Hakam bin Mas'ud Saqafi states that I went to Umar bin Khattab (may Allah be pleased with him). He (Umar) made the real brother a sharer in one-third with the half-brother from the mother's side. A man said to him, "You have made such a decision for the first time." Umar (may Allah be pleased with him) said, "How was the decision (made before)?" He said, "You would decide a share for the half-brother from the mother's side and not for the real brother." Umar (may Allah be pleased with him) said, "That decision was for that (situation) and this decision is for this (occasion)."

(١٢٤٦٧) حکم بن مسعودثقفی فرماتے ہیں کہ میں عمر بن خطاب (رض) کے پاس حاضر ہوا، آپ (رض) نے حقیقی بھائی کو اخیافی بھائی کے ساتھ ثلث میں شریک کیا۔ ایک آدمی نے ان سے کہا آپ نے یہ فیصلہ پہلی دفعہ ایسا کیا ہے، عمر (رض) نے کہا : کیسے فیصلہ کیا تھا ؟ اس نے کہا : آپ نے اخیافی بھائی کے لیے حصہ مقرر کیا تھا اور حقیقی بھائی کے لیے نہ کیا تھا، حضرت عمر (رض) نے کہا : وہ فیصلہ وہاں تھا اور یہ فیصلہ اس (موقع محل) پر ہے۔
Hukum bin Masood Saqafi farmate hain ki main Umar bin Khattab (RA) ke paas hazir hua, aap (RA) ne haqeeqi bhai ko ikhlaafi bhai ke sath suls mein sharik kiya. Ek aadmi ne un se kaha aap ne yeh faisla pehli dafa aisa kiya hai, Umar (RA) ne kaha: kaise faisla kiya tha? Usne kaha: aap ne ikhlaafi bhai ke liye hissa muqarrar kiya tha aur haqeeqi bhai ke liye nah kiya tha, Hazrat Umar (RA) ne kaha: woh faisla wahan tha aur yeh faisla is (mauqa mahal) par hai.
Masud bin Hakam Thaqafi narrates: Umar (may Allah be pleased with him) gave a verdict concerning a woman who left behind her husband, daughter, paternal sister, and maternal sister. Umar (may Allah be pleased with him) gave an equal share of one-third to both the paternal and maternal sisters. A man said, "O Leader of the Believers! You did not include so-and-so in such-and-such a case." Umar (may Allah be pleased with him) replied, "That was the verdict at that time, and this is the verdict today."

(١٢٤٦٩) مسعود بن حکم ثقفی فرماتے ہیں : حضرت عمر (رض) نے ایک عورت کے بارے میں فیصلہ کیا۔ جس نے خاوند، بیٹی، اخیافی بہن اور حقیقی بہن چھوڑی تھی۔ پس عمر (رض) نے اخیافی اور حقیقی بہن کو ثلث میں برابر شریک رکھا۔ ایک آدمی نے کہا : اے امیر المومنین ! آپ نے فلاں فلاں میں شریک نہ کیا تھا، حضرت عمر (رض) نے کہا : وہ اس وقت فیصلہ تھا اور آج یہ فیصلہ ہے۔
(12469) Masood bin Hukm Saqafi farmate hain : Hazrat Umar (RA) ne ek aurat ke bare mein faisla kiya. Jis ne khaavand, beti, akhyafi bahan aur haqiqi bahan chori thi. Pas Umar (RA) ne akhyafi aur haqiqi bahan ko suls mein barabar sharik rakha. Ek aadmi ne kaha : Aye Ameer-ul-Momineen ! Aap ne falan falan mein sharik nah kiya tha, Hazrat Umar (RA) ne kaha : Woh us waqt faisla tha aur aaj yeh faisla hai.
It is narrated from Abi Majliz that Usman (may Allah be pleased with him) used to include paternal and maternal half-brothers in inheritance, while Ali (may Allah be pleased with him) did not.

(١٢٤٧٢) ابی مجلز سے روایت ہے کہ حضرت عثمان (رض) نے اخیافی اور حقیقی بھائیوں کو ثلث میں شریک کیا اور حضرت علی (رض) ان کو شریک نہ کرتے تھے۔
12472 abi majlis se riwayat hai keh hazrat usman (rz) ne akhiafi aur haqeeqi bhaiyon ko suls mein sharik kya aur hazrat ali (rz) un ko sharik nah karte thay.
Zaid bin Thabit (may Allah be pleased with him) said about partners: "Give a share to your elders (fathers), for they are like the trunk of a crooked tree. The father brought them closer and made them partners in a third."

(١٢٤٧٣) حضرت زید بن ثابت (رض) نے شریکوں کے بارے میں کہا : اپنے بڑوں (آبائ) کو حصہ دو وہ کجاوہ کی لکڑی کی مانند ہیں۔ باپ نے ان کو قربت میں زیادہ کیا اور ان کو ثلث میں شریک کیا۔
Hazrat Zaid bin Sabit (RA) ne sharikon ke bare mein kaha : apne baron (abai) ko hissa do woh kajawa ki lakdi ki manind hain. Baap ne un ko qurbat mein ziada kiya aur un ko suls mein sharik kiya.
It is narrated from Ibrahim that Umar, Abdullah and Zaid (may Allah be pleased with them) said: Half for the husband, one-sixth for the mother and they included real brothers and step-brothers in one-third and they said: The father brought them closer in proximity.

(١٢٤٧٤) ابراہیم سے روایت ہے کہ حضرت عمر، عبداللہ اور زید (رض) نے کہا : خاوند کے لیے نصف، ماں کے لیے سدس اور انھوں نے حقیقی بھائیوں اور اخیافی بھائیوں کو ثلث میں شریک کیا اور انھوں نے کہا : باپ نے ان کو قربت میں زیادہ کیا۔
(12474) Ibrahim se riwayat hai ki Hazrat Umar, Abdullah aur Zaid (rz) ne kaha : khaavand ke liye nisf, maan ke liye sudus aur unhon ne haqeeqi bhaiyon aur akhiafi bhaiyon ko sulus mein sharik kiya aur unhon ne kaha : baap ne un ko qurbat mein ziyada kiya.
A narration from Sha'bi states that Umar and Abdullah (may Allah be pleased with them) said: "Mother, husband, and full and half-brothers; for the wife is half, for the mother is a sixth, and both put the full and half brothers together in a third, whether they are male or female," and they said: "The father made them closer in proximity."

(١٢٤٧٥) شعبی سے روایت ہے کہ عمر اور عبداللہ (رض) نے کہا : ماں، خاوند اور اخیافی اور حقیقی بھائیوں میں زوج کے لیے نصف، ماں کے لیے سدس اور دونوں نے اخیافی اور حقیقی بھائیوں کو ثلث میں شریک کیا، مذکر ہوں یا مونث اور کہا : باپ نے ان کو قربت میں زیادہ ہے۔
(12475) Shubi se riwayat hai ke Umar aur Abdullah (rz) ne kaha: maan, khaavand aur akhiafi aur haqeeqi bhaiyon mein zauj ke liye nisf, maan ke liye sudus aur donon ne akhiafi aur haqeeqi bhaiyon ko suls mein sharik kiya, muzakkar hon ya monis aur kaha: baap ne in ko qurbat mein ziada hai.
Hazil ibn Shurahbil said: We came to Abdullah concerning (the inheritance of) a husband, a mother, two paternal brothers, and one full brother. Ali said: The shares have been completed, and nothing is given to the full brother.

(١٢٤٧٧) ہزیل بن شرحبیل کہتے ہیں : ہم عبداللہ کے پاس زوج، ماں دو اخیافی بھائیوں ایک حقیقی بھائی کے بارے میں آئے علی (رض) نے کہا : حصے مکمل ہوچکے ہیں اور حقیقی بھائی کو کچھ نہ دیا۔
Hazil bin Sharahbeel kehte hain : hum Abdullah ke paas zauj, maan do akhayafi bhaiyon ek haqeeqi bhai ke baare mein aaye Ali (raz) ne kaha : hisse mukammal hochuke hain aur haqeeqi bhai ko kuch na diya.
Hazil reports that Abdullah (may Allah be pleased with him) was asked about a woman who left behind her husband, mother, full sister, and paternal half-brother. He said that the husband gets half, the mother gets one-sixth, and the paternal half-brother gets one-third, thus completing the shares with nothing left for the full sister.

(١٢٤٧٨) ہزیل فرماتے ہیں کہ عبداللہ (رض) نے ایسی عورت کے بارے میں کہا جس نے خاوند، ماں، حقیقی بہن اور اخیافی بھائی کو چھوڑا ہو کہ زوج کے لیے نصف، ماں کے لیے سدس اور اخیافی بھائی کے لیے ثلث حصوں کو پورا کرنے والا اور حقیقی بھائی کے لیے کوئی حصہ نہ رکھا۔
Hazil farmate hain keh Abdullah ne aisi aurat ke bare mein kaha jis ne khaavand maan haqeeqi behan aur akhyafi bhai ko chhoda ho keh zauj ke liye nisf maan ke liye sudus aur akhyafi bhai ke liye sulus hisson ko poora karne wala aur haqeeqi bhai ke liye koi hissa nah rakha.
It is narrated from Shabi that Ali and Zaid (may Allah be pleased with them) said: "Half for the spouse, one-sixth for the mother, one-third for the consanguine brother, and the real brother is not made a sharer with the consanguine. And both of them said: 'They are 'Asaba, if anything is left, it is for them, and if nothing is left, then there is nothing for them.'"

(١٢٤٨٠) شعبی سے روایت ہے کہ علی اور زید (رض) نے کہا : زوج کے لیے نصف، ماں کے لیے سدس اور اخیافی بھائی کے لیے ثلث اور حقیقی بھائی کو اخیافی کے ساتھ شریک نہ کیا اور دونوں نے کہا : وہ عصبہ ہیں اگر کوئی چیز بچ جائے تو ان کے لیے ہوگی اور اگر نہ بچے تو ان کے لیے کچھ نہ ہوگا۔
(12480) Shobai se riwayat hai ki Ali aur Zaid (RA) ne kaha: Zauj ke liye nisf, maan ke liye sudus aur akhyafi bhai ke liye sulus aur haqiqi bhai ko akhyafi ke sath sharik na kiya aur dono ne kaha: Woh asaba hain agar koi cheez bach jaye to un ke liye hogi aur agar na bache to un ke liye kuch na hoga.
It is narrated from Shabi that Zaid (may Allah be pleased with him) did not make (anyone) partners (in inheritance). He only gave one-third to his sworn brothers besides his real brothers. Hisham said: I refuted this. I said: Zaid used to make (people) partners (in inheritance).

(١٢٤٨١) شعبی سے روایت ہے کہ زید (رض) شریک نہ کرتے تھے۔ وہ حقیقی بھائیوں کے علاوہ صرف اخیافی بھائیوں کو ثلث دیتے تھے، ہیشم نے کہا : میں نے اس کا رد کیا، میں نے کہا : زید شریک کرتے تھے۔
(12481) Shobai se riwayat hai ke zaid (raz) sharik na karte thay. Woh haqeeqi bhaiyon ke ilawa sirf akhiafi bhaiyon ko suls dete thay, hisham ne kaha : main ne is ka rad kiya, main ne kaha : zaid sharik karte thay.
(12482) Ali (may Allah be pleased with him) used to make a sworn brother as a beneficiary of one-third of his inheritance and would not include his real brothers, saying: "They are 'Asabah (male relatives who inherit the remainder of the estate after the distribution of fixed shares) and nothing would be left for them."

(١٢٤٨٢) حضرت علی (رض) اخیافی بھائی کے لیے ثلث بناتے تھے اور حقیقی بھائیوں کو شریک نہ کرتے تھے اور فرماتے : وہ عصبہ ہیں اور ان کے لیے کچھ نہ بچتا تھا۔
(12482) Hazrat Ali (RA) akhyafi bhai ke liye suls banaate thay aur haqeeqi bhaiyon ko sharik na karte thay aur farmate : woh asaba hain aur un ke liye kuch na bachta tha.
Abdullah bin Salmah narrated that Ali (may Allah be pleased with him) was asked about the brothers from Akhaaf. He said: "What do you think if they were one hundred, would you give more than a third?" They said: "No." He said: "I will not reduce it from that."

(١٢٤٨٣) عبداللہ بن سلمہ فرماتے ہیں کہ حضرت علی (رض) سے اخیافی بھائیوں کے بارے میں پوچھا گیا تو انھوں نے کہا : تیرا کیا خیال ہے اگر وہ ایک سو ہوں تو ثلث سے زیادہ دو گے ؟ انھوں نے کہا : نہیں۔ کہا : میں اس سے کم نہیں کروں گا۔
Abdullah bin Salma farmate hain ki Hazrat Ali (RA) se akhiafi bhaiyon ke bare mein poocha gaya to unhon ne kaha: Tera kya khayal hai agar wo ek so hon to suls se ziada do ge? Unhon ne kaha: Nahin. Kaha: Main is se kam nahin karoon ga.
