Amr bin Shu'aib narrates: A man from Banu Mudlij, named Qatadah, threw a sword at his son, striking and wounding him fatally. Suraqah bin Ja'shum came to Umar and informed him of the incident. Umar instructed him to prepare 120 camels and await his arrival. When Umar arrived, he took 30 pregnant camels, 30 sterile she-camels, and 40 male camels from amongst them and asked, "Where is the brother of the deceased?" He replied, "I am here." Umar said, "Take these." Indeed, the Messenger of Allah (peace and blessings be upon him) said: "There is no retaliation against a killer for the sake of the one killed."
Imam Shafi'i (may Allah have mercy on him) said, "I have heard from many scholars that a father will not be killed in retaliation for his son, and this is what I say as well."
Shaykh (may Allah have mercy on him) said, "This narration is disconnected, and what Imam Shafi'i (may Allah have mercy on him) has emphasized from many scholars is connected."

(١٥٩٦٣) عمرو بن شعیب فرماتے ہیں : بنو مدلج کے ایک قتادہ نامی شخص نے اپنے بیٹے کو تلوار پھینک کر ماری وہ لگ گئی وہ زخمی ہوا اور مرگیا۔ سراقہ بن جعشم حضرت عمر کے پاس آئے تو حضرت عمر کو یہ قصہ بتایا۔ حضرت عمر نے فرمایا کہ ١٢٠ اونٹ تیار کرو اور میرا انتظار کرو تو حضرت عمر آئے، ان اونٹوں میں ٣٠ حقے، ٣٠ جذعے اور ٤٠ خلفہ اونٹ لیے اور فرمایا : مقتول کا بھائی کہاں ہے ؟ تو اس نے کہا : میں یہاں ہوں۔ فرمایا : یہ لے لو۔ بیشک رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : قاتل کے لیے کچھ بھی نہیں ہے۔
امام شافعی (رح) فرماتے ہیں کہ میں نے بہت سارے اہل علم سے سنا ہے کہ والد کو بیٹے کے بدلے قتل نہیں کیا جائے گا اور میں بھی یہی کہتا ہوں۔
شیخ (رح) فرماتے ہیں یہ روایت منقطع ہے اور امام شافعی (رح) نے جو بہت سارے علماء سے تاکید کی ہے وہ موصولاً ہے۔
(15963) Amr bin Shoaib farmate hain : Banu Mudlaj ke ek Qatadah nami shakhs ne apne bete ko talwar phenk kar maari woh lag gayi woh zakhmi hua aur mar gaya. Siraqah bin Jashm Hazrat Umar ke paas aaye to Hazrat Umar ko yeh qissa bataya. Hazrat Umar ne farmaya ke 120 unt taiyar karo aur mera intezaar karo to Hazrat Umar aaye, un oonton mein 30 haqay, 30 jazay aur 40 khalfah unt liye aur farmaya : Maqtool ka bhai kahan hai ? To us ne kaha : mein yahan hoon. Farmaya : Yeh le lo. Beshak Rasool Allah ((صلى الله عليه وآله وسلم)) ne farmaya : Qatil ke liye kuchh bhi nahin hai.
Imam Shafai (rah) farmate hain ke mein ne bahut sare ahle ilm se suna hai ke walid ko bete ke badle qatl nahin kiya jaye ga aur mein bhi yahi kehta hoon.
Sheikh (rah) farmate hain yeh riwayat munqata hai aur Imam Shafai (rah) ne jo bahut sare ulama se taqeed ki hai woh mawsoolan hai.
Abdullah bin Amr bin As (may Allah be pleased with him) narrated that a man from Banu Mudlij gave a slave-girl to another man from the same tribe. She gave birth to a son. When the son grew up, the man told him to do a certain task. The son refused, so the man, out of anger, threw a sword at him, injuring him. The boy later died from that injury. His tribe went to Umar and told him the whole story. Umar said, “O enemy of Allah! You killed your son. If I had not heard the Prophet (peace and blessings of Allah be upon him) saying that a father should not be killed for his son, I would have killed you. Bring the blood money.” He brought 120 or 130 camels. Umar took 100 camels from him and gave them to the heirs of the deceased, but he did not give anything to the father.
Umar (may Allah be pleased with him) also said, “This was the judgment of the Prophet (peace and blessings of Allah be upon him) that a son may be killed in retaliation for the murder of his father, but a father may not be killed for the murder of his son.”

(١٥٩٦٤) عبداللہ بن عمرو بن عاص (رض) فرماتے ہیں کہ میں نے بنو مدلج کے ایک شخص کو لونڈی دی، اس سے اس کا بیٹا بھی پیدا ہوا جب وہ بیٹا جوان ہوگیا تو اس شخص نے اسے کہا کہ فلاں فلاں میرا کام کرو، اس نے انکار کیا تو اس شخص نے غصے میں تلوار اسے پھینک کر ماری، جس سے وہ زخمی ہوگیا اور پھر اس زخم سے وہ مرگیا۔ اس کی قوم کے لوگ حضرت عمر کے پاس آئے اور سارا واقعہ سنایا تو حضرت عمر نے فرمایا : او اللہ کے دشمن ! تو نے اپنے بیٹے کو قتل کیا ہے۔ اگر میں نے نبی (صلی اللہ علیہ وآلہ وسلم) کا یہ فرمان نہ سنا ہوتا کہ باپ کو بیٹے کے بدلے قتل نہیں کیا جائے گا تو میں تجھے قتل کردیتا۔ لاؤ دیت دو تو وہ ١٢٠ یا ١٣٠ اونٹ لایا۔ حضرت عمر نے ان سے ١٠٠ اونٹ لے کر اس کے ورثاء کو دے دیے اور باپ کو کچھ نہ دیا۔
اور حضرت عمر (رض) یہ بھی فرماتے ہیں کہ نبی (صلی اللہ علیہ وآلہ وسلم) کا یہ فیصلہ تھا کہ بیٹے کو تو باپ کے بدلہ میں قتل کیا جائے گا باپ کو نہیں۔
(15964) Abdullah bin Amro bin Aas (Razi Allah Anhu) farmate hain ke maine Banu Mudlaj ke ek shakhs ko laundi di, iss se uska beta bhi paida hua jab woh beta jawan hogaya to iss shakhs ne usse kaha ke falan falan mera kaam karo, usne inkar kiya to iss shakhs ne ghusse mein talwar usse phenk kar maari, jiss se woh zakhmi hogaya aur phir iss zakhm se woh mar gaya. Iss ki qaum ke log Hazrat Umar ke paas aaye aur sara waqea sunaya to Hazrat Umar ne farmaya: O Allah ke dushman! Tu ne apne bete ko qatl kiya hai. Agar maine Nabi ((صلى الله عليه وآله وسلم)) ka yeh farmaan na suna hota ke baap ko bete ke badle qatl nahi kiya jayega to mein tujhe qatl karta. Lao deit do, to woh 120 ya 130 unt laya. Hazrat Umar ne unse 100 unt le kar uske warisai ko de diye aur baap ko kuchh na diya.
Aur Hazrat Umar (Razi Allah Anhu) yeh bhi farmate hain ke Nabi ((صلى الله عليه وآله وسلم)) ka yeh faisla tha ke bete ko to baap ke badle mein qatl kiya jayega baap ko nahi.
Umar bin Khattab (ra) narrates that I heard from the Messenger of Allah (peace be upon him and his family) that a father will not be killed for his son (i.e., in retaliation for the son's crime).

(١٥٩٦٥) عمر بن خطاب (رض) فرماتے ہیں کہ میں نے رسول اللہ (صلی اللہ علیہ وآلہ وسلم) سے سنا کہ والد سے اس کے بیٹے کا قصاص نہیں لیا جائے گا۔
(15965) Umar bin Khattab (RA) farmate hain keh maine rasool Allah (SAW) se suna keh walid se uske bete ka qisas nahin liya jaye ga.
Ibn Abbas (may Allah be pleased with him) reported that the Prophet (peace and blessings of Allah be upon him) said: "Do not carry out punishments in mosques, and a son shall not be punished for the crime of his father."

(١٥٩٦٦) ابن عباس (رض) فرماتے ہیں کہ آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : حدود کو مساجد میں نہ قائم کرو اور والد سے بیٹے کا قصاص نہیں لیا جائے گا۔
(15966) Ibn Abbas (RA) farmate hain keh aap ((صلى الله عليه وآله وسلم)) ne farmaya: hudood ko masajid mein na qaim karo aur walid se bete ka qisas nahin liya jaye ga.
(15967) Ibn 'Abbas (may Allah be pleased with him) narrated that the Messenger of Allah (peace and blessings of Allah be upon him) said: "Do not carry out punishments in the mosque, and retaliation shall not be taken from a father for his son."
