The Holy Prophet (peace and blessings of Allah be upon him) said: You people come to me with your disputes, while I am also a human being like you. It may be that some of you are more eloquent in argument than others, and I judge between you according to what I hear from you. So, whoever I decree something for from his brother's right, let him not take it, for it is but a piece of fire that will come with him on the Day of Judgment.
حضور اقدس (صلی اللہ علیہ وآلہ وسلم) نے ارشاد فرمایا : تم لوگ اپنا جھگڑا لے کر میرے پاس آتے ہو، جبکہ میں بھی تمہاری طرح انسان ہوں، شاید کہ تم میں سے بعض لوگ بعض پر دلائل میں سبقت لے جائیں، اور میں تو تمہارے درمیان اسی کے مطابق فیصلہ کروں گا جو تم سے سنوں گا، پس جس کے لیے میں اس کے بھائی کے حق میں سے کچھ بھی فیصلہ کر دوں وہ اس کو نہ لے، بیشک وہ تو آگ کا ایک ٹکڑا ہے۔ جو قیامت کے دن اس کے ساتھ آئے گا۔
Huzoor Aqdas (Sallallahu Alaihi Wasallam) ne irshad farmaya: Tum log apna jhagda le kar mere pass aate ho, jabkeh main bhi tumhari tarah insan hun, shayad keh tum mein se baaz log baaz par dalail mein subqat le jayen, aur main to tumhare darmiyan usi ke mutabiq faisla karunga jo tum se sununga, pas jis ke liye main us ke bhai ke haq mein se kuchh bhi faisla kar dun woh us ko na le, beshak woh to aag ka ek tukda hai. Jo qayamat ke din us ke saath aaye ga.
It is narrated on the authority of Hazrat Umm Salama (may Allah be pleased with her) that two persons from the Ansar came to the Prophet (peace and blessings of Allah be upon him) disputing over an inheritance. They had no witnesses. The Prophet (peace and blessings of Allah be upon him) said, "You people come to me with your disputes, and I am just a human being like you. Perhaps some of you are more eloquent and persuasive in argument than others, and I judge between you according to what I hear. So whoever I rule in favor of, taking from his brother's right, let him not take it, for indeed it is a piece of fire that will be a collar of fire around his neck on the Day of Judgment." Hazrat Umm Salama (may Allah be pleased with her) said that upon hearing this, both of them began to cry, and each one began to say to the other, "My right is for my brother." The Holy Prophet (peace and blessings of Allah be upon him) said, "Now that you have done this, go both of you and divide the inheritance between yourselves with fairness and intending to uphold the right. Then cast lots between yourselves, and then each of you should make his share lawful for his brother."
حضرت ام سلمہ (رض) سے مروی ہے کہ انصار کے دو شخص میراث کے متعلق جھگڑتے ہوئے آنحضرت (صلی اللہ علیہ وآلہ وسلم) کے پاس آئے، ان کے پاس گواہ نہ تھے، آنحضرت (صلی اللہ علیہ وآلہ وسلم) نے ارشاد فرمایا : تم لوگ اپنا جھگڑا لے کر میرے پاس آتے ہو میں بھی تمہاری طرح ایک انسان ہوں، شاید کہ تم میں سے بعض بعض پر حجت و دلیل میں غالب آجائے ، میں تو تمہارے درمیان اسی کے مطابق فیصلہ کرتا ہوں جو سنتا ہوں، پس جس کے لیے اس کے بھائی کے حق میں سے فیصلہ جائے تو اس کو چاہیے کہ وہ وصول نہ کرے، بیشک وہ تو آگ کا ایک ٹکڑا ہے ، جو قیامت کے دن اس کی گردن میں آگ کا کڑا ہوگا، حضرت ام سلمہ (رض) فرماتی ہیں کہ یہ سن کر وہ دونوں رونے لگے ، اور ہر ایک دوسرے سے کہنے لگا کہ میرا حق میرے بھائی کے لیے ہے۔ حضور اقدس (صلی اللہ علیہ وآلہ وسلم) نے ارشاد فرمایا : جب تم یہ کرچکے تو اب تم دونوں جاؤ اور آپس میں تقسیم کرلو، اور حق کا ارادہ کرو اور پھر آپس میں قرعہ ڈال لو، پھر چاہیے کہ تم میں سے ہر ایک اپنا حصہ اپنے بھائی کے لیے حلال کر دے۔
Hazrat Umm Salma (RA) se marvi hai ki Ansar ke do shakhs miراث ke mutalliq jhagadte hue Aanhazarat (Sallallahu Alaihi Wasallam) ke paas aaye, un ke paas gawah na the, Aanhazarat (Sallallahu Alaihi Wasallam) ne irshad farmaya : Tum log apna jhagda le kar mere paas aate ho main bhi tumhari tarah ek insan hun, shayad ki tum mein se baaz baaz per hujjat o daleel mein ghalib aa jaye, main to tumhare darmiyan usi ke mutabiq faisla karta hun jo sunta hun, pas jis ke liye us ke bhai ke haq mein se faisla jaye to us ko chahiye ki woh wasool na kare, beshak woh to aag ka ek tukda hai, jo qayamat ke din us ki gardan mein aag ka kada hoga, Hazrat Umm Salma (RA) farmati hain ki yeh sun kar woh dono rone lage, aur har ek dusre se kahne laga ki mera haq mere bhai ke liye hai. Huzoor Aqdas (Sallallahu Alaihi Wasallam) ne irshad farmaya : Jab tum yeh kar chuke to ab tum dono jao aur aapas mein taqseem kar lo, aur haq ka irada karo aur phir aapas mein quraa daal lo, phir chahiye ki tum mein se har ek apna hissa apne bhai ke liye halal kar de.
It is narrated on the authority of Abu Hurairah (may Allah be pleased with him) that the Messenger of Allah (peace and blessings of Allah be upon him) said: I am only a human being like you. It may be that some of you are more eloquent and persuasive in argument than others. So whoever takes even a span of land belonging to his brother, he will be made to carry a burden of it on the Day of Resurrection.
حضرت ابوہریرہ (رض) سے مروی ہے کہ حضور اقدس (صلی اللہ علیہ وآلہ وسلم) نے ارشاد فرمایا : میں بھی تمہاری طرح انسان ہوں ، شاید تم میں سے بعض ، بعض پر حجت و دلیل میں غالب آجائے، پس جو اپنے بھائی کا ایک ٹکڑا بھی لے گا تو وہ قیامت کے دن آگ کا ٹکڑا ہوگا۔
Hazrat Abu Hurairah (RA) se marvi hai keh Huzoor Aqdas (Sallallahu Alaihi Wasallam) ne irshad farmaya: mein bhi tumhari tarah insan hun, shayad tum mein se baaz, baaz per hujjat o daleel mein ghalib ajaye, pas jo apne bhai ka ek tukda bhi le ga to woh qayamat ke din aag ka tukda hoga.
Hazrat Shuraih was telling the quarreling people: 'Soon the oppressor will realize the right (due) of (the one) which he has diminished, for indeed, the oppressor is (like one) waiting for an eagle and the oppressed is waiting for help.'
حضرت شریح جھگڑنے والوں سے فرما رہے تھے کہ : عنقریب ظالم حق کو جان لیں گے جو انھوں نے کم کیا ہے، بیشک ظالم عقاب اور مظلوم مدد کا منتظر ہے۔
Hazrat Shurai jhagadne walon se farma rahe thay ke: anqareeb zaalim haq ko jaan len ge jo unhon ne kam kya hai, beshak zaalim azab aur mazloom madad ka muntazir hai.
Prophet Muhammad (peace be upon him) said that Hazrat Shuraih used to say, "O Abdullah! By God, I have passed a verdict in your favor. I believe that you are a wrongdoer, but I don't give a verdict based on my suspicion and opinion. I have given the verdict based on the witnesses you presented. Surely, what is forbidden for you will not become permissible because of my verdict."
حضرت محمد (صلی اللہ علیہ وآلہ وسلم) فرماتے ہیں کہ حضرت شریح خصم سے فرماتے، اے عبداللہ ! خدا کی قسم میں نے تیرے حق میں فیصلہ کیا ہے، اور میرا خیال ہے کہ تو ظالم ہے لیکن میں اپنے ظن اور خیال پر فیصلہ نہیں کرتا، میں تو ان گواہوں پر فیصلہ کرتا ہوں جو تو نے پیش کئے، بیشک میرے فیصلہ کرنے سے جو چیز تیرے لیے حرام ہے وہ حلال نہ ہوگی۔
Hazrat Muhammad (Sallallahu Alaihi Wasallam) farmate hain keh Hazrat Shuraiha khasam se farmate, aye Abdullah! Khuda ki qasam maine tere haq mein faisla kiya hai, aur mera khayal hai keh tu zalim hai lekin mein apne zann aur khayal par faisla nahi karta, mein to un gawahon par faisla karta hun jo tu ne pesh kiye, beshak mere faisla karne se jo cheez tere liye haram hai wo halal na hogi.
