Chapter: Regarding brothers and sisters, and children and grandchildren.

باب: في الإخوة والأخوات والولد، وولد الولد

Sunan al-Darimi 2925

It is narrated on the authority of Masruq that Abdullah bin Masud (may Allah be pleased with him) said about real sisters and paternal sisters: "For real sisters, there will be two-thirds, and what remains will be only for the men, not for the women." Then Masruq, when he came to Madinah, heard the saying of Zayd bin Thabit (may Allah be pleased with him) which he liked very much. Some of his students said: “Will you (your teacher) leave the saying of Abdullah bin Masud?” He replied that when he came to Madinah, he found Zayd bin Thabit to be among the strongest and most knowledgeable in knowledge. Ahmad bin Abdullah bin Yunus said: “I asked Ibn Shahab: What did Zayd say about this? So he said that he made both real and paternal sisters partners (in inheritance).

مسروق رحمہ اللہ سے مروی ہے کہ سیدنا عبداللہ بن مسعود رضی اللہ عنہ نے حقیقی بہنوں اور پدری بہنوں کے بارے میں کہا: حقیقی بہنوں کے لئے دوثلث ہوگا اور جو بچے گا وہ صرف مردوں کے لئے ہوگا عورتوں کے لئے نہیں، پھر مسروق جب مدینہ آئے تو سیدنا زید بن ثابت رضی اللہ عنہ کا قول سنا جو انہیں بہت پسند آیا، ان کے بعض شاگردوں نے کہا: آپ (اپنے استاذ) سیدنا عبداللہ بن مسعود رضی اللہ عنہ کا قول چھوڑ دیں گے؟ انہوں نے جواب دیا کہ میں مدینہ آیا تو سیدنا زید بن ثابت رضی اللہ عنہ کو مضبوط اور پختہ علم والوں میں سے پایا۔ أحمد بن عبداللہ بن یونس نے کہا: میں نے ابن شہاب سے پوچھا: سیدنا زید رضی اللہ عنہ نے اس بارے میں کیا کہا؟ تو انہوں نے کہا کہ حقیقی اور پدری سب کو انہوں نے شریک بنایا۔

Masruq rahimahullah se marvi hai ki Sayyidna Abdullah bin Masood razi Allah anhu ne haqeeqi bahanon aur padri bahanon ke bare mein kaha: haqeeqi bahanon ke liye do tihai hoga aur jo bachega woh sirf mardon ke liye hoga auraton ke liye nahin, phir Masruq jab Madinah aaye to Sayyidna Zaid bin Thabit razi Allah anhu ka qaul suna jo unhen bahut pasand aaya, unke baaz shagirdon ne kaha: Aap (apne ustaad) Sayyidna Abdullah bin Masood razi Allah anhu ka qaul chhod denge? Unhon ne jawab diya ki main Madinah aaya to Sayyidna Zaid bin Thabit razi Allah anhu ko mazboot aur pakka ilm walon mein se paya. Ahmad bin Abdullah bin Younas ne kaha: mainne Ibn Shahab se poocha: Sayyidna Zaid razi Allah anhu ne is bare mein kya kaha? To unhon ne kaha ki haqeeqi aur padri sab ko unhon ne sharik banaya.

(حديث موقوف) أَخْبَرَنَا أَحْمَدُ بْنُ عَبْدِ اللَّهِ، حَدَّثَنَا أَبُو شِهَابٍ، عَنْ الْأَعْمَشِ، عَنْ مُسْلِمٍ، عَنْ مَسْرُوقٍ، عَنْ عَبْدِ اللَّهِ: أَنَّهُ كَانَ يَقُولُ فِي أَخَوَاتٍ لِأَبٍ وَأُمٍّ، وَإِخْوَةٍ وَأَخَوَاتٍ لِأَبٍ: قَالَ: "لِلْأَخَوَاتِ لِلْأَبِ وَالْأُمِّ الثُّلُثَانِ، وَمَا بَقِيَ فَلِلذُّكُورِ دُونَ الْإِنَاثِ"، فَقَدِمَ مَسْرُوقٌ الْمَدِينَةَ، فَسَمِعَ قَوْلَ زَيْدٍ فِيهَا فَأَعْجَبَهُ، فَقَالَ لَهُ بَعْضُ أَصْحَابِهِ: أَتَتْرُكُ قَوْلَ عَبْدِ اللَّهِ؟ قَالَ: إِنِّي أَتَيْتُ الْمَدِينَةَ فَوَجَدْتُ زَيْدَ بْنَ ثَابِتٍ مِنْ الرَّاسِخِينَ فِي الْعِلْمِ. قَالَ أَحْمَدُ: فَقُلْتُ لِأَبِي شِهَاب: وَكَيْفَ قَالَ زَيْدٌ فِيهَا؟ قَالَ: شَرَّكَ بَيْنَهُمْ.

Sunan al-Darimi 2926

Ismail bin Abi Khalid said: We mentioned in the presence of Hakim bin Jabir that Ibn Mas'ud, may Allah be pleased with him, gives two-thirds to real sisters and paternal siblings with real sisters, and whatever is left is divided among men only, and women get nothing. Hakim said: Zayd bin Thabit, may Allah be pleased with him, said: This is the practice of the days of ignorance that only men are heirs and not their women.

اسماعیل بن ابی خالد نے کہا: ہم نے حکیم بن جابر کے پاس تذکرہ کیا کہ سیدنا ابن مسعود رضی اللہ عنہ حقیقی بہن اور پدری بھائی بہن کے ساتھ حقیقی بہنوں کو دو ثلث دیتے ہیں اور جو بچتا ہے وہ صرف مردوں میں تقسیم کرتے ہیں عورتوں کو کچھ نہیں دیتے، حکیم نے کہا: سیدنا زید بن ثابت رضی اللہ عنہ نے کہا: یہ تو دورِ جاہلیت کا عمل ہے کہ عورتوں کے بجائے صرف مرد ہی وارث ہوں، ان کی عورتیں وارث نہ ہوں۔

Ismail bin Abi Khalid ne kaha: hum ne Hakim bin Jabir ke paas tazkira kiya ke Sayyiduna Ibn Masood (رضي الله تعالى عنه) haqiqi bahan aur padri bhai bahan ke saath haqiqi bahnon ko do suls dete hain aur jo bachta hai woh sirf mardon mein taqsim karte hain auraton ko kuch nahin dete, Hakim ne kaha: Sayyiduna Zaid bin Sabit (رضي الله تعالى عنه) ne kaha: yeh to dore jahiliyat ka amal hai ke auraton ke bajaye sirf mard hi waris hon, in ki auraten waris na hon.

(حديث موقوف) حَدَّثَنَا سَعِيدُ بْنُ الْمُغِيرَةِ، عَنْ عِيسَى بْنِ يُونُسَ، عَنْ إِسْمَاعِيل، قَالَ: ذَكَرْنَا عِنْدَ حَكِيمِ بْنِ جَابِر: أَنَّ ابْنَ مَسْعُودٍ قَالَ فِي أَخَوَاتٍ لِأَبٍ وَأُمٍّ وَإِخْوَةٍ وَأَخَوَاتٍ لِأَبٍ: أَنَّهُ كَانَ يُعْطِي لِلْأَخَوَاتِ مِنْ الْأَبِ وَالْأُمِّ الثُّلُثَيْنِ، وَمَا بَقِيَ فَلِلذُّكُورِ دُونَ الْإِنَاثِ، فَقَالَ حَكِيمٌ: قَالَ زَيْدُ بْنُ ثَابِتٍ: "هَذَا مِنْ عَمَلِ الْجَاهِلِيَّةِ أَنْ يَرِثَ الرِّجَالُ دُونَ النِّسَاءِ إِنَّ إِخْوَتَهُنَّ قَدْ رُدُّوا عَلَيْهِنَّ".

Sunan al-Darimi 2927

It is narrated on the authority of Masruq (may Allah have mercy on him) that: Sayyida Aisha (may Allah be pleased with her) used to give inheritance to two daughters, one granddaughter and one grandson. So she used to give two-thirds to both the daughters and the remaining one-third she used to distribute equally among all. And Sayyiduna Abdullah bin Masud (may Allah be pleased with him) did not include the granddaughter (in inheritance). Whatever was left, he would distribute it among the men only, and he used to say: Sisters are in the same category as daughters.

مسروق رحمہ اللہ سے مروی ہے کہ: سیدہ عائشہ رضی اللہ عنہا دو بیٹیوں اور ایک پوتی و ایک پوتے کو میراث میں شریک کرتی تھیں، چنانچہ وہ دونوں بیٹیوں کو دو ثلث دیتی تھیں اور باقی بچا ایک ثلث میں سب کو شریک کرتی تھیں۔ اور سیدنا عبداللہ بن مسعود رضی اللہ عنہ پوتی کو شریک نہیں کرتے تھے، جو بچتا وہ صرف مردوں میں تقسیم کرتے، اور وہ کہتے تھے: بہنیں بیٹیوں کے درجے میں ہیں۔

Masruq rehmatullah alaih se marvi hai ki: Sayyidah Ayesha ( (رضي الله تعالى عنه) ا) do betiyon aur ek poti wa ek pote ko miras mein sharik karti thin, chunancha woh donon betiyon ko do sullas deti thin aur baki bacha ek sullas mein sab ko sharik karti thin. Aur Sayyiduna Abdullah bin Masud (رضي الله تعالى عنه) poti ko sharik nahin karte the, jo bachta woh sirf mardon mein taqsim karte, aur woh kahte the: behenen betiyon ke darje mein hain.

(حديث موقوف) حَدَّثَنَا مُحَمَّدُ بْنُ يُوسُفَ، حَدَّثَنَا سُفْيَانُ، عَنْ مَعْبَدِ بْنِ خَالِدٍ، عَنْ مَسْرُوقٍ، عَنْ عَائِشَةَ:"أَنَّهَا كَانَتْ تُشَرِّكُ بَيْنَ ابْنَتَيْنِ وَابْنَةِ ابْن، وَابْنِ ابْن: تُعْطِي الِابْنَتَيْنِ الثُّلُثَيْنِ، وَمَا بَقِيَ فَشَرِيكُهُمْ. وَكَانَ عَبْدُ اللَّهِ لَا يُشَرِّكُ، يُعْطِي الذُّكُورَ دُونَ الْإِنَاثِ، وَقَالَ: "الْأَخَوَاتُ بِمَنْزِلَةِ الْبَنَاتِ"..

Sunan al-Darimi 2928

Shabi (may Allah have mercy on him) said: Sayyiduna Ibn Mas'ud (may Allah be pleased with him) used to say about a daughter and several granddaughters and one grandson that if their share in the inheritance was less than one-sixth, he would still give them one-sixth, and if their share was more than one-sixth, he would still give them one-sixth. Daughter: half (1/2) Grandson: two-thirds (2/3) Granddaughter: one-sixth (1/6)

شعبی رحمہ اللہ نے کہا سیدنا ابن مسعود رضی اللہ عنہ ایک بیٹی اور کئی پوتیوں اور ایک پوتے کے بارے میں کہتے تھے کہ اگر تقسیم میں ان کے لئے سدس سے کم آتا ہو تو بھی انہیں سدس دیدیتے، اور اگر سدس سے زیادہ آتا تب بھی انہیں سدس دیتے تھے۔ بیٹی نصف 3 پوتا سہمان 2 پوتی سہم سدس

Shabi rehmatullah alaih ne kaha saidna ibn masood (رضي الله تعالى عنه) ek beti aur kai potiyon aur ek pote ke bare mein kehte the ke agar taqseem mein unke liye suds se kam aata ho to bhi unhen suds dete, aur agar suds se zyada aata tab bhi unhen suds dete the. Beti nisf 3. Pota sahman 2. Poti saham suds.

(حديث موقوف) أَخْبَرَنَا مُحَمَّدُ بْنُ يُوسُفَ، حَدَّثَنَا سُفْيَانُ، عَنْ أَبِي سَهْلٍ، عَنْ الشَّعْبِيِّ: أَنَّ ابْنَ مَسْعُودٍ كَانَ يَقُولُ فِي بِنْتٍ وَبَنَاتِ ابْنٍ، وَابْنِ ابْنٍ: "إِنْ كَانَتِ الْمُقَاسَمَةُ بَيْنَهُمْ أَقَلَّ مِنْ السُّدُسِ، أَعْطَاهُمْ السُّدُسَ، وَإِنْ كَانَ أَكْثَرَ مِنَ السُّدُس، ِأَعْطَاهُمُ السُّدُسَ".

Sunan al-Darimi 2929

It is narrated on the authority of Masruq (may Allah have mercy on him) that he used to include daughters, granddaughters, and two sisters in inheritance. So, Alqamah said to him, "Was there anyone among those who said this more knowledgeable than Abdullah ibn Mas'ud (may Allah be pleased with him)?" Masruq (may Allah have mercy on him) said, "No, but I saw Zayd ibn Thabit (may Allah be pleased with him) and the people of Medina including them in inheritance."

مسروق رحمہ اللہ سے مروی ہے کہ وہ بیٹی، پوتی اور دو بہنوں کو وراثت میں شریک کرتے تھے تو علقمہ نے ان سے کہا کہ ایسا کہنے والوں میں کوئی سیدنا عبداللہ بن مسعود رضی اللہ عنہ سے زیادہ (پختہ علم والے) تھے؟ مسروق رحمہ اللہ نے کہا: نہیں، لیکن میں نے سیدنا زید بن ثابت رضی اللہ عنہ اور اہلِ مدینہ کو دیکھا کہ وہ ان کو شریک کرتے تھے۔

Masrooq rehmatullah alaih se marvi hai ki woh beti, poti aur do behenon ko wirasat mein sharik karte thay to Alqama ne unse kaha ki aisa kehne walon mein koi Sayyiduna Abdullah bin Masood razi Allah tala anhu se zyada (pakka ilm walay) thay? Masrooq rehmatullah alaih ne kaha: nahin, lekin maine Sayyiduna Zaid bin Sabit razi Allah tala anhu aur ahle Madinah ko dekha ki woh unko sharik karte thay.

(حديث موقوف) حَدَّثَنَا مُحَمَّدٌ، حَدَّثَنَا سُفْيَانُ، عَنْ الْأَعْمَشِ، عَنْ إِبْرَاهِيمَ، عَنْ مَسْرُوقٍ: أَنَّهُ كَانَ يُشَرِّكُ فَقَالَ لَهُ عَلْقَمَةُ: هَلْ أَحَدٌ مِنْهُمْ أَثْبَتُ مِنْ عَبْدِ اللَّهِ؟ فَقَالَ: لَا، وَلَكِنِّي رَأَيْتُ زَيْدَ بْنَ ثَابِتٍ، وَأَهْلَ الْمَدِينَةِ "يُشَرِّكُونَ فِي ابْنَتَيْنِ وَبِنْتِ ابْن، ٍوَابْنِ ابْن، وَأُخْتَيْنِ".

Sunan al-Darimi 2930

Muhammad Ibn Sirin (may Allah have mercy on him) narrated from Qadi Shurayh that a woman left behind her husband, mother, full sister, paternal half-sister and maternal half-brother. So, they divided (the inheritance) by six and increased it to ten. And they gave the husband three shares (i.e. three out of six), half the share, and they gave the full sister the remaining three shares, i.e. half the share. Then they gave the mother one-sixth (one share), and the maternal half-brother two shares, which is one-third, and the paternal half-sister one share, completing one-third.

محمد بن سیرین رحمہ اللہ نے قاضی شریح سے روایت کیا کہ ایک عورت نے اپنا شوہر، ماں، حقیقی بہن، پدری بہن اور مادری بھائی چھوڑے تو انہوں نے چھ سے تقسیم کی اور اس کو بڑھا کر دس کیا اور شوہر کو تین سہم (یعنی چھ میں سے تین) نصف حصہ دیا، حقیقی بہن کو باقی تین سہم یعنی نصف حصہ دیدیا، پھر ماں کو سدس (ایک سہم) اور مادری بھائیوں کو ثلث یعنی دو سہم اور پدری بہن کو ثلثین پورا کرتے ہوئے ایک سہم دیا۔

Muhammad bin Sirin rehmatullah ne qazi shrih se riwayat kia keh aik aurat ne apna shohar, maan, haqeeqi behan, padri behan aur madri bhai chhore to unhon ne chhe se taqseem ki aur us ko barha kar das kia aur shohar ko teen saham (yani chhe mein se teen) nisf hissa dia, haqeeqi behan ko baqi teen saham yani nisf hissa dedia, phir maan ko suds (aik saham) aur madri bhaion ko suls yani do saham aur padri behan ko sulsain pura karte hue aik saham dia.

(حديث مقطوع) حَدَّثَنَا مُحَمَّدُ بْنُ يُوسُفَ، حَدَّثَنَا سُفْيَانُ، عَنْ هِشَامٍ، عَنْ مُحَمَّدِ بْنِ سِيرِينَ، عَنْ شُرَيْحٍ:"فِي امْرَأَةٍ تَرَكَتْ زَوْجَهَا، وَأُمَّهَا، وَأُخْتَهَا لِأَبِيهَا وَأُمِّهَا، وَأُخْتَهَا لِأَبِيهَا، وَإِخْوَتَهَا لِأُمِّهَا، جَعَلَهَا مِنْ سِتَّةٍ، ثُمَّ رَفَعَهَا فَبَلَغَتْ عَشْرَةً، لِلزَّوْجِ النِّصْفُ ثَلَاثَةُ أَسْهُمٍ، وَلِلْأُخْتِ مِنْ الْأَبِ وَالْأُمِّ النِّصْفُ ثَلَاثَةُ أَسْهُمٍ، وَلِلْأُمِّ السُّدُسُ سَهْمٌ، وَلِلْإِخْوَةِ مِنْ الْأُمِّ الثُّلُثُ سَهْمَانِ، وَلِلْأُخْتِ مِنْ الْأَبِ سَهْمٌ تَكْمِلَةُ الثُّلُثَيْنِ".
