Sunan al-Kubra Bayhaqi 16076
Amr bin Shu'aib, on his father's authority, and he on his father's authority reported that the Prophet, may peace and blessings of Allah be upon him, said: "Whoever intentionally kills a person, then he (the murderer) is to be handed over to the heir (Wali) of the murdered. The Wali then has the option of either accepting blood money or carrying out the death penalty."

(١٦٠٧٦) عمرو بن شعیب اپنے والد سے اور وہ اپنیدادا سے روایت کرتے ہیں کہ نبی (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : جو جان بوجھ کر قتل کرے تو اسے ولی المقتول کے حوالے کیا جائے وہ چاہے تو اس سے دیت لے لے چاہے تو قتل کر دے۔
(16076) Amr bin Shoaib apne walid se aur wo apne dada se riwayat karte hain ke Nabi ((صلى الله عليه وآله وسلم)) ne farmaya: Jo jaan boojh kar qatal kare to use wali ul maqtool ke hawale kiya jaye wo chahe to us se deet le le chahe to qatal kar de.
١٦٠٧٦ - وَأَخْبَرَنَا أَبُو الْحُسَيْنِ بْنُ الْفَضْلِ الْقَطَّانُ، بِبَغْدَادَ، أنبأ أَحْمَدُ بْنُ عُثْمَانَ بْنِ يَحْيَى الْآدَمِيُّ، ثنا إِبْرَاهِيمُ بْنُ الْهَيْثَمِ، ثنا الْهَيْثَمُ بْنُ جَمِيلٍ، ثنا مُحَمَّدُ بْنُ رَاشِدٍ، عَنْ سُلَيْمَانَ بْنِ مُوسَى، عَنْ عَمْرِو بْنِ شُعَيْبٍ، عَنْ أَبِيهِ، عَنْ جَدِّهِ،قَالَ النَّبِيُّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ:" مَنْ قَتَلَ عَمْدًا دُفِعَ إِلَى وَلِيِّ الْمَقْتُولِ فَإِنْ شَاءَ قَتَلَهُ، وَإِنْ شَاءَ أَخَذَ الدِّيَةَ "
