Chapter on a man affecting his wife after the first Tahallul and before the second.
باب الرجل يصيب امرأته بعد التحلل الأول وقبل الثاني
Sunan al-Kubra Bayhaqi 9799
Ata' bin Abi Rabah narrated from Ibn 'Abbas (may Allah be pleased with him) that a man came to him and said: "I had intercourse with my wife before performing the Tawaf of the Ka'bah." Ibn 'Abbas said, "Do you have anything (of wealth)?" He said, "I am wealthy." Ibn 'Abbas said, "Then sacrifice a fat she-camel and feed the poor."

(٩٧٩٩) عطاء بن ابی رباح حضرت ابن عباس (رض) سے نقل فرماتے ہیں کہ ان کے پاس ایک آدمی آیا، اس نے کہا : جس نے بیت اللہ کا طواف کرنے سے پہلے اپنی بیوی سے مجامعت کرلی تھی، فرمایا : تو کیا تیرے پاس کوئی چیز ہے ؟ وہ کہنے لگا : میں مالدار ہوں۔ ابن عباس (رض) نے فرمایا : ایک موٹی تازی اونٹنی ذبح کر کے مساکین کو کھلا دو۔
(9799) Ata bin Abi Rabah Hazrat Ibn Abbas (RA) se naqal farmate hain ke unke paas ek aadmi aaya, usne kaha : jisne Baitullah ka tawaf karne se pehle apni biwi se mujameat karli thi, farmaya : to kya tere paas koi cheez hai ? woh kehne laga : mein maldar hun. Ibn Abbas (RA) ne farmaya : ek moti taazi untni zabah kar ke misakeen ko khila do.
Ata reported on the authority of Ibn Abbas that a man had intercourse with his wife on the day of sacrifice before performing the circumambulation of the Holy Kaaba. He (the Prophet) said: He should sacrifice two she-camels. But there will be no Hajj for them next year.

(٩٨٠١) عطاء حضرت ابن عباس (رض) سے نقل فرماتے ہیں کہ ایک آدمی نے قربانی کے دن بیت اللہ کا طواف کرنے سے پہلے اپنی بیوی سے مجامعت کرلی۔ آپ نے فرمایا : وہ دو اونٹنیاں قربان کریں۔ لیکن آئندہ سال ان پر حج نہ ہوگا۔
(9801) ataa hazrat ibn abbas (rz) se naqal farmate hain ke ek aadmi ne qurbani ke din baitullah ka tawaf karne se pehle apni biwi se mujammaat karli aap ne farmaya woh do untniyan qurban karen lekin aayinda saal un par hajj na hoga
(9802) Ibn Zayd al-Dilami reported from 'Ikrimah, the freed slave of Ibn 'Abbas, that he thought he narrated from Ibn 'Abbas (may Allah be pleased with him) that he said concerning the man who has intercourse with his wife before performing the Tawaf al-Ifadah: He should perform Hajj and offer a sacrifice.

(٩٨٠٢) ابن زیددیلمی حضرت عکرمہ جو ابن عباس کے آزاد کردہ غلام ہیں ان سے بیان کرتے ہیں کہ میرا گمان ہے کہ وہ ابن عباس (رض) سے نقل فرماتے ہیں کہ انھوں نے اس شخص کے بارے میں فرمایا جو طواف افاضہ کرنے سے پہلے اپنی بیوی سے مجامعت کرے تو وہ فرمانے لگے : وہ عمرہ کرے گا اور قربانی کرے گا۔
(9802) ibnezaiddilami hazrat akrama jo ibne abbas ke azad kardah gulam hain unse bayan karte hain ke mera gumaan hai ke woh ibne abbas (raz) se naqal farmate hain ke unhon ne us shakhs ke bare mein farmaya jo tawaf efaza karne se pehle apni biwi se mujameat kare to woh farmane lage : woh umrah karega aur qurbani karega.
(9803) It is reported from Ata' bin Abi Rabah, on the authority of Ibn 'Abbas (may Allah be pleased with him), that he was asked about a Muhrim (a person who is in the state of Ihram) who is in Mina, and he has intercourse with his wife before performing the Farewell Tawaf. He ordered that he should sacrifice a camel.
Imam Shafi'i chooses this very opinion. Imam Malik says that an 'Umrah, a camel sacrifice, and a complete Hajj become obligatory on him.
(B) It is narrated from Rabi'ah, and he abandoned the saying of Ibn 'Abbas due to the opinion of Rabi'ah.
Thawr bin Yazid narrates from 'Ikrimah: "No one is ready to accept his saying."

(٩٨٠٣) عطاء بن ابی رباح حضرت ابن عباس (رض) سے نقل فرماتے ہیں کہ ان سے سوال ہوا کہ محرم آدمی جو منیٰ میں ہے طواف افاضہ سے پہلے اپنی بیوی سے مجامعت کرلیتا ہے انھوں نے حکم دیا کہ وہ ایک اونٹ قربان کرے۔
امام شافعی اسی چیز کو ہم اختیار کریں گے، امام مالک فرماتے ہیں کہ اس کے ذمہ عمرہ، اونٹ کی قربانی اور مکمل حج ہے۔
(ب) ربیعہ سے منقول ہے اور انھوں نے ربیعہ کی رائے کی وجہ سے ابن عباس کے قول کو چھوڑ دیا ہے۔
ثور بن یزید جو عکرمہ سے نقل فرماتے ہیں : ان کا قول کوئی بھی قبول کرنے کے لیے تیار نہیں ہے۔

Imam Shafi isi cheez ko hum ikhtiyar karenge, Imam Malik farmate hain ke uske zimma umrah, unt ki qurbani aur mukammal Hajj hai
(B) Rubiyah se manqol hai aur unhon ne Rubiyah ki rai ki wajah se Ibn Abbas ke qaul ko chhor diya hai
Sor bin Yazid jo Akrama se naqal farmate hain : un ka qaul koi bhi qubool karne ke liye taiyar nahin hai
