Chapter: Prohibition of intending to kill women and children
باب النهي عن قصد النساء والولدان بالقتل
Sunan al-Kubra Bayhaqi 18086
(18086) It is narrated from Zahri Ibn Ka'b Ibn Malik, and he from his paternal uncle, that when the Messenger of Allah (peace be upon him) sent him towards Ibn Abi Al-Huqaiq, he forbade him from killing women and children.

(١٨٠٨٦) زہری ابن کعب بن مالک سے اور وہ اپنے چچا سے نقل فرماتے ہیں کہ جب رسول کریم (صلی اللہ علیہ وآلہ وسلم) نے انھیں ابن ابی الحقیق کی طرف بھیجا تو عورتوں اور بچوں کے قتل سے منع فرمایا۔
18086 Zuhri Ibn Kaab bin Malik se aur wo apne chacha se naqal farmate hain ki jab Rasool Kareem (صلى الله عليه وآله وسلم) ne unhen Ibn Abi al-Haqiq ki taraf bheja to aurton aur bachchon ke qatl se mana farmaya.
Abdullah bin Umar (may Allah be pleased with him) narrated that during one of the battles of the Messenger of Allah (peace and blessings of Allah be upon him), a slain woman was found. The Prophet (peace and blessings of Allah be upon him) forbade the killing of women and children.

(١٨٠٨٧) حضرت عبداللہ بن عمر (رض) فرماتے ہیں کہ رسول معظم (صلی اللہ علیہ وآلہ وسلم) کے غزوات میں سے کسی غزوہ میں ایک مقتولہ عورت پائی گئی تو آپ (صلی اللہ علیہ وآلہ وسلم) نے عورتوں اور بچوں کے قتل سے انکار فرمایا۔
Hazrat Abdullah bin Umar (RA) farmate hain ki Rasool e Muazzam (SAW) ke ghazwaat mein se kisi ghazwa mein ek maqtoola aurat pai gai to aap (SAW) ne auraton aur bachchon ke qatal se inkar farmaya.
Abdullah bin Umar (may Allah be pleased with him) narrated that during a battle, a woman was found slain. So, the Messenger of Allah (peace and blessings of Allah be upon him) prohibited the killing of women and children. (b) Buraidah narrated that the Prophet (peace and blessings of Allah be upon him) said: Do not kill the children.

(١٨٠٨٨) حضرت عبداللہ بن عمر (رض) نقل فرماتے ہیں کہ کسی غزوہ میں ایک عورت مقتول پائی گئی تو رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے عورتوں اور بچوں کے قتل سے منع فرما دیا۔ (ب) حضرت بریدہ نبی (صلی اللہ علیہ وآلہ وسلم) سے بیان کرتے ہیں کہ تم بچوں کو قتل نہ کرو۔
Hazrat Abdullah bin Umar (RA) naql farmate hain ke kisi ghazwa mein ek aurat maqtool pai gai to Rasool Allah (SAW) ne aurton aur bachchon ke qatal se mana farma diya. (b) Hazrat Buraidah Nabi (SAW) se bayan karte hain ke tum bachchon ko qatal na karo.
Aswad bin Suray reported: I participated in a battle with the Messenger of Allah, peace and blessings be upon him. When we were victorious, the people began to kill and plunder, even killing the children. When it was mentioned to the Messenger of Allah, peace and blessings be upon him, he said, “What is wrong with the people that they think killing the children is lawful?” A man said, “O Messenger of Allah, they are the children of polytheists.” The Prophet said, “And are your children any better than the children of the polytheists?” Then he said, “Do not kill the children,” and he repeated it three times. He said, “Every child is born upon natural instinct, until his tongue speaks clearly, then his parents make him a Jew or a Christian.”
(b) Abu Ja’far said: The meaning of what Ahmad ibn Ubayd said, that every soul is born upon natural instinct, means the natural instinct upon which they were created when He brought them forth from the loins of Adam, when they testified to His oneness.

(١٨٠٨٩) اسود بن سریع فرماتے ہیں کہ میں نے رسول اللہ (صلی اللہ علیہ وآلہ وسلم) کے ساتھ مل کر غزوہ کیا۔ ہمیں کامیابی ملی تو لوگوں نے قتل و غارت کی۔ حتیٰ کہ بچوں کو بھی قتل کردیا۔ جب رسول اللہ (صلی اللہ علیہ وآلہ وسلم) کو پتہ چلا تو فرمایا : لوگوں کو کیا ہوگیا ہے کہ قتل کے جواز میں وہ بچوں کو بھی قتل کرتے ہیں۔ ایک شخص نے کہا : اے اللہ کے رسول ! وہ مشرکین کی اولاد ہیں۔ آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : تمہارے بہتر مشرکین کے بیٹے ہیں۔ پھر فرمایا : بچوں کو قتل نہ کرو، تین مرتبہ فرمایا۔ پھر فرمایا : ہر بچہ فطرت پر پیدا ہ وتا ہے یہاں تک کہ اس کی زبان فصیح ہوجاتی ہے تو اس کے والدین اس کو یہودی یا عیسائی بنا دیتے ہیں۔
(ب) ابو جعفر کہتے ہیں کہ احمد بن عبید کے قول کا معنیٰ کہ ہر جان فطرت پر پیدا ہوتی ہے یعنی وہ فطرت جب انھیں صلب آدم سے نکالا تھا اور انھوں نے توحید کا اقرار کیا تھا۔
(18089) Aswad bin Saria farmate hain ke maine Rasul Allah (Sallallaho Alaihe Wasallam) ke sath mil kar ghazwa kiya. Hamein kamyabi mili to logon ne qatal o gharat ki. Hatta ke bachchon ko bhi qatal kardiya. Jab Rasul Allah (Sallallaho Alaihe Wasallam) ko pata chala to farmaya: Logon ko kya hogaya hai ke qatal ke jawaaz mein woh bachchon ko bhi qatal karte hain. Ek shakhs ne kaha: Aye Allah ke Rasul! Woh mushrikeen ki aulad hain. Aap (Sallallaho Alaihe Wasallam) ne farmaya: Tumhare behtar mushrikeen ke bete hain. Phir farmaya: Bachchon ko qatal na karo, teen martaba farmaya. Phir farmaya: Har bachcha fitrat par paida hota hai yahan tak ke uski zaban fasih hojati hai to uske waldain usko yahudi ya eesae bana dete hain.
(b) Abu Jaffar kahte hain ke Ahmad bin Ubaid ke qaul ka maeny ke har jaan fitrat par paida hoti hai yani woh fitrat jab unhein sulb e Adam se nikala tha aur unhon ne tauheed ka iqrar kiya tha.
