Chapter on taking as evidence that his ruling is reconciled among them in the gift based on choice, not acceptance

Sunan al-Kubra Bayhaqi 12001
Nu'man bin Bashir (may Allah be pleased with him) reported: My father brought me to the Messenger of Allah (peace and blessings of Allah be upon him) and said: "O Messenger of Allah! Be a witness that I have given Nu'man such and such of my wealth as a gift." The Prophet (peace and blessings of Allah be upon him) said: "Have you given to all your sons what you have given to Nu'man?" He said: "No." He (peace and blessings of Allah be upon him) said: "Seek a witness other than me. Do you not like that they should be equal in goodness to you?" He said: "Why not?" He (peace and blessings of Allah be upon him) said: "Not now."
In Shu'ba's narration it says: "Do you not like that they should be equal to you in goodness and kindness?" He said: "Yes." He (peace and blessings of Allah be upon him) said: "Then seek a witness other than me."

(١٢٠٠١) نعمان بن بشیر (رض) فرماتے ہیں : میرے والد مجھے رسول اللہ (صلی اللہ علیہ وآلہ وسلم) کے پاس لے کر آئے اور کہا : اے اللہ کے رسول ! آپ گواہ بن جائیں کہ میں نے نعمان کو اپنے مال سے اتنا عطیہ دیا ہے، آپ (صلی اللہ علیہ وآلہ وسلم) نے کہا : کیا تو نے اپنے سارے بیٹوں کو عطیہ دیا ہے، جس طرح نعمان کو دیا ہے ؟ اس نے کہا : نہیں، آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : میرے علاوہ کسی کو گواہ بنا لو، کیا تجھے پسند نہیں کہ وہ تیرے لیے نیکی میں سب برابر ہوں، اس نے کہا : کیوں نہیں۔ آپ نے فرمایا : اس وقت نہیں۔
شعبی کے الفاظ ہیں : کیا تجھے پسند نہیں کہ وہ تیرے لیے نیکی اور کرم میں برابر ہوں ؟ اس نے کہا : ہاں۔ آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : پھر اس پر میرے علاوہ کسی اور کو گواہ بنا لو۔
(12001) Noman bin Bashir (RA) farmate hain : Mere walid mujhe Rasool Allah ((صلى الله عليه وآله وسلم)) ke paas lekar aaye aur kaha : Aye Allah ke Rasool ! Aap gawaah ban jayen ke maine Noman ko apne maal se itna atiya diya hai, Aap ((صلى الله عليه وآله وسلم)) ne kaha : kya tune apne sare beton ko atiya diya hai, jis tarah Noman ko diya hai ? Usne kaha : nahi, Aap ((صلى الله عليه وآله وسلم)) ne farmaya : Mere ilawa kisi ko gawaah bana lo, kya tujhe pasand nahi ke woh tere liye neki mein sab barabar hon, Usne kaha : kyun nahi. Aap ne farmaya : Is waqt nahi.
Shobai ke alfaz hain : Kya tujhe pasand nahi ke woh tere liye neki aur karam mein barabar hon ? Usne kaha : Haan. Aap ((صلى الله عليه وآله وسلم)) ne farmaya : Phir is par mere ilawa kisi aur ko gawaah bana lo.
Narrated Na'man bin Bashir (RA): My father gave me a gift and then Ismail bin As-Saib said from amongst the people, "He has given a gift (only) to his slave." I said, "My mother, 'Amra bint Rawaha, told me to go to Allah's Messenger (ﷺ) and request him to be a witness to this gift." So, we went to the Prophet (ﷺ) and I mentioned that, "My father has given me a gift and 'Amra ordered me to let you be a witness to it." The Prophet (ﷺ) asked (my father), "Have you got any other son besides him?" He said, "Yes." The Prophet (ﷺ) said, "Have you given a similar gift to all your sons as you have given to this one?" He said, "No." Some of the narrators said, "(On that) the Prophet (ﷺ) said, 'This is injustice.' " And some of them said, "This is a special gift which you have given, preferring him to the others or a forced gift, so get somebody else to be a witness to it besides me." In the narration of Mughira, (the words are), "Don't you like that all your children should be equal as regards your kindness and benevolence?" He said, "Yes." The Prophet (ﷺ) then said, "Get someone else to be a witness to this (gift) besides me." And Mujahid said in his narration, "It is their right on you to be just to them as it is your right on them to be good to you."

(١٢٠٠٢) نعمان بن بشیر (رض) سے روایت ہے کہ مجھے میرے والدنے عطیہ دیا، اسماعیل بن سالم نے لوگوں کے درمیان سے کہا : غلام کا عطیہ دیا۔ نعمان نے کہا : میری ماں عمرہ بنت رواحہ نے کہا : تو رسول اللہ (صلی اللہ علیہ وآلہ وسلم) کے پاس جا اور آپ کو گواہ بنا۔ وہ نبی (صلی اللہ علیہ وآلہ وسلم) کے پاس آئے، آپ کے سامنے یہ ذکر کیا کہ میں نے اپنے بیٹے نعمان کو عطیہ دیا ہے اور عمرہ نے مجھ سے سوال کیا ہے کہ میں آپ کو گواہ بناؤں، آپ (صلی اللہ علیہ وآلہ وسلم) نے پوچھا : کیا تیرے اس کے علاوہ اور بھی بیٹے ہیں ؟ اس نے کہا : ہاں آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : کیا تو نے سب کو نعمان کی طرح عطیہ دیا ہے ؟ اس نے کہا : نہیں، بعض محدثین نے نقل کیا ہے کہ یہ ظلم ہے اور بعض نے کہا : یہ خاص عطیہ ہے جو دوسروں کو چھوڑ کر اسے دیا گیا ہے یا مجبوری کا عطیہ ہے۔ پس میرے علاوہ کسی کو گواہ بنا لو۔ مغیرہ کے الفاظ ہیں : کیا تجھے پسند نہیں وہ کہ نیکی اور کرم میں تیرے لیے برابر ہوں۔ اس نے کہا : ہاں۔ آپ (صلی اللہ علیہ وآلہ وسلم) نے کہا : میرے علاوہ کسی کو گواہ بنا لو اور مجاہد نے اپنی حدیث میں ذکر کیا ہے کہ تیرے اوپر ان کے لیے حق ہے کہ ان کے درمیان عدل کر، جس طرح ان پر تیرا حق ہے کہ وہ تجھ سے نیکی کریں۔
(12002) Noman bin Bashir (RA) se riwayat hai ke mujhe mere walid ne atiya diya, Ismail bin Salem ne logon ke darmiyan se kaha: Gulam ka atiya diya. Noman ne kaha: Meri maa Umrah bint Rawah ne kaha: To Rasool Allah ((صلى الله عليه وآله وسلم)) ke pass ja aur aap ko gawa bana. Woh Nabi ((صلى الله عليه وآله وسلم)) ke pass aaye, aap ke samne yeh zikar kiya ke maine apne bete Noman ko atiya diya hai aur Umrah ne mujh se sawal kiya hai ke main aap ko gawa banaun, aap ((صلى الله عليه وآله وسلم)) ne pucha: Kya tere is ke ilawa aur bhi bete hain? Us ne kaha: Haan aap ((صلى الله عليه وآله وسلم)) ne farmaya: Kya tu ne sab ko Noman ki tarah atiya diya hai? Us ne kaha: Nahin, baz muhaddiseen ne naqal kiya hai ke yeh zulm hai aur baz ne kaha: Yeh khas atiya jo doosron ko chhor kar use diya gaya hai ya majboori ka atiya hai. Pas mere ilawa kisi ko gawa bana lo. Mughirah ke alfaz hain: Kya tujhe pasand nahin woh ke neki aur karam mein tere liye barabar hon. Us ne kaha: Haan. Aap ((صلى الله عليه وآله وسلم)) ne kaha: Mere ilawa kisi ko gawa bana lo aur Mujahid ne apni hadees mein zikar kiya hai ke tere upar un ke liye haq hai ke un ke darmiyan adl kar, jis tarah un per tera haq hai ke woh tujh se neki karen.
He (Shu'bi) said: I heard a lengthy narration from Nauman bin Bashir (may Allah be pleased with him). He (Nauman) said in the end that the Prophet (peace and blessings of Allah be upon him) said: “I will not be a witness to this. This is injustice. Let someone else be your witness in this matter and be just in giving gifts to your children just as you would like them to be just with you in good deeds.”

(١٢٠٠٣) شعبی فرماتے ہیں کہ میں نے نعمان بن بشیر (رض) سے لمبا قصہ سنا، انھوں نے آخر میں کہا کہ نبی (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : میں اس پر گواہ نہیں بنتا، یہ ظلم ہے اس پر کسی اور کو گواہ بنالے اور اپنی اولاد کے درمیان عطیہ میں عدل کرو جس طرح تم پسند کرتے ہو کہ وہ نیکی میں تمہارے ساتھ عدل کریں۔
Shabi farmate hain ke maine Nauman bin Bashir (RA) se lamba qissa suna, unhon ne akhir mein kaha ke Nabi (SAW) ne farmaya: mein iss par gawah nahi banta, ye zulm hai iss par kisi aur ko gawah banale aur apni aulad ke darmiyan atiya mein adl karo jis tarah tum pasand karte ho ke wo neki mein tumhare saath adl karen.
(12004) It is narrated from Numan bin Bashir (may Allah be pleased with him) that my father gave me a gift, then he brought me to the Prophet (peace and blessings of Allah be upon him) to make you a witness. You (peace and blessings of Allah be upon him) asked: "Have you given gifts to all your sons?" He said: "No." You (peace and blessings of Allah be upon him) said: "Do you not intend good for them as you intend for this one?" He said: "Why not?" You (peace and blessings of Allah be upon him) said: "I cannot be a witness." You (peace and blessings of Allah be upon him) said: "Observe fairness and justice among your children."
Imam Shafi'i (may Allah have mercy on him) states: Abu Bakr (may Allah be pleased with him) favored Aisha (may Allah be pleased with her) with a gift.
The Sheikh says: Urwah bin Zubair said: Aisha (may Allah be pleased with her) said: Abu Bakr (may Allah be pleased with him) gave me twenty wasqs of dates from his wealth. When the time of his death approached, he sat down, made witnesses, and then said: "O my dear daughter! I prefer that you be wealthy after me among the people, and indeed I have given you twenty wasqs of dates. I want you to take it into your possession and cut it down. However, today it is the property of the heir, and they are your two brothers and two sisters." Aisha (may Allah be pleased with her) said: "O my dear father! This is Asma, my sister, so who is the other one?" He said: "The one in the womb of Juwairiya's daughter, I think it is a girl." Aisha (may Allah be pleased with her) said: "Even if you had given me so much more, I would have returned it to you."
Imam Shafi'i (may Allah have mercy on him) states: Umar (may Allah be pleased with him) favored Asim bin Umar with a gift, and Abdur Rahman bin Auf favored the son of Umm Kulthum.

(١٢٠٠٤) حضرت نعمان بن بشیر (رض) سے روایت ہے کہ میرے والدنے مجھے عطیہ دیا، پھر وہ مجھے نبی (صلی اللہ علیہ وآلہ وسلم) کے پاس لائے کہ آپ کو گواہ بنالیں، آپ (صلی اللہ علیہ وآلہ وسلم) نے پوچھا : کیا تو نے اپنے سارے بیٹوں کو عطیہ دیا ہے ؟ اس نے کہا : نہیں۔ آپ (صلی اللہ علیہ وآلہ وسلم) نے کہا : کیا تو ان سے نیکی کا ارادہ نہیں رکھتاجس طرح اس سے رکھتا ہے ؟ اس نے کہا : کیوں نہیں۔ آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : میں گواہ نہیں بن سکتا، آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : اپنی اولاد میں قربت اختیار کرو۔
امام شافعی (رح) فرماتے ہیں : حضرت ابوبکر (رض) نے حضرت عائشہ (رض) کو عطیہ کے ساتھ فضیلت دی۔
شیخ فرماتے ہیں : عروہ بن زبیر کہتے ہیں : حضرت عائشہ (رض) نے کہا : حضرت ابوبکر (رض) نے مجھے اپنے مال سے بیس وسق کاٹنے والی کھجوریں دیں، جب وفات کا وقت آیا تو بیٹھ گئے پھر گواہ بنایا، پھر کہا : اے پیاری بیٹی ! لوگوں میں سے میرے بعد تیرا غنی ہونا زیادہ پسندیدہ ہے اور بیشک میں نے تجھے بیس وسق کا ٹنے والی کھجوریں دیں ہیں۔ میں چاہتا ہوں کہ تو اسے اپنے قبضے میں لے اور کاٹ لے۔ لیکن آج وہ وارث کا مال ہے اور وہ تیرے دو بھائی اور دو بہنیں ہیں۔ حضرت عائشہ (رض) نے کہا : اے ابا جان ! یہ اسماء میری بہن ہے تو دوسری کون ہے ؟ آپ نے کہا : خارجہ کی بیٹی کے پیٹ میں جو ہے میرے خیال میں وہ لڑکی ہے، حضرت عائشہ (رض) نے کہا اگر آپ مجھے اتنا زیادہ بھی دیتے تو میں آپ کی طرف لوٹا دیتی،۔
امام شافعی (رح) فرماتے ہیں : حضرت عمر (رض) نے عاصم بن عمر کو عطیہ دے کر فضیلت دی اور عبدالرحمن بن عوف نے ام کلثوم کے بیٹے کو فضیلت دی۔
12004 Hazrat Nauman bin Bashir (RA) se riwayat hai ki mere wald ne mujhe ataa diya, phir wo mujhe Nabi (SAW) ke paas laaye ki aap ko gawah bana len, aap (SAW) ne poocha : kya too ne apne sare beton ko ataa diya hai ? Usne kaha : nahi. Aap (SAW) ne kaha : kya too unse neki ka irada nahi rakhta jis tarah is se rakhta hai ? Usne kaha : kyon nahi. Aap (SAW) ne farmaya : mein gawah nahi ban sakta, aap (SAW) ne farmaya : apni aulad mein qurbat ikhtiyar karo.
Imam Shafi (RA) farmate hain : Hazrat Abu Bakar (RA) ne Hazrat Ayesha (RA) ko ataa ke saath fazilat di.
Sheikh farmate hain : Urwah bin Zubair kehte hain : Hazrat Ayesha (RA) ne kaha : Hazrat Abu Bakar (RA) ne mujhe apne mal se bees wasq kaatne wali khajoorein di, jab wafaat ka waqt aaya to baith gaye phir gawah banaya, phir kaha : aye pyari beti ! Logon mein se mere baad tera ghani hona zyada pasandida hai aur beshak maine tujhe bees wasq ka tanne wali khajoorein di hain. Mein chahta hun ki too ise apne qabze mein le aur kaat le. Lekin aaj wo waris ka mal hai aur wo tere do bhai aur do behnen hain. Hazrat Ayesha (RA) ne kaha : aye aba jaan ! Ye Asma meri behen hai to doosri kaun hai ? Aap ne kaha : Jarjah ki beti ke pet mein jo hai mere khayal mein wo ladki hai, Hazrat Ayesha (RA) ne kaha agar aap mujhe itna zyada bhi dete to mein aap ki taraf lauta deti,.
Imam Shafi (RA) farmate hain : Hazrat Umar (RA) ne Asim bin Umar ko ataa dekar fazilat di aur Abdul Rahman bin Auf ne Umme Kulsoom ke bete ko fazilat di.
It is narrated from Nafi' that Ibn Umar (may Allah be pleased with him) divided his inheritance into three or four equal parts for some of his children.

(١٢٠٠٥) نافع سے منقول ہے کہ حضرت ابن عمر (رض) نے اپنی بعض اولاد کے لیے تین یا چار برابر حصے کیے۔
(12005) Nafi se manqol hai keh Hazrat Ibn Umar (RA) ne apni baz aulad ke liye teen ya chaar barabar hisse kiye.
Qasim bin Abdur Rahman Ansari and Ibn Umar (may Allah be pleased with them) went to a man from the Ansar. They bought a piece of land from him. A man came and said: “I see that you bought land and gave it in charity.” Ibn Umar (may Allah be pleased with him) said: “This land is for my son Waqid. He is poor. You have given charity, excluding your other children for him (i.e. your other children will not inherit it).”
Grade: Da'if
(١٢٠٠٦) قاسم بن عبدالرحمن انصاری اور ابن عمر (رض) انصار کے ایک آدمی کے پاس گئے۔ انھوں نے اس سے زمین کا سودا کیا اور اس سے خرید لیا، ایک آدمی آیا اور اس نے کہا : میں نے دیکھا ہے کہ آپ نے زمین خریدی ہے اور اس کو صدقہ کیا ہے، ابن عمر (رض) نے کہا : یہ زمین میرے بیٹے واقد کی ہے، وہ مسکین ہے، آپ نے اپنی دوسری اولاد کے علاوہ اس کو عطیہ دیا۔
Qasim bin Abdurrahman Ansari aur Ibn Umar (RA) Ansar ke aik aadmi ke paas gaye. Unhon ne us se zameen ka sauda kiya aur us se kharid liya, aik aadmi aaya aur us ne kaha : mein ne dekha hai ke aap ne zameen kharidi hai aur us ko sadqa kiya hai, Ibn Umar (RA) ne kaha : yeh zameen mere bete Waqid ki hai, woh miskeen hai, aap ne apni doosri aulad ke ilawa us ko ataa diya.
It is narrated from 'Umar bin Munkadar that the Messenger of Allah (peace and blessings of Allah be upon him) said: "Every owner of wealth has the most right to his wealth." Ibn Wahb said: "He can do whatever he wants with it."

(١٢٠٠٧) عمر بن منکدر سے منقول ہے کہ رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : ہر مال والا اپنے مال کا زیادہ حق دار ہے، ابن وہب نے کہا : وہ جو چاہے اس سے کرے۔
(12007) Umar bin Munkadar se manqol hai keh Rasul Allah ((صلى الله عليه وآله وسلم)) ne farmaya : Har maal wala apne maal ka zyada haqdaar hai, Ibn Wahab ne kaha : Woh jo chahe us se kare.
