Chapter on a woman obligated to perform Hajj if there is a way to it and she is with trustworthy women on a safe, populated route.
باب المرأة يلزمها الحج بوجود السبيل إليه وكانت مع ثقة من النساء في طريق مأهولة آمنة
Sunan al-Kubra Bayhaqi 10129
Muhammad bin 'Abbad Al-Makhzumi narrated from Ibn 'Umar (may Allah be pleased with him) that he heard the Prophet (peace and blessings of Allah be upon him) say: "{ مَنِ اسْتَطَاعَ اِلَیْہِ سَبِیْلًا } (Al-'Imran: 97)" - "Whoever is able to make his way there."

(١٠١٢٩) محمد بن عباد مخزومی ابن عمر (رض) سے نقل فرماتے ہیں کہ اس نے نبی (صلی اللہ علیہ وآلہ وسلم) سے سنا : { مَنِ اسْتَطَاعَ اِلَیْہِ سَبِیْلًا } (اٰل عمران : ٩٧) ” جو اس کی طاقت رکھتا ہو۔ “
Muhammad bin Abad Makhzumi ibn Umar (RA) se naql farmate hain ki usne Nabi (SAW) se suna : { Man istataa ilayhi sabeelan } (Al Imran : 97) ” Jo is ki taqat rakhta ho “.
Adi bin Hatim (may Allah be pleased with him) narrated: I was with the Messenger of Allah (peace and blessings of Allah be upon him) when two men came to him. One was complaining of poverty, and the other was complaining about being robbed on the highway. The Prophet (peace and blessings of Allah be upon him) said, “It will not be long before a woman travels from Hira to Makkah without any fear except the fear of Allah, and the Day of Judgment will not be established until one of you will go out with his charity but will find no one to accept it from him. Wealth will increase in abundance until a man will stand with his charity, but he will not find anyone to accept it from him. Then one of you will stand before Allah, with no screen between him and Allah, nor any translator to convey his speech. Allah will ask him: 'Did I not give you wealth?' He will reply: 'Yes.' Allah will ask: 'Did I not send Messengers to you?' He will reply: 'Yes.' He will look to his right and see nothing but Hellfire, and he will look to his left and see nothing but Hellfire. So protect yourselves from the Hellfire, even with half a date in charity. And if you cannot find even that, then with a kind word."

(١٠١٣٠) عدی بن حاتم فرماتے ہیں : میں رسول اللہ (صلی اللہ علیہ وآلہ وسلم) کے پاس تھا کہ دو آدمی آئے، ایک فقیری و محتاجی کی اور دوسرا راستہ کے کاٹے جانے (یعنی ڈاکوؤں کے پریشان کرنے) کی شکایت کر رہا تھا، آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : تھوڑا وقت ہی گزرے گا کہ ایک عورت حیرہ شہر سے مکہ کا سفر بغیر کسی محافظ کے کرے گی اور قیامت اس وقت تکقائم نہ ہوگی جب تم میں سے کوئی اپنا صدقہ لیے گھومے گا لیکن قبول کرنے والا کوئی نہ ہوگا۔ پھر مال زیادہ ہوجائے گا۔ پھر تم میں سے کوئی اللہ کے سامنے کھڑا ہوگا۔ اللہ اور اس کے بندے کے درمیان حجاب نہ ہوگا اور نہ ہی کوئی ترجمان ہوگا ۔ اللہ پوچھے گا : کیا میں نے تجھے مال نہ دیا تھا ؟ وہ کہے گا : کیوں نہیں، اللہ پوچھیں گے : کیا میں نے رسول مبعوث نہکیے تھے ؟ بندہ کہے گا : کیوں نہیں، بندہ اپنے دائیں بائیں دیکھے گا تو آگ ہی آگ نظر آئے گی لہٰذا تم میں سے ہر ایک اپنے آپ کو آگ سے بچا لے اگرچہ کھجور کا ایک ٹکڑا ہی دے۔ اگر یہ بھی نہ پائے تو اچھی بات کہہ دے۔
10130 Adi bin Hatim farmate hain : mein Rasool Allah ((صلى الله عليه وآله وسلم)) ke paas tha ke do aadmi aaye, ek faqiri o mohtaji ki aur dusra raaste ke kaate jaane (yani dakuon ke pareshan karne) ki shikayat kar raha tha, aap ((صلى الله عليه وآله وسلم)) ne farmaya : thora waqt hi guzre ga ke ek aurat Hira sheher se Makkah ka safar baghair kisi mehfooz ke kare gi aur qayamat us waqt tak qaim na hogi jab tum mein se koi apna sadqa liye ghoome ga lekin qubool karne wala koi na hoga. Phir maal zyada ho jaye ga. Phir tum mein se koi Allah ke samne khara hoga. Allah aur uske bande ke darmiyan hijab na hoga aur na hi koi tarjuman hoga . Allah pooche ga : kya maine tujhe maal na diya tha ? Woh kahe ga : kyon nahin, Allah poochengay : kya maine rasool mab'oos na kiye thay ? Banda kahe ga : kyon nahin, banda apne dayen baayen dekhe ga to aag hi aag nazar aaye gi lihaza tum mein se har ek apne aap ko aag se bacha le agarche khajoor ka ek tukra hi de. Agar ye bhi na paye to achchi baat keh de.
(10131) Adi bin Hatim (may Allah be pleased with him) narrated that we were with the Prophet (peace and blessings of Allah be upon him). A man came and complained about famine, and another complained about highway robbery. The Prophet (peace and blessings of Allah be upon him) said: "O Adi bin Hatim! Have you seen Hira?" I said: "I have not seen it, but I have been informed about it." He (peace and blessings of Allah be upon him) said: "If you live long, you will see a woman traveling from Hira to perform Tawaf of the Ka'bah, fearing none but Allah." I said to myself: "Where will the robbers of the tribe of Tayy go, who have set fire to the cities?" He (peace and blessings of Allah be upon him) said: "If you live long, the treasures of Khosrow will be conquered." I said: "O Messenger of Allah! Khosrow bin Hormuz?" He (peace and blessings of Allah be upon him) said: "Yes, Khosrow bin Hormuz. If you live long, you will see a time when a man will go out with a handful of gold or silver, and he will not find anyone to accept it from him, and when one of you meets Allah on that Day, there will be no interpreter between him and Allah to interpret for him. Then Allah Almighty will say: 'Did I not send to you Messengers who conveyed My Message?' The servant will say: 'Yes.' He will look to his right and see only fire, and to his left and see only fire."
Adi said: "I heard the Messenger of Allah (peace and blessings of Allah be upon him) say: 'Protect yourselves from the fire, even with half a date. And if you do not find half a date, then with a good word.'" Adi said: "I saw a woman who had traveled from Kufa and performed Tawaf of the Ka'bah, fearing none but Allah. And I was also present when the treasures of Khosrow bin Hormuz were conquered. If you live long, you will soon see what Abu al-Qasim (peace and blessings of Allah be upon him) said: 'A man will go out with a handful of gold or silver, and he will not find anyone to accept it from him.'"
Imam Shafi'i's opinion is that the slave girl who traveled with Ibn Umar (may Allah be pleased with him) was neither his Mahram nor was there any Mahram with her.

(١٠١٣١) عدی بن حاتم (رض) فرماتے ہیں کہ ہم نبی (صلی اللہ علیہ وآلہ وسلم) کے پاس تھے۔ ایک آدمی نے آکر فاقہ کی اور دوسرے نے راستے، کاٹے جانے کی شکایت کی، آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : اے عدی بن حاتم ! کیا آپ نے حیرہ دیکھا ہے ؟ میں نے کہا : نہیں دیکھا، لیکن میں اس کے بارے میں خبر دیا گیا ہوں، آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : اگر تیری زندگی لمبی ہوئی تو تو دیکھے گا ایک عورت حیرہ سے کوچ کر کے کعبہ کا طواف کرے گی ، اس کو صرف اللہ کا خوف ہوگا۔ میں نے اپنے دل ہی میں کہا کہ قبیلہ طئی کے ڈاکو کہاں جائیں گے، جنہوں نے شہروں کو آگ لگا رکھی ہے، آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : اگر تیری زندگی لمبی ہوئی تو کسریٰ کے خزانے فتح کیے جائیں گے، میں نے کہا : اے اللہ کے رسول ! کسریٰ بن ہرمز ! آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : ہاں کسریٰ بن ہرمز۔ اگر تیری زندگی لمبی ہوئی تو تو دیکھے گا کہ آدمی ایک مٹھی سونے یا چاندی کی لیکر نکلے گا تو اس کو قبول کرنے والا کوئی نہ ملے گا اور تم میں سے کوئی ایک جس دن اللہ سے ملاقات کرے گا تو اللہ اور بندے کے درمیان کوئی ترجمان نہ ہوگا جو ان کے درمیان ترجمانی کرے۔ پھر اللہ تعالیٰ فرمائیں گے : کیا میں نے تیری طرف رسول نہ مبعوث کیے کہ جنہوں نے میری بات پہنچائی، بندہ کہے گا : کیوں نہیں، وہ اپنے دائیں جانب دیکھے گا تو صرف آگ اور اپنے بائیں جانب دیکھے گا تو صرف آگ۔
عدی کہتے ہیں : میں نے رسول اللہ (صلی اللہ علیہ وآلہ وسلم) سے سنا کہ آگ سے بچو ، چاہے کھجور کے ایک ٹکڑے کے ساتھ ہی۔ اگر کھجور کا ٹکڑا نہ ملے تو اچھی بات کہہ دینا۔ عدی کہتے ہیں کہ میں نے ایک عورت کو دیکھا اس نے کوفہ سے کوچ کیا اور بیت اللہ کا طواف کیا، اس کو صرف اللہ کا خوف تھا اور میں اس وقت بھی تھا جب کسریٰ بن ہرمز کے خزانے فتح کیے گئے۔ اگر تمہاری زندگی لمبی ہوئی تو عنقریب تم دیکھو گے جو ابوالقاسم (صلی اللہ علیہ وآلہ وسلم) نے فرمایا کہ آدمی ایک مٹھی بھر سونا یا چاندی لے کر نکلے گا اور اس کو قبول کرنے والا کوئی نہ ہوگا۔
امام شافعی کا قول قدیم ہے کہ ابن عمر (رض) کے ساتھ ان کی لونڈی نے سفر کیا نہ تو وہ اس کے محرم تھے اور نہ ہی اس کے ساتھ کوئی محرم تھا۔
10131 Adi bin Hatim (RA) farmate hain ki hum Nabi (SAW) ke pas thay. Ek aadmi ne aakar faqa ki aur dusre ne rastay, kate jane ki shikayat ki, aap (SAW) ne farmaya : Aye Adi bin Hatim ! kya aap ne Hira dekha hai ? mein ne kaha : nahi dekha, lekin mein is ke bare mein khabar diya gaya hun, aap (SAW) ne farmaya : Agar teri zindagi lambi hui to tu dekhe ga ek aurat Hira se کوچ kar ke Kaba ka tawaf kare gi , is ko sirf Allah ka khauf hoga. Mein ne apne dil hi mein kaha ki qabeela Tai ke daku kahan jayen ge, jinhon ne shehron ko aag laga rakhi hai, aap (SAW) ne farmaya : Agar teri zindagi lambi hui to Kisra ke khazane fatah kiye jayen ge, mein ne kaha : Aye Allah ke Rasool ! Kisra bin Hurmuz ! aap (SAW) ne farmaya : Haan Kisra bin Hurmuz. Agar teri zindagi lambi hui to tu dekhe ga ki aadmi ek muthi sone ya chandi ki lekar nikle ga to is ko qubool karne wala koi na mile ga aur tum mein se koi ek jis din Allah se mulaqat kare ga to Allah aur bande ke darmiyan koi tarjuman na hoga jo in ke darmiyan tarjumani kare. Phir Allah Ta'ala farmaein ge : kya mein ne teri taraf Rasool na mab'oos kiye keh jinhon ne meri baat pahunchayi, banda kahe ga : kyun nahi, woh apne daein janib dekhe ga to sirf aag aur apne bayen janib dekhe ga to sirf aag.
Adi kahte hain : mein ne Rasool Allah (SAW) se suna ki aag se bacho , chahe khajoor ke ek tukde ke sath hi. Agar khajoor ka tukda na mile to achhi baat keh dena. Adi kahte hain ki mein ne ek aurat ko dekha is ne Kufa se کوچ kiya aur Bait Ullah ka tawaf kiya, is ko sirf Allah ka khauf tha aur mein us waqt bhi tha jab Kisra bin Hurmuz ke khazane fatah kiye gaye. Agar tumhari zindagi lambi hui to anqarib tum dekho ge jo Abu'l-Qasim (SAW) ne farmaya ki aadmi ek muthi bhar sona ya chandi le kar nikle ga aur is ko qubool karne wala koi na hoga.
Imam Shafi'i ka qaul qadeem hai ki Ibn Umar (RA) ke sath in ki laundi ne safar kiya na to woh is ke mehram thay aur na hi is ke sath koi mehram tha.
(10132) Nafi' narrates from Ibn Umar (may Allah be pleased with him) that his slave girl Safiyya used to travel behind him to Makkah.
(b) In Aqabah's narration, it is stated that Ibn Umar's (may Allah be pleased with him) slave girl performed Hajj with him on the back of a camel. Her name was Safiyya.
Imam Shafi'i's (may Allah be pleased with him) modern opinion is: He says that Aisha (may Allah be pleased with her), Ibn Umar, and Urwah say that a woman can travel without a mahram.

(١٠١٣٢) نافع، ابن عمر (رض) سے نقل فرماتے ہیں کہ ان کی لونڈی صفیہ ان کے ساتھ پیچھے بیٹھ کر مکہ کا سفر کرتیں۔
(ب) عقبہ کی روایت میں ہے کہ ابن عمر (رض) کی لونڈی نے ان کے ساتھ اونٹ کی پشت پر حج کا سفر کیا، اس کا نام صفیہ تھا۔
امام شافعی (رض) کا جدید قول ہے : فرماتے ہیں کہ حضرت عائشہ (رض) ابن عمر اور عروہ فرماتے ہیں کہ عورت بغیر محرم کے سفر کرسکتی ہے۔
10132 Nafi ibn Umar (RA) se naql farmate hain ki un ki laundi Safiyah un ke sath peeche baith kar Makkah ka safar karti.
(b) Aqba ki riwayat mein hai ki Ibn Umar (RA) ki laundi ne un ke sath unt ki pusht par Hajj ka safar kiya, is ka naam Safiyah tha.
Imam Shafi (RA) ka jadeed qaul hai : farmate hain ki Hazrat Aishah (RA) Ibn Umar aur Urwah farmate hain ki aurat baghair mahram ke safar kar sakti hai.
Aisha (RA) narrated that Abu Saeed used to give a religious verdict that a woman should not travel without a mahram. She (Aisha) said: "Do all these women have mahrams?"

(١٠١٣٣) حضرت عائشہ (رض) فرماتی ہیں کہ ابو سعید فتویٰ دیتے تھے کہ عورت بغیر محرم کے سفر نہ کرے۔ فرماتی ہیں : کیا ان سب کے محرم ہیں۔
