Sunan al-Kubra Bayhaqi 15671
Aqaba bin Harith narrated that a black woman came and she presumed that she had breastfed both of them, meaning Aqaba and his wife. He said: She came to the Prophet (ﷺ) and mentioned this matter to him, and he turned away. She came again, and the Prophet (ﷺ) smiled and said: "And how can it be, when it has already been said?" This has been narrated in Sahih al-Bukhari, by Muhammad bin Kathir.

(١٥٦٧١) عقبہ بن حارث سے روایت ہے کہ ایک سیاہ عورت آئی، اس نے گمان کیا کہ اس نے ان دونوں کو دودھ پلایا ہے، یعنی عقبہ اور اس کی بیوی کو۔ فرماتے ہیں : وہ نبی (صلی اللہ علیہ وآلہ وسلم) کے پاس آیا، اس نے یہ معاملہ آپ (صلی اللہ علیہ وآلہ وسلم) سے ذکر کیا۔ اور اعراض کیا اور نبی (صلی اللہ علیہ وآلہ وسلم) مسکرائے اور کہا : اور کیسے جب کہ کہا جاچکا۔
اس کو بخاری نے محمد بن کثیر سے اپنی صحیح میں روایت کیا ہے۔
Aqba bin Haris se riwayat hai ki aik siyah aurat aai usne gumaan kiya ki usne in donon ko doodh pilaya hai yani Aqba aur uski biwi ko farmate hain woh Nabi ((صلى الله عليه وآله وسلم)) ke paas aaya usne yeh mamla aap ((صلى الله عليه وآله وسلم)) se zikr kiya aur airaz kiya aur Nabi ((صلى الله عليه وآله وسلم)) muskurae aur kaha aur kaise jab keh kaha jachuka
is ko Bukhari ne Muhammad bin Kasir se apni Sahih mein riwayat kiya hai
Ubayd ibn Abi Maryam narrated to us from `Aqaba ibn Harith that he heard it from `Aqaba, but I have a better memory of the narration of Ubayd. I married a woman. A black woman came to us and said, "I breastfed both of you." So, I went to the Prophet (ﷺ) and said, "I married the daughter of so-and-so. A black woman came to us and said, 'I breastfed both of you,' and she is lying." I argued with him, coming to him from the side of his face. I said, "She is lying!" The Messenger of Allah (ﷺ) said, "How can it be otherwise when she thinks that she breastfed both of you? So, divorce that wife."
This hadith was also narrated by Al-Bukhari in his Sahih from `Ali ibn `Abdullah and Isma`il.

(١٥٦٧٢) عبید بن ابی مریم عقبہ بن حارث سے نقل فرماتے ہیں کہ میں نے اس کو عقبہ سے سنا لیکن میں عبید کی حدیث کو زیادہ یاد کرنے والا ہوں ۔ میں نے عورت سے شادی کی۔ ہمارے پاس ایک سیاہ عورت آئی۔ اس نے کہا : میں نے تم دونوں کو دودھ پلایا ہے۔ میں نبی (صلی اللہ علیہ وآلہ وسلم) کے پاس آیا۔ میں نے کہا : میں نے فلاں کی بیٹی فلاں سے شادی کی۔ ہمارے پاس ایک سیاہ عورت آئی۔ اس نے کہا : میں نے تم دونوں کو دودھ پلایا ہے اور وہ جھوٹی ہے۔ اس نے مجھ سے مباحثہ کیا۔ میں اس کے پاس اس کے چہرے کی طرف سے آیا۔ میں نے کہا : وہ جھوٹی ہے۔ رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : یہ کیسے ہوسکتا ہے حالانکہ اس کا خیال ہے کہ اس نے تم دونوں کو دودھ پلایا ہے۔ تو اس بیوی کو چھوڑ دے۔
اس کو بخاری نے اپنے صحیح میں علی بن عبداللہ اور اسماعیل سے روایت کیا ہے۔
15672 Ubaid bin Abi Maryam Aqba bin Haris se naqal farmate hain ki maine is ko Aqba se suna lekin main Ubaid ki hadees ko ziada yaad karne wala hun. Maine aurat se shadi ki. Humare pass ek siyah aurat aai. Usne kaha: maine tum donon ko doodh pilaya hai. Main Nabi ((صلى الله عليه وآله وسلم)) ke pass aaya. Maine kaha: maine falan ki beti falan se shadi ki. Humare pass ek siyah aurat aai. Usne kaha: maine tum donon ko doodh pilaya hai aur wo jhooti hai. Usne mujhse mubahesa kiya. Main uske pass uske chehre ki taraf se aaya. Maine kaha: wo jhooti hai. Rasulullah ((صلى الله عليه وآله وسلم)) ne farmaya: ye kaise hosakta hai halanki uska khayal hai ki usne tum donon ko doodh pilaya hai. To us biwi ko chhod de. Is ko Bukhari ne apne Sahih mein Ali bin Abdullah aur Ismail se riwayat kiya hai.
Ibn Abi Malikah narrated to me that 'Uqbah bin Harith narrated to me a hadith, or I heard it from him, that he married Umm Yahya bint Abi Ihab. A black slave girl came and said: 'I breastfed both of you.' He mentioned that to the Messenger of Allah (ﷺ). He turned away from him. I came from the other side and mentioned it to him (ﷺ). He (ﷺ) said: 'How can it be now when she thinks that she breastfed both of you?' He forbade him from (marrying) her.
The wording of Yahya bin Said's hadith is also narrated by Al-Bukhari in his Sahih from Abu 'Asim and 'Ali bin 'Abdullah, from Yahya, with a similar narration.

(١٥٦٧٣) ابن ابی ملیکہ سے روایت ہے کہ مجھے عقبہ بن حارث نے حدیث بیان کی یا میں نے اس سے سنا کہ اس نے ام یحییٰ بنت ابی اہاب سے شادی کی۔ ایک سیاہ لونڈی آئی۔ اس نے کہا : میں نے تم دونوں کو دودھ پلایا ہے۔ میں نے یہ رسول اللہ (صلی اللہ علیہ وآلہ وسلم) سے ذکر کیا۔ آپ نے مجھ سے اعراض کیا۔ میں دوسری طرف سے آیا تو میں نے اس کو ذکر کیا ۔ آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : اب کیسے ہوسکتا ہے جبکہ وہ گمان کرتی ہے کہ اس نے تم دونوں کو دودھ پلایا ہے۔ آپ نے اس کو اس سے روک دیا۔
یحییٰ بن سعید کی حدیث کے الفاظ کو بخاری نے ابو عاصم اور علی بن عبداللہ سے یحییٰ سے اسی طرح صحیح میں مدرج روایت کیا ہے۔
(15673) Ibn Abi Malika se riwayat hai ki mujhe Uqba bin Harith ne hadees bayaan ki ya maine us se suna ki usne Umm Yahya bint Abi Ihab se shadi ki. Ek siyah laundi aai. Usne kaha: maine tum donon ko doodh pilaya hai. Maine ye Rasool Allah ((صلى الله عليه وآله وسلم)) se zikar kiya. Aap ne mujhse iraz kiya. Main dusri taraf se aaya to maine usko zikar kiya. Aap ((صلى الله عليه وآله وسلم)) ne farmaya: ab kaise hosakta hai jabke wo guman karti hai ki usne tum donon ko doodh pilaya hai. Aap ne usko us se rok diya.
Yahya bin Saeed ki hadees ke alfaz ko Bukhari ne Abu Aasim aur Ali bin Abdallah se Yahya se isi tarah sahih mein mudaraj riwayat ki hai.
Ibn Juraij narrated to me that Ibn Abi Mulaikah informed me that 'Uqbah ibn Harith informed him that he married Umm Yahya bint Abi Ihab. A dark-complexioned young woman came and said: "I breastfed both of you." He said: "I went to the Prophet (peace and blessings of Allah be upon him) and mentioned this to him. You turned away. I came from the other side and mentioned it to you. You said: 'How can that be when he thinks that she breastfed both of you?'" Imam Shafi'i said: "Your turning away (peace and blessings of Allah be upon him) is appropriate because you did not consider her testimony to be something that would make it obligatory upon him, and your saying 'How can he think that she breastfed both of you?' is similar to you disliking him staying with her after being told that she is his milk-sister. And the meaning of what we have said - that he should leave her out of piety - is not an obligation according to the ruling."

(١٥٦٧٤) ابن جریج سے روایت ہے کہ مجھے ابن ابی ملیکہ نے خبر دی کہ عقبہ بن حارث نے اس کو خبر دی کہ اس نے ام یحییٰ بنت ابو اہاب سے نکاح کیا۔ ایک سیاہ لونڈی آئی۔ اس نے کہا : میں نے تم دونوں کو دودھ پلایا ہے۔ کہتے ہیں : میں نبی (صلی اللہ علیہ وآلہ وسلم) کے پاس آیا۔ میں نے آپ سے یہ ذکر کیا۔ آپ نے اعراض کیا۔ میں دوسری طرف سے آیا اور میں نے آپ سے اس کا ذکر کیا۔ آپ نے اس کو کہا : یہ کیسے ممکن ہے جبکہ اس کا گمان ہے کہ اس نے تم دونوں کو دودھ پلایا ہے ؟
امام شافعی فرماتے ہیں : آپ (صلی اللہ علیہ وآلہ وسلم) کا اعراض کرنا اس بات کے مناسب ہے کہ آپ ای کی گواہی کو ایسا نہیں سمجھتے تھے جو اس کو لازم ہو اور آپ کا یہ قول ” کیسے وہ گمان کرتی ہے کہ اس نے تم دونوں کو دودھ پلایا ہے۔ “ یہ مشابہ ہے کہ آپ اس کے ساتھ اس کے قیام کو ناپسند کر رہے تھے اور اس کو کہا گیا کہ وہ تیری رضاعی بہن ہے اور اس کا معنی جو ہم نے کہا کہ وہ اس کو چھوڑ دے ورعاً ہے یعنی تقویٰ یہ ہے حکماً نہیں ہے۔
(15674) Ibn Juraij se riwayat hai ki mujhe Ibn Abi Malika ne khabar di ki Aqba bin Haris ne usko khabar di ki usne Umme Yahya bint Abu Ahab se nikah kiya ek siyah laundi aai usne kaha mainne tum donon ko doodh pilaya hai kehte hain main Nabi ((صلى الله عليه وآله وسلم)) ke paas aaya mainne aapse ye zikar kiya aapne airaz kiya main dusri taraf se aaya aur maine aapse iska zikar kiya aapne isko kaha ye kaise mumkin hai jabke uska guman hai ki usne tum donon ko doodh pilaya hai?
Imam Shafi farmate hain aap ((صلى الله عليه وآله وسلم)) ka airaz karna is baat ke munasib hai ki aap iski gawahi ko aisa nahin samajhte the jo isko lazim ho aur aapka ye qaul kaise wo guman karti hai ki usne tum donon ko doodh pilaya hai ye mushabih hai ki aap uske saath uske qayam ko napasand kar rahe the aur usko kaha gaya ki wo teri rizayi bahan hai aur iska mani jo humne kaha ki wo usko chhod de waran yeh hai taqwa yeh hai hukman nahin hai.
Zayd bin Aslam narrated that a man and his wife came to 'Umar bin Khattab (may Allah be pleased with him), and a woman came and said, "I breastfed both of them."' Umar (may Allah be pleased with him) refused to accept her statement and said, "Your (alleged) foster-daughter is lawful for you (to marry)." This is a mursal narration and has been narrated through another chain of narration as well.

(١٥٦٧٥) زید بن اسلم سے روایت ہے کہ ایک آدمی اور اس کی بیوی دونوں عمر بن خطاب (رض) کے پاس آئے اور ایک عورت آئی، اس نے کہا : میں نے تم دونوں کو دودھ پلایا ہے۔ عمر بن خطاب (رض) نے اس کے قول کو لینے سے انکار کیا اور فرمایا : تیری عورت تیرے لیے ہے۔
یہ مرسل ہے اور دوسری سند سے روایت کی گئی ہے۔
Zayd bin Aslam se riwayat hai ki ek aadmi aur uski biwi dono Umar bin Khattab (RA) ke pass aaye aur ek aurat aayi, usne kaha : main ne tum donon ko doodh pilaya hai. Umar bin Khattab (RA) ne uske qaul ko lene se inkar kiya aur farmaya : teri aurat tere liye hai.
Ye mursal hai aur dusri sanad se riwayat ki gayi hai.
A woman was brought to 'Umar bin Khattab (may Allah be pleased with him). She bore witness against a man and his wife that she breastfed both of them. He ('Umar) said: "No, not until two men or one man and two women testify." We were informed by Abu Sa'eed bin Abi 'Amr that he was informed by Rabi' who said: We were informed by Shafi'i, that Muslim informed us from Ibn Juraij, that he narrates from 'Ata that the testimony of less than (the required number of) women is not permissible.

(١٥٦٧٦) عکرمہ بن خالد مخزومی سے روایت ہے کہ عمر بن خطاب (رض) کے پاس عورت لائی گئی۔ اس نے ایک شخص اور اس کی بیوی کے خلاف گواہی دی کہ اس نے ان دونوں کو دودھ پلایا ہے۔ آپ نے فرمایا : نہیں یہاں تک کہ دو آدمی یا ایک آدمی اور دو عورتیں گواہی دیں۔ ہم کو ابو سعید بن ابی عمرو نے خبر دی کہ ہم کو ربیع نے خبر دی وہ کہتے ہیں : ہمیں شافعی نے خبردی، ہمیں مسلم نے ابن جریج سے خبر دی وہ عطاء سے بیان کرتے ہیں کہ عورتوں سے کم کی گواہی جائز نہیں ہے۔
Ukarma bin Khalid Makhzoomi se riwayat hai ke Umar bin Khattab (rz) ke pass aurat laayi gayi. Usne ek shakhs aur uski biwi ke khilaf gawahi di ke usne in donon ko doodh pilaya hai. Aap ne farmaya: Nahin yahan tak ke do aadmi ya ek aadmi aur do aurtain gawahi dain. Hum ko Abu Saeed bin Abi Amr ne khabar di ke hum ko Rabia ne khabar di woh kahte hain: Humein Shafai ne khabar di, humein Muslim ne Ibn Juraij se khabar di woh Ata se bayan karte hain ke aurton se kam ki gawahi jaiz nahin hai.
Abu 'Ubayd said that the Prophet (peace and blessings of Allah be upon him) was asked: Whose testimony is permissible regarding breastfeeding? He said: The testimony of one man or one woman. These are weak chains of narration. Similar narrations are not considered evidence. Muhammad ibn 'Uthman has been accused of lying and Ibn Baylaman is weak and there is disagreement in the text regarding him. Similarly, it has been said that one man and one woman, and it has been said: one man and two women. And Allah knows best.

(١٥٦٧٧) ابو عبید فرماتے ہیں کہ نبی (صلی اللہ علیہ وآلہ وسلم) سے پوچھا گیا : رضاعت کے بارے میں کن کی گواہی جائز ہے فرمایا : ایک آدمی یا ایک عورت کی گواہی۔ یہ ضعیف اسناد ہیں اس کی طرح کی اسناد کو حجت نہیں بنایا جاسکتا۔ محمد بن عثیم کو جھوٹ کی تہمت لگائی گئی ہے اور ابن بیلمانی ضعیف ہے اور اس پر متن میں اختلاف کیا گیا ہے، اسی طرح ہے اور کہا گیا ہے کہ ایک آدمی اور عورت اور کہا گیا : ایک آدمی اور دو عورتیں اور اللہ ہی زیادہ جاننے والا ہے۔
15677 Abu Ubaid farmate hain ke Nabi ((صلى الله عليه وآله وسلم)) se poocha gaya: Razaat ke bare mein kin ki gawahi jaiz hai? Farmaya: Ek aadmi ya ek aurat ki gawahi. Ye zaeef asnad hain iski tarah ki asnad ko hujjat nahi banaya jasakta. Muhammad bin Uthman ko jhoot ki tohmat lagayi gayi hai aur Ibn Baylamani zaeef hai aur is par matan mein ikhtilaf kiya gaya hai, isi tarah hai aur kaha gaya hai ke ek aadmi aur aurat aur kaha gaya: Ek aadmi aur do aurten aur Allah hi zyada jaane wala hai.
