usne Abdul Rahman bin Zaid bin Khattab ki umme walad se shadi karli. Kehte hain ke Abdullah bin Abdul Rahman ne mujhe bulaya jab main unke pass aaya to unke samne kore rakhe hue the aur lohe ki zanjeer thi aur do gulam usne bitha rakhe the. Kehne lage isko talaq do warna... Usne qasam utha ke kaha main tere sath ye ye karoonga. Kehte hain maine kaha hazar talaqain. Main uske pass se nikla to maine Hazrat Abdullah bin Umar ko Makkah ke raste mein paya. Maine unko apni halat batai to Hazrat Abdullah (RaziAllahu Anhu) ghusse hue aur farmane lage ye koi talaq nahi hai teri biwi tere liye haram nahi hui to apne ahl ke pass ja. Kehte hain mera dili itminan na hua yahan tak ke main Abdullah bin Zubair (RaziAllahu Anhu) ke pass aaya woh us din Makkah mein the. Maine unko apni halat batai to unhon ne bhi Abdullah bin Umar (RaziAllahu Anhu) ki tarah kaha to Abdullah bin Zubair ne mujhe farmaya woh tere upar haram nahi to apni biwi ke pass ja aur Jabir bin Aswad Zuhri ko dekha jo Madinah ke ameer the ke woh Abdullah bin Abdul Rahman ko saza de aur ye ke woh mere aur meri ghar wali ke darmiyan rukawat na bane. Main aaya to Safiya bint Abi Ubaid yani Ibn Umar (RaziAllahu Anhu) ki biwi ne meri aurat ko taiyar kiya aur Ibn Umar (RaziAllahu Anhu) ke jante hue usko mere upar dakhil kar diya. Phir maine apne walime ki dawat mein Hazrat Abdullah bin Umar (RaziAllahu Anhu) ko bhi bulaya.
Sabit Al-A'raj said: I married the Umm Walad (former slave concubine) of Abdur-Rahman bin Zaid bin Khattab, so her son called me and summoned his two slaves. They tied me up, beat me with whips, and said: "Divorce her, or we will surely do this." He (Sabit) said: "So I divorced her, then I asked Ibn Umar and Ibn Zubair (may Allah be pleased with them), and they did not consider it a divorce."

(١٥١٠٦) ثابت اعرج کہتے ہیں : میں نے عبدالرحمن بن زید بن خطاب کی ام ولد سے شادی کی تو اس کے بیٹے نے مجھے بلا لیا اور اپنے دو غلام بھی بلا لیے۔ انھوں نے مجھے باندھ کر کوڑوں سے میری پٹائی کی اور انھوں نے کہا : اس کو طلاق دے یا ہم اس طرح ضرور کریں گے۔ کہتے ہیں : میں نے طلاق دے دی، پھر میں نے ابن عمر، ابن زبیر (رض) سے سوال کیا تو انھوں نے اس کو طلاق شمار نہیں کیا۔
Sabit Arj kehte hain : mein ne Abdurrahman bin Zaid bin Khattab ki umme walad se shadi ki to uske bete ne mujhe bula liya aur apne do ghulam bhi bula liye. Unhon ne mujhe bandh kar kordon se meri pitai ki aur unhon ne kaha : isko talaq de ya hum is tarah zaroor karenge. Kehte hain : mein ne talaq de di, phir mein ne Ibn Umar, Ibn Zubair (rz) se sawal kiya to unhon ne isko talaq shumar nahin kiya.
